HomeMy Public PortalAbout08-20-2007PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, AUGUST 20, 2007 The Common Council of the City of Richmond, Indiana met in regular session Monday, August 20, 2007 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR PARKER President Pappin presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. Also presented were Richmond High School government students Becka McCollum and Sarah Jordan. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the meeting of August 6, 2007, with a second by Councilor Welch. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 9 -2007 — A RESOLUTION SUPPORTING THE APPROVAL OF A LATE FILED APPLICATION FOR A REAL ESTATE TAX ABATEMENT FOR ROSE CITY BUSINESS PARK, LLC. This Resolution would allow Rose City Business Park to file a late Statement of Benefits form. The total value of improvements made to Real Estate has exceeded the projection stated in Ordinance No. 11- 2006. Resolution No. 9 -2007 was referred to the Tax Abatement Committee for due diligence. COMMUNICATION FROM THE MAYOR • Mayor Hutton announced there was no reported flooding during the recent heavy rains. • Ms. Hutton reported a committee is being formed to develop a plan for the Park Department Golf Division. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the August 2 & 9, 2007 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS REPORTS FROM STANDING COMMITTEES REPORTS FROM SPECIAL COMMITTEES REPORTS FROM ORGANIZATIONS MISCELLANEOUS BUSINESS Councilor Sharp reminded Council that the results of the Buxton Study, an exploration of economic development possibilities in the retail sector, will be presented to the public on August 30th at 8:30 a.m. in Vivian Auditorium, Whitewater Hall, IU East. Common Council Minutes August 20, 2007 Page 2 of 3 Councilor Sharp also reminded the public of the Committee of the Whole meeting of Common Council to review the proposed 2008 Budget to be held September 5, 7 PM in the Council Chambers. This meeting will also be televised. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 54 & 59 -2007 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 54 -2007 - AN APPROPRIATION ORDINANCE AMENDING THE 2006 BUDGET (Roseview Transit) The Clerk read Ordinance No. 54 -2007 on first reading by title only. This Ordinance would delete $38,000.00 from Salaries and Wages and add $20,000.00 to Fleet Maintenance — Repair Parts and $18,000.00 to Contractual Service. Councilor Welch moved to amend the title of the Ordinance to read An Appropriation Ordinance Amending the 2007 Budget with a second by Councilor Wissel. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 54 -2007 as amended to second reading and to suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 54 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 54 -2007 as amended on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 54 -2007 as amended with a second by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 54 -2007 as amended to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 54 -2007 on third reading by title only. Ordinance No. 54 -2007 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 59 -2007 - A GENERAL ORDINANCE AMENDING SECTION 70.03 OF THE CITY OF RICHMOND CODE (accident report fees) The Clerk read Ordinance No. 59 -2007 on first reading by title only. This Ordinance would increase the fee for an accident report from the Police Department from $3.00 per report to $8.00 per report effective September 1, 2007. Councilor Welch moved to advance Ordinance No. 59 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 59 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 59 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Lundy moved for engrossment of Ordinance No. 59 -2007 with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 59 -2007 on third reading by title only. Ordinance No. 59 -2007 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING Councilor Wissel moved to amend the Agenda to add Ordinance No. 37 -2007 on second reading with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. ORDINANCE NO. 37 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 The Clerk read Ordinance No. 37 -2007 on second reading by title only. This Ordinance is a request by Bev's Threads for a ten year tax abatement on Real Estate valued at $3,000,000. Tony Foster of Metropolitan Development asked that this Ordinance be amended to reflect the Petitioner as Thor Construction. Thor Construction will be constructing the building and leasing it back to Bev's Threads. Councilor Wissel moved to amend Ordinance No. 37 -2007 naming Thor Construction as the Petitioner with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Mr. Foster noted the Estimated New Value of the Real Estate should be changed to $3,200,000. Councilor Wissel moved to amend Ordinance No. 37 -2007 as amended to reflect the Estimated New Value of Real Estate to be $3,200,000 with a second by Councilor Welch. City Attorney Chidester pointed out a discrepancy in the total amount of salaries for new employees. The Tax Abatement recommended holding Ordinance No. 37 -2007 as amended on second reading.
