Members present: Mayor, Wayne Neddermeyer; Councilmen, Robert Franklin, Williim Reiser,
Arthur Theis, Donald DesLauriers; Clerk, Donna Roehl; Planning and Zoning
Administrator, Anne Dorweiler; Building Inspector, Russel Bouley.
1. COLONIAL DRIVE IN
Mayor Neddermeyer asked if any Council member had an objection to discussing the licensing
of Colonial Drive In Theatre, as it had not been scheduled for discussion. No objections
were given by any member.
Mel Lebewitz of Colonial Drive In stated that they had attempted to meet with Russ Bouley to
discuss the city requirements regarding replacement of the fence. They felt that the license
fee did not have to be paid until determination had been made regarding the fence. Mr. Bouley
stated that he had forgotten the meeting that had been set up. The Mayor reminded Mr. Leb-
ewitz that Mr. Bouley has a business nearby and could have been called.
Members received copies of the police report regarding tickets that had been issued for oper-
ating without a license.
Ralph Hammen, who had asked to have the fence repaired last summer and who had appeared before
Council in October, again explained the condition of the fence behind his house and the fact
that people enter the Drive In through his back yard. Be was also concerned about the fence
location and asked if the owner knew where the property line was.
Anne Dorweiler explained that a fence must be withing 3 feet of a property line and that ord-
inances should be followdd so that problems do not arise each year. It would mean posting a
bond to insure proper fence construction.
Russ Bouley, Wayne Neddermeyer, Donald DesLauriers and Drive In owners agreed to meet the
following morning, March 23rd, to determine location and type of fence needed.
Motion by Robert Franklin, seconded by William Reiser to grant a license to Colonial Drive In
Theatre upon posting of a performance bond of $2500 to insure construction of fence along east
side of property as required by Building Inspector and Councilman DesLauriers; repairs to be
made by April 6th and extension completed by May 15, 1976. Failure to meet deadlines may re-
sult in City calling the bond.
Motion carried unanimously
Mr. Lebewitz discussed license fees, presented list of fees paid in other municipalities. He
asked if Council would consider charging a lower fee. Mayor stated that the fee had been set
for this year and that he could appear when budget for 1977 was determined.
Motion by Donald DesLauriers, seconded by Arthur Theis to grant a cigarette license to Col-
onail Drive In Theatre.
Motion carried unanimously
2. COMPREHENSIVE PLAN
The following revisions of the first draft were made:
Motion -by Robert Franklin, seconded by William Reiser to strike "and Lake Independence areas,"
and add "area" after "Medina-Morningside" on page 13, Item C-1.
Motion carried unanimously
Motion by Robert Franklin, seconded by Arthur Theis to strike "commercial" and "of less than
2 acres" on Page 28, Item 11.
Motion carried unanimously
Discussion of the zoning map.
Motion by Robert Franklin, seconded by William Reiser to revise the Comprehensive Plan zoning
map by moving the "r" designation that includes St. Anne's Church, south of Hamel Rd.
Motion carried unanimously
Motion by Arthur Theis, seconded by Donald DesLauriers to adopt the Community Development
Guide (Comprehensive Plan) as amended, and instruct Clerk to make the above revisions and
the revisions made on October-21, 1976.
Motion carried unanimously
Motion by Arthur Thies, seconded by Robert Franklin to adjourn., Motion carried unanimously
