HomeMy Public PortalAboutr 03:122No. 03-122 Date of Adoption March 27, 2003 AUTHORIZING THE DECOMMISSION OF AN INGROUND SWIMMING POOL AND REPAIR/REPLACEMENT OF RETAINING WALL AT 64 HAGAMAN STREET WHEREAS, the Borough of Carteret Construction Code Official, Anthony Neibert, has advised the Mayor and Council that the in-ground swimming pool, and the retaining wall adjacent thereto, located at 64 Hagaman Street are presently in such a state of disrepair so as to constitute unsafe structures; and WHEREAS, Mr. Neibert has'further advised the Governing Body that such conditions presently threaten the public health, safety and welfare of the residents of the Borough of Carteret and pose an immediate danger to properties adjacent to the above described location; and WHEREAS, the Borough's Construction Code Office has issued various summonses to the property owner for said conditions and the failure to rectify the same, and this matter has been the subject of several hearings before the Carteret Municipal Court; and WHEREAS, warrants have been issued against the property owner for failure to appear in the Municipal Court and failure to comply with the terms and conditions of the previous orders of the Municipal Court Judge directing that the above conditions be rectified; and WHEREAS, the Carteret Police Department has presently been unable to locate the owner of said property; and WHEREAS, Mr. Neibert has advised the Governing Body that, should these conditions continue to go unabated, an imminent safety hazard exists. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey as follows: 1. That the Borough Engineer, T&M Associates, is hereby directed to investigate the condition of the retaining wall located at 64 Hagaman Street and make recommendations to the Construction Code Official with regard to the repair and/or replacement of the same. 2. That the Construction Code Official is hereby authorize~t and directed to solicit proposals for the decommission of the in-ground swimming pool at said location and to further act upon the recommendations of the Borough Engineer with regard to the retaining wall. PAGE 2 NO. ~ 3. That the Construction Code Officials work with the Borough Attorney and the Finance Department to complete the recommended repairs so as to protect the public health safety and welfare of the residents of the Borough of Carteret. 4. That the Construction Code Official is hereby directed to maintain a detailed accounting of any and all costs incurred with regard to any work conducted at 64 Hagaman Street in completing the above described repairs and provide this information to the Tax Collector so that an appropriate lien reflecting the same may be placed upon the real property constituting ~64 Hagaman Street, Carteret, NJ. 5. That the above-described repairs/replacement are hereby authorized at a maximum cost not to exceed $10,000.00. 6. That a certified copy of this Resolution be forwarded to the Construction Code Official, the Borough Attorney, and the Borough's Finance Department and the Tax Collector.
