Glenn Clerk Treasurer Greencastle Common Council Minutes April 8, 2008 7:00 P.M. Greencastle City Hall Call to Order; Roll Call A. Mayor Murray called the meeting to order at 7:00 PM; upon roll call the following councilors were found present: John Lanie, Jinsie Bingham, Terry J. Smith, and Adam Cohen. Mark Hammer absent. II. Public Petitions and Comments A. None heard. III. Special Requests A. Street Closure 1. Veteran's Memorial Highway — May 3, 2008 a. Mayor Murray reviewed this request from Paul Wilson. Motion by • Terry J. Smith to approve this request as presented, second by John Lanie, unanimous approval. B. Noise Waiver 1. Relay For Life — May 3 — 4, 2008 a. Mayor Murray reviewed this request for this event. Raija Bushnell present representing Relay For Life. Motion by Adam Cohen to approve this request, second by Terry J. Smith, unanimous approval. C. Street Closure 1. Main Street — Fair On The Square and Annual Farmers Market a. Mayor Murray reviewed this request. No one present for this request. Laurie Hardwick reminded Main Street they will need to apply for an Itinerant Merchant permit. John Lanie motion to approve both requests as presented, second by Jinsie Bingham, unanimous approval. 2. Motorcycle Benefit Ride a. Lisa and Scott Eaton requesting use of the Vine Street and Columbia Street lot, Saturday June 14, 2008 from 6:00 AM to 12 midnight for benefit for Boy Scouts, Food Pantry and anonymous individual, motion by Terry J. Smith to approve as requested, second by John Lanie, unanimous approval. 3. Phi Gamma Delta • a. Request to waive noise ordinance on April 26 until 1:00 AM. No one representing this request. Adam Cohen motion to approve this request with stipulation that all neighbors receive letter prior to the event, second by Terry J. Smith, unanimous approval. is IV. Department Reports A. Cemetery — Ernie Phillips, present B. City Engineer — C. Fire Department— Bill Newgent, present D. Park and Recreation — Rod Weinschenk E. Planner— Shannon Norman, present 1. Invited Council to upcoming contractors meeting on April 25 at 8:30 AM to 10:30 AM. F. Police Department — Tom Sutherlin G. Street Department— Paul Wilson H. Wastewater Department — George Russell, present 1. George Russell updated council regarding repairs to asphalt on Jackson Street North. Joe Spiker is working on the repairs. Appears there is a broken pipe in the line and will need to be repaired first. Hope to have this repaired this week. I. Water Works — Ed Phillips, present J. City Attorney - Laurie Robertson Hardwick, present 1. Reported that CSX representative was in today and reported that repairs will begin this week to various crossings. V. Approval of Minutes A. Regular Meeting March 11, 2008 1. Correction to Ken Owen name no s, motion by Jinsie Bingham, second by John Lanie, unanimous approval. VI. Approval of City Claims A. John Lanie reviewed claims and moved to approve as presented, second by Terry J. Smith, unanimous approval. VII. Old Business A. Ordinance 2008 -3, An Ordinance Replacing Ordinance 1996 -5 Regarding Procedures For Drug And Alcohol Testing For Employees With Commercial Drivers Licenses, Second Reading 1. Motion by Adam Cohen to approve on second reading, second by Jinsie Bingham, unanimous approval. VIII. New Business A. Ordinance 2008 -4 - An Ordinance Requiring A Reflective Symbol On Structures Using Engineered Lumber, First Reading 1. Mayor Murray read Ordinance in its entirety. Fire Chief Bill Newgent explained why the need for this Ordinance. a. Motion by Terry J. Smith to approve as presented, second by Jinsie Bingham, unanimous approval. B. Ordinance 2008 -5 — An Ordinance Creating Section 6 -149 Of The Greencastle City Code, Prohibiting Outdoor Hydronic Heaters, First Reading Page 2 of 4 1. Mayor Murray read this ordinance in its entirety. Mayor Murray asked Shannon Norman and Chief Newgent to address this Ordinance. Norman shared that these facilities have been prohibited in other cities in Indiana due to densely populated areas. Councilor Cohen asked how many operating in city at this time and Norman shared she believes there are two or three. Chief Newgent shared that Greencastle Community Schools has a corn burner, however, they are regulated by IDEM, reducing the emissions. Currently we have Ordinances prohibiting open burns. Councilor Smith asked regarding a time frame on using these facilities. Norman shared that the problem with this is that it would not be equitable regulations. Matt Able, homeowner in city, shared he recently purchased a hydronic burner and the attractiveness of these devices is the economical advantage. Councilor Cohen asked Chief Newgent if he believes these to be safer than other structures. Chief Newgent shared that he believes they are safer because they are outside of the main structure of the house. Councilor Cohen asked about the environmental issue regarding these devices. Norman shared that the issue is not knowing what individuals are burning. Councilor Smith shared he has spoken to approximately 30 people in his neighborhood who are concerned about the emission, however, would rather see an ordinance regulating installation, stack height and what is burned than an ordinance eliminating them completely. a. Motion to approve on first reading, second by John Lanie, motion carried with ayes by Jinsie Bingham, John Lanie, Adam Cohen, • nay vote by Terry J. Smith. IX. Reports A. Mayor's Report 1. Reported that website is up and running. Asked councilors for contact information that they would like posted. 2. Savings of about $48,000 in Utility department with consolidation of two departments. 3. Former President Clinton will be here Friday 4. Upcoming events April 23 at 5:30 PM TIF district discussion. B. Clerk- Treasurer's Report 1. Reported cash balances to council. C. Councilors 1. Adam Cohen asking councils permission to share with Council homes that are potentially unsafe in our community. Councilor Cohen shared that he feels this is an immediate concern that we must address. These structures are unsafe and potential hazardous situations for neighborhoods surrounding these structures. Councilor asking that this council appropriate funds in the Riverboat Fund to address these structures. Attorney Hardwick shared information regarding the process to address these structures is very cumbersome and can take many months to finalize. X. Adjournment A.
