The new turn lane on SH-55 will require the relocation of the existing city owned/maintained separated pathway (east of the highway) located within the property of 400 Deinhard Lane (Builders First Source, owned by LN Real Estate). To ensure that the City can continue to own and maintain this pathway once it is reconstructed, a new easement agreement is needed, since the pathway will be moved approximately 5 feet further east within LN Real Estate’s property. Additional easement is also needed along the Deinhard Lane property frontage to accommodate an extended sidewalk that will link the intersection with the driveway entrance to Builders First Source This agenda bill presents the proposed easement agreement between the City of McCall and LN Real Estate. It establishes that the City will own and maintain the pathway/sidewalks and adjoining landscaping, as well as allowing for snow storage, and public utilities within the easement. The agreement has been reviewed and approved by both the City’s and LN Real Estate’s legal counsels and is ready for Council approval.  RECOMMENDED ACTION: Approve the easement agreement between the City of McCall and LN Real Estate at 400 Deinhard Lane and authorize the Mayor to sign all necessary documents.
