PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Kathy McNamara, City Attorney Andrew Rawlings, Public Works Director Zech Prouse (via teleconference) and City Clerk/Treasurer Keri West. ABSENT: Council Member Peter Wadsworth. VISITORS: Chris Williams, Kurt Roland, Larie Elliott, Gary Elliott, Ashleigh Yardley, Treyton Kirkendoll, Joanie Marshall, Janene Anderson, Jason Anderson, Jolyn Louk, Brian Smaka, Bill Koester, Kathy Koester, Clark Morsbach, Craig Marshall and Van Jackson. Mayor Gubler welcomed everyone and Council Member McNamara led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of July 20, 2021 were reviewed. Council reviewed the finance reports for the period ending July 31, 2021 (83% of the fiscal year elapsed). The City had $2,072,658.23 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the consent agenda as presented. Council Member McNamara seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: General Water System Discussion—Mayor Gubler stated the water system was predicted to be completed by August 1, 2021. However, it is still not complete. He continued and stated all the large items have been installed and are completed, but the City is now waiting for Rocky Mountain Power to set the transformer. They are not able to do that until they hear from the State of Idaho regarding an electrical inspection. The new tentative date for the completion of the entire project is now September 1, 2021. Mayor Gubler then briefly stated the City may be looking into future water reserves for emergency situations. Approval of Fiscal Year 2022 Annual Appropriations Ordinance (Ord. 267-08-21) —Mayor Gubler stated the budget has been discussed in detail at previous meetings and stated the total budget being proposed is $2,444,596.00. He stated this is a Public Hearing and asked if anyone from the audience would like to speak in favor of or opposed to the proposed budget. No comments made. Mayor Gubler closed this Public Hearing portion of the meeting. Mayor Gubler asked the Council if anyone had any questions or concerns. No comments made. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve Ordinance No. 267-08-21, an Ordinance entitled the Annual Appropriations Ordinance for the IONA CITY COUNCIL REGULAR MEETING—AUGUST 17, 2021 Fiscal Year beginning October 1, 2021, and ending on September 30, 2022, appropriating the sum of $2,444,596 to defray expenses and liabilities of the City of Iona for said fiscal year, authorizing a levy of a sufficient tax upon the taxable property and specifying the objects and purpose for which said appropriation is made. Council Member Thompson also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council President Geray seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Application for Conditional Use Permit; Residential basement occupancy at 3652 N. Dayton Street per Iona City Code 11-4-3(B)(7), submitted by Gary & Lark Elliott — Gary Elliott of 5462 E. Rockwood Avenue approached the podium and stated they purchased the home at 3652 N. Dayton Street after the previous owner lost her husband and moved to another area. Mr. Elliott explained the purpose for buying the home was to have a space for family members to rent while they look for a permanent home in this difficult housing market. He continued and stated they currently have renters occupying the upstairs of the home, while their grandson occupies the basement. Mr. Elliott stated the home is already set up to pay two separate water bills and this will be continued. He continued and stated they live around the corner from the home and are very selective about who they approve as renters. Joanie Marshall of 3588 N. Dayton Street approached the podium and stated she is against this proposal because of the precedence it sets to turn any home into a duplex with multiple renters. She continued and stated there is a lot of development going on in the City with homes that have unfinished basements. She expressed concerns regarding investors purchasing homes, finishing the basements and renting the floors to separate renters. Mrs. Marshall continued and stated she believes the owner of the house should live in the home to allow renters on another floor. She then stated she did not have a problem with the previous owners renting their basement because she knew the owners lived upstairs and would take care of the property. Mr. Elliott spoke again and stated he understands the City Council has the power to set restrictions on Conditional Use Permits and would be able to minimize any precedent this situation would create. He then asked if this situation has been a common request. Mayor Gubler stated that since 2007, there have only been 2 applicants for this type of Conditional Use Permit, but both required the homeowners to live in the home. Mayor Gubler continued and stated the City Council can impose conditions on an approved application, but the outside perspective could cause concern and possible litigation. Jolyn Louk of 5428 E. Rockwood Avenue stated her property is adjacent to the back property line of the home and never had any problems when the previous owners rented their basement. She continued and stated she knows the Elliotts and has no concerns with them renting the house as two separate rentals. She continued and stated if the house sells, the City has no control over who buys it and how many people live in it. Ms. Louk stated she does understand Mrs. Marshall's concerns, but she also realizes an amendment to this section of the City Code is the next item on the agenda to be discussed tonight. Ms. Louk continued and stated the Elliotts have a family member living in the basement that is going to keep an eye on things for them. Mayor 2 IONA CITY COUNCIL REGULAR MEETING—AUGUST 17, 2021 Gubler agreed there is a difference between having a family member living in the home than a paid renter. Bill Koester of 3767 N. Dayton Street approached the podium and stated the City Code requires the basement dwelling to be fully compliant with the International Building Code for residential occupancies. He suggested having the City's Building Inspector visit the basement to conclude if it meets these requirements. Mayor Gubler asked if there were any members in the audience that would like to speak in favor of or opposed to this application. No response. Mayor Gubler then closed the Public Hearing portion of this agenda item. Council Member McNamara stated she is concerned because the previous owners were told they had to live in the home. However, she continued and stated she would approve it if there are family members living in the home. Mayor Gubler then expressed this will become difficult to define and designate the difference between a family member just living in the home versus a rental property. Council President Geray asked if the long-term intention of the Elliotts is to always have a family member living in the home. Mr. Elliott confirmed. Council President Geray began discussing the proposed changes to this section of the City Code that are next on the agenda. He specifically mentioned the proposed section 11-4-3(B)(7)(a) which states, "The owner of the property (or, in the case of an entity owning the property, an owner of the entity; or, in the case of a trust, an individual who is a beneficiary of the trust) must actually reside in the residential structure on the property." Council President Geray stated this amendment could be a benefit to the Elliotts if they intend to always have a family member, or beneficiary of the trust, reside in the home. He continued and explained this would require the Elliotts to have the house owned under a trust and include the family member living in the home as a beneficiary. Council President Geray stated he believes this will give the Elliotts an option and still be compliant with the direction the City wants to go on these situations. Attorney Rawlings clarified this application needs to be considered under the current City Code. Council President Geray stated he understands, but he believes the Elliotts should be given the consideration since they can comply with the updated amendments. He suggested approving it based on the proposed Conditional Use Permit requirements, rather than denying or approving with conditions based on the current code. Attorney Rawlings stated this is a legal way to proceed. Larie Elliott stated the home is already owned under their family trust. Council Member Thompson asked whether the Council wants to include in the permit the annual renewal requirement. Council President Geray stated he does support this requirement. Mayor Gubler stated he thinks the requirement should be changed to allow the City the discretion to review annually, but not be required to do so. Council Member Thompson then asked if the Council would still like to require two separate water bills. Mayor Gubler confirmed and explained both water bills are the responsibility of the owner of the property. 3 IONA CITY COUNCIL REGULAR MEETING—AUGUST 17, 2021 Council President Geray stated if the Elliotts agree to have their application considered under the proposed City Code amendments, he suggested to review and vote on that agenda item before voting on this application. Mr. & Mrs. Elliott agreed to this action. Council then proceed to begin discussion on the next agenda item with the intention of coming back to vote on this application. Discussion and vote of the next agenda item concluded [see next section on"Amendment to Iona City Code 11-4-3, specifying terms for Conditional Uses in R-1 Zones"] and the Council returned to this agenda item. Council discussed conditions for the permit being limited to bedrooms versus the amount of people. Mayor Gubler entertained a motion. Council President Geray made a motion to approve the Conditional Use Permit for Gary & Larie Elliott for the residence at 3652 N. Dayton Street, subject to the updated Conditional Use requirements as outlined in Ordinance No. 268-08-21, and a condition that the permit may be reviewed annually at the City's discretion. Council Member Thompson seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Amendment to Iona City Code 11-4-3, specifying terms for Conditional Uses in R-1 Zones (Ord. 268-08-21) —Council Members began the full discussion of this agenda item, pertaining to residential basement occupancies as Conditional Uses. Joanie Marshall asked Attorney Rawlings if a corporation would be able to purchase a home in Iona and rent it out, listing the renters as beneficiaries. Attorney Rawlings stated if a person or company makes another person a beneficiary of a trust, they will owe that person fiduciary duties as a beneficiary of that trust. He stated it is not 100% guaranteed not to happen, but it would be very rare and would be very risky for the property owner. Attorney Rawlings continued and explained the differences between trusts and entities. Mayor Gubler stated the Planning & Zoning Commission (P&Z) had concerns regarding the water connection requirement for basement rentals. Clerk West stated the P&Z did not agree with the requirement to have a separate water line and connection for the basement occupants. She continued and stated an applicant was denied two years ago to have a non-relative renter in her basement because she did not have a separate water line. Mayor Gubler stated he would like to see this requirement removed. Council Members McNamara and Thompson agreed. Council President Geray disagreed and stated if someone wants to rent their basement for profit, they should meet all of the requirements. Director Prouse agreed with Council President Geray and suggested changing the wording to allow a separate shut-off from the main floor that needs to be inspected by the Plumbing Inspector. Bill Koester stated he is on the P&Z and when they discussed this item they recommended requiring an annual renewal with the separate water line being required after the third year. He also stated if the City changes to water meters in the future, this could cause additional problems. Larie Elliott spoke and stated they own an office building in Idaho Falls with several tenants. She continued and stated they receive one bill from the City of Idaho Falls and they are responsible for splitting it up and paying the bill. Mayor Gubler stated he thinks this should be the 4 IONA CITY COUNCIL REGULAR MEETING—AUGUST 17, 2021 responsibility of the property owner and not the renters. Discussion continued regarding the requirement of separate water lines and bills. Attorney Rawlings explained the Council cannot remove the separate water line requirement without a separate Public Hearing Notice. He suggested approving or denying the proposed ordinance and hold another Public Hearing next month addressing the remaining desired changes. Attorney Rawlings then asked the Council if they would like the property owner to be charged two separate water bills or one water bill with two Equivalent Domestic Users (EDUs). Clerk West stated in some situations, the tenant does receive and pay their own water bill. Council President Geray suggested adding wording to the proposed ordinance for next month to reflect an option for the property owner or the tenant to receive the bill with the owner ultimately responsible for payment. Attorney Rawlings then asked the Council if this section should be limited to only basements, or should it apply to any secondary occupancy on the property. Clerk West stated she has spoken to various residents who are interested in adding a shop to their property with living quarters or a small apartment. Mayor Gubler stated he thinks those residents would need to change the zoning of their lot to R-2. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Ordinance No. 268-08-21, an Ordinance of the City of Iona, Idaho; amending section 11-4-3 of the Iona City Code; specifying terms for Conditional Uses in R-1 Zones; providing methodology; preserving prior ordinances in each instance; providing for severability; and establishing an effective date. Council President Geray also made a motion to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Thompson seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Application for Final Plat and Annexation Agreement; Eagle Rock Engineering, Elim Estates; a Subdivision located on the North side of Iona Road between 45th East and Olsen Street — Mayor Gubler stated the Preliminary Plat was approved at last month's Council Meeting. He asked City Engineer Brian Smaka if all of his concerns have been addressed with the final version of the plat and Annexation Agreement. Mr. Smaka confirmed he has spoken with Eagle Rock and he issued the final approval letter today. Council President Geray asked Kurt Roland with Eagle Rock Engineering if they have received the most recent letters from the City Engineer. Mr. Roland confirmed he has received the letters and agrees to all remaining actions that are still required. Mayor Gubler stated this is a Public Hearing and asked if anyone from the audience would like to address the Council in favor of or opposed to this application. Clark Morsbach of 4840 E. Rockwood Avenue approached the podium and asked what will happen to the ditch between Homer Estates and Elim Estates. Mayor Gubler stated the ditch is an active waterway, so it has to remain. He continued and stated the new water line will have to go under the ditch and will have a sleeve installed around it for maintenance purposes. Director Prouse stated the sleeve is also for the protection of the main line in case any surface water leaks down through the ditch. The sleeve will help keep the main water line from being compromised. 5 IONA CITY COUNCIL REGULAR MEETING—AUGUST 17, 2021 Mayor Gubler also stated there is an existing water line coming off of Rockwood Avenue. This new water line will loop from that line through Elim Estates and to Iona Road. He continued and stated the City will loop the water line to maintain good water pressure for all users. Joanie Marshall asked how big the lots will be in Elim Estates. Mayor Gubler stated the minimum lot size allowed in the City is 1/3 acre. Clerk West stated most of the lots in Elim Estates are close to 1/2 acre. Mayor Gubler asked for other comments from the audience. No response. Mayor Gubler then closed the Public Hearing portion of this agenda item. Attorney Rawlings informed the Council the Annexation Agreement is in its final form and the developer has no problems with any of the provisions. However, there is an issue with the name of the entity as it is recorded with the State of Idaho. Attorney Rawlings continued and stated the Annexation Agreement can be approved subject to this issue being addressed. He also stated the actual Annexation Ordinance will be presented to P&Z and City Council next month. Clerk West asked if the developer is able to begin construction prior to the Annexation Ordinance being passed in September. Attorney Rawlings confirmed they are able to begin after everything from tonight is approved and recorded. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the Final Plat for Elim Estates, including the substance of the Annexation Agreement and the changes coming forth in the next meeting. Council Member McNamara seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES STAFF REPORTS: Director Prouse, Council President Geray, Council Member Thompson and Council Member McNamara all stated nothing to report. Clerk West stated the City Elections will take place soon and the Mayor seat is up for reelection as well as Council Member Thompson and Council Member McNamara. The packets are in the City Office and the deadline to submit them is Friday, September 3`d at 5:00pm. The office will be open that Friday. Clerk West also stated the September Council Meeting will be held on Tuesday, September 28th to allow her to attend the annual conference in Boise.
