ORDINANCE NO. 95 -788
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY AMENDING ARTICLE VI, CHAPTER 2, PART IV, OF THE
TEMPLE CITY MUNICIPAL CODE BY ADDING SECTION 6252
ESTABLISHING THE PENALTY FOR UNAUTHORIZED
COLLECTION OF RECYCLABLE MATERIALS AS AN INFRACTION
AND ALLOWING FOR A PENALTY ASSESSMENT SCHEDULE TO
BE ESTABLISHED BY CITY COUNCIL RESOLUTION
WHEREAS, the City Council of the City of Temple City recognizes the need to enhance the City's
ability to effectively enforce the unauthorized collection of recyclable materials; and
WHEREAS, the Temple City Municipal Code authorizes City officials to issue citations for
municipal code violations; and
WHEREAS, there is a need to establish a penalty and penalty assessment schedule for violations
of this ordinance in order to enhance the City's ability to effectively respond to the significant increase
in reported thefts of recyclable materials.
NOW, THEREFORE, the City Council of the City of Temple City does hereby ordain as follows:
SECTION 1. Section 6252 of the Temple City Municipal Code is hereby added to read:
6252. PUNISHMENT OF VIOLATIONS
Any person violating the provisions or failing to comply with any of the mandatory
requirements of this ordinance is guilty of an infraction punishable by a fine not to exceed
that allowable by California State law, as set forth by City Council resolution. Each such
person shall be guilty of a separate offense for each and every day during any portion of
which any violation of any provision of this ordinance is committed, continued, or
permitted by such person, and shall be punishable accordingly. Pursuant to the provisions
of Section 36900 of the California Government Code, the first and second violations of any
provisions of this ordinance may be enforced as "infractions," while any subsequent
violations shall be deemed and enforced as "misdemeanors."
SECTION 2. The City Clerk shall certify to the passage and adoption of this ordinance and to
its approval by the Mayor and shall cause the same to be published in the Star News, a newspaper of
general circulation and circulated in the City of Temple City.

I, City Clerk of the City of Temple City, hereby certify that the foregoing ordinance, Ordinance
No. 95 -788 was introduced at the regular meeting of the City Council of the City of Temple City held on
the 21st day of November 1995, and was duly passed, approved and adopted by said Council, approved and
signed by the Mayor and attested to by the City Clerk at a regular meeting held on the 5th day of
December 1995 by the following vote:
AYES: Councilman - Budds, Gillanders, Souder, Wilson, Breazeal
NOES: Councilman -None
