HomeMy Public PortalAbout1995-20 Rezoning® ORDINANCE 1995 -20 AN ORDINANCE REZONING 50.53 ACRES (OLD LANDFILL SITE) FROM AG AND C -1 TO I -2 WHEREAS, it was requested that the following described real estate be rezoned from AG and C -1 to 1 -2; and WHEREAS, the rezoning was approved by the Plan Commission at its meeting on September 26, 1995, and certified to the legislative body; NOW THEREFORE be it ordained by the Common Council of the City of Greencastle, Putnam County, Indiana, that: SECTION I. The following described real estate, and the same is, hereby rezoned from AG and C -1 to 1 -2, to wit: Part of the East half of the Northwest quarter of Section 29, Township 14 North, Range 4 West, in Greencastle Township, Putnam County, Indiana, more particularly • described as follows: Beginning at an iron pin at the Southwest corner of the East half of the Northwest quarter of Section 29, Township 14 North, Range 4 West; thence North (basis of bearings in this description) 1809.34 feet with the West line of said half - quarter to an iron pin; 'fence North 65 degrees 05 minutes 09 seconds East 79.07 feet to a point in the center of a public road; thence with the center of said road the following six courses: 1) South 87 degrees 35 minutes 28 seconds East 192.38 feet; 2) South 82 degrees 34 minutes 33 seconds East 215.61 feet; 3) South 76 degrees 27 minutes 24 seconds East 341.34 feet; 4) South 83 degrees 09 minutes 47 seconds East 247.16 feet; 5) North 84 degrees 39 minutes 17 seconds East 180.61 feet; and 6) North 74 degrees 31 minutes 52 seconds East 84.23 feet to an iron pin on the East line of the East half of the Northwest quarter of said Section 29; thence South 00 degrees 13 minutes 11 seconds West 1173.85 feet with said East line to an iron pin in the center of the former Indianapolis and Western Railway right -of -way; thence South 38 degrees 10 minutes 08 seconds West 727.96 feet with said railroad centerline to an iron pin on the South line of the East half of the Northwest quarter of said Section 29; thence North 89 degrees 22 minutes 02 seconds West 861.65 feet with said South line to the point of beginning, containing 50.53 acres, more or less. ALSO: an easement for a term of ten (10) years for the purpose of ingress and egress 50 feet in width, the centerline of which is described as follows: Beginning at the O Southeast corner of the above described 50.53 acre tract, said point described as being on the South line of the East half of the Northwest quarter of Section 29, Township 14 North, Range 4 West, and South 89 degrees 22 minutes 02 seconds East 861.65 feet from an iron Pin at the Southwest corner of said half- quarter; thence South 38 degrees 10 minutes 08 seconds West 89.11 feet; thence South 39 degrees 09 minutes 21 seconds East 73.69 feet; thence South 1 degree 33 minutes 12 seconds West 96.50 feet; thence ® South 5 degrees 50 minutes 03 seconds West 85.72 feet; thence South 7 degrees 41 minutes 55 seconds East 103.58 feet; thence South 5 degrees 10 minutes 51 seconds West 112.36 feet; thence South 82 degrees 31 minutes 50 seconds East (parallel with and 25 feet Northerly from the Eastern end of the South boundary of a 0.38 acre tract described in Deed Record 195, page 611 in the office of the Putnam County Recorder) 982.97 feet to a point in the center of the Greencastle- Manhattan Road. SECTION II. This ordinance shall be in full force and effect from and after its passage, promulgation, approval by the Mayor and publication in accordance with the law.
