HomeMy Public PortalAboutOrdinance 95-7811 1 ORDINANCE NO. 95 -781 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY ZONING CODE TO STREAMLINE EXISTING RESIDENTIAL DEVELOPMENT CRITERIA THE CITY COUNCIL OF THE CITY OF TEMPLE CITY HEREBY ORDAINS AS FOLLOWS: SECTION 1. Based upon the fmdings as contained in the Planning Commission Resolution No. 95- 1773PC and based upon information provided in the staff report and discussion at the Planning Commission meeting of March 28, April 11, May 23 and July 11, 1995, and based upon the City Council public hearing on August 15, 1995, the City Council amends the Zoning Code as described in Sections 2 through 5 below: SECTION 2. The City Council amends Section 9350 of the Temple City Zoning Code to read as follows: 9350. PERMITTED USES. A. Principal Uses. 1. Single family detached dwelling units or two- family (duplex -type) structures at a ratio not to exceed one dwelling unit for each 4,350 square feet of lot area or, when the lot size is greater than 15,000 square feet, a ratio not to exceed one dwelling for each 3,600 square feet of lot area provided that any multiple family residential project with more than four dwelling units shall consist solely of detached, as opposed to attached, dwelling units, except for R -2 zoned parcels with street frontage on Rosemead Boulevard. 2. Multiple family dwelling units shall be permitted as long as a minimum of 4,350 square feet of lot area is available per dwelling unit or, when the lot size is greater than 15,000 square feet, a minimum of 3,600 square feet of lot area per dwelling unit. SECTION 3. The City Council amends Section 9122 of the Temple City Zoning Code to read as follows: 9122. '0' SECTION Open Space shall mean ground floor area other than the required front yard area, driveway, swimming pool, or off - street parking facility, which has an average gradient of not to exceed 5 %, with no building or structure located therein, except for non - habitable structures used exclusively for recreational purposes. Not withstanding any other provision of this Section, open space shall include the required side and rear yard area of any lot provided said area complies with each of the other provisions hereof. SECTION 4. The City Council amends Section 9533 and Section 9563 of the Temple City Zoning Code to read as follows: Ordinance No. 95 -781 Page 2 9533. DESIGN CRITERIA. G. The trash pick -up for condominium conversion projects consisting of four or fewer dwelling units may occur at curbside. Projects which consist of more than four dwelling units shall provide an adequate trash and garbage collection and pick -up area for use within 150 ft. of each unit in a location or locations accessible to a public street or alley, and enclosed on three (3) sides by a five (5) foot high masonry, brick or concrete wall which shall be enclosed with solid decorative gates of the same height. Such areas may be for individual dwelling units independent of others, or for groups of dwelling units or for all such dwelling units. Areas for group use shall be set back or otherwise protected from adjacent properties and streets. 9563. DESIGN CRITERIA. G. The City Council amends Section 9202 of the Temple City Zoning Code to read as follows: 9202. CONDITIONAL USE PERMITS. WHEN REQUIRED The following uses shall be permitted in all zones (except in the residential zones unless otherwise herein provided) provided that a conditional use permit is first obtained pursuant to the provisions of Division III. Uses designated by a ** in the following list of uses shall be approved through an administrative review procedure as set forth in Section 9214. Dwelling units, three or more located on the same lot to include apartments (in all R- zones) ** SECTION 6. This project should result in no significant effects upon the environment and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 7. The City Clerk shall certify to the passage and adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Pasadena Star News, a newspaper circulated in the City of Temple City. 1 1 1 1 Ordinance No. 95 -781 Page 3 APPROVED AND ADOPTED this 5th day of September, 1995.
