INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Tyrell at 2. 7:30 P. M., who then led the Pledge of Allegiance to the Flag. 3. INVOCATION: Invocation was given by City Manager Woollett. 4• ROLL CALL: w - , PRESENT: Councilmen- Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford and City Manager Woollett. APPROVAL OF MINUTES: 1. Minutes of July 23, 19G2. Councilman Dickason referred to page 4 item 16, the last paragraph and added" and that it is the policy of this Council that salaried personnel will not be paid over -time unless specifically approved by the Council." Coun- cilman Merritt referred to item 14B regarding the vote correct- ing his vote as abstaining instead of "AYE ". Councilman Merritt moved to approve the minutes of July 9 , 1962 as corrected, Councilman Nunamaker seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None MINUTES OF REGULAR MEETING OF APRIL 23, 1962. - AMENDMENTS Referring to item 10 TEMPLE CITY IMPROVEMENT #1 SEWERS, WOOLLEY ST. ET AL The last paragraph referring to Resolution No. 62 -201 should precede the paragraph just above referring to Resolution No. 62 -202, and should also include the report from the Health Officer spread opon the minutes as follows: "COUNTY OF LOS ANGELES, HEALTH DEPARTMENT, 241 N. FIGUEROA ST. Los Angeles 12, Calif. January 8, 1962 SUBJECT: Temple City Improvement No. 1, Sanitary Sewers in Woolley Street and Other Rights of Way, Vicinity of Temple City RECOMMENDATION: It is respectfully recommended that sanitary sewers be installed in this district. ANALYSIS: This Department has made an investigation of the Woolley Street and Other. Rights of Way Sanitary Sewer District, Temple City Improvement No. 1, Vicinity of Temple City. During the course of this investigation 19 house -to -house calls were made. Of this number, 7 occupants were not at home or did not answer the door. Of the 12 property owners or tenants actually contacted, 6 or 50% reported having experienced . trouble with their individual subsurface sewage dis- posal systems. They complained that the seepage pits filled up causing raw sewage to back up into the house plumbing fixtures or to overflow onto the surface of the ground. Also that frequent pumping and cleaning out of the seepage pits was necessary. The majority of the homes in this district are from five to seven years old. The effective sidewall lead; ing areas of the seepage pits are now becoming sealed due to their long period of usage. When this condi- tion occurs, the pits cease to function properly and soon fill up. Council Minutes, July 23, 1962, page 2 In view of our survey, I, the undersigned Health Offi- cer of the County of Los Angeles, having been official. ly designated by the City Council or the City of Temple City to perform public health services for the City ,of Temple City, do hereby recommend that proceedings be instituted at once for the construction of sanitary in Woolley Street and Other Rights of Way, City of Temple City. This recommendation is made as an im- provement necessary to the protection of public health and pursuant to the provisions of Section 2808 of the Streets and Highways Code. Very truly yours, K. H. City Attorney Shatford read title to Ordinance No. 62.84 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY, MUNICIPAL CODE TO PROVIDE PLANNING COMMISSION DETERMINATION OF ALL ZONE VARIANCE CASES AND MODIFICATIONS THEREOF WITH RIGHT OF APPEAL TO THE CITY COUNCIL. Councilman Fitzjohn moved to waive further reading, Councilman Nunamaker seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrel NOES: Councilmen =None ABSENT: Councilmen Councilman Nunamaker moved to adopt Ordinance No. 62 -84, Coun- cilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyrell NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Shatford advised any member of the Council may by motion within the time limit allotted institute an appeal. 7. PROPOSED LIBRARY CONTRACT: Fickes & Fickes, Architects Eugene W. Fickes and James T. Fickes were both present and to- gether with the Council reviewed the proposed library contract page by page revising, adding and deleting to negotiate a con- tract agreeable to the architects and the City.All points aoroed upon a new contract will be drawn as corrected to show the amount of the construction to be $185,000. with bona fide bids not to exceed 1 %. Also upon completion the Architect shall be paid $350.00 to furnish the City with as -built drawings showing construction changes in the work and final locations of mechanical service lines and outlets. Progressive dates were set as follows: (1) Schematic Design Phase, date of completion to be Sept. 5th, 1962; (2) & (3) Design Development Phase and Construction Documents Phase to be completed by Jan. 5, 1963. City Attorney Shatford read in full Resolution No. 62 -221 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHOR IZING EXECUTION OF A CONTRACT FOR ARCHITECT- ENGINEER SERVICES OF FICKES & FICKES RE DESIGN OF LIBRARY AND RELATED FACILITIES Councilman Dickason moved to adopt Resolution No. 62 -221, Coun- cilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 8. TEMPLE CITY BEAUTIFUL: STREET PLANTING ON LAS TUNAS DRIVE. City Manager Woollett presented a report on costs of maintenance and watering the trees to be planted in the sidewalks on Las Tunas Drive and recommended the City assume this repsonsibility. 312 Council Minutes, July 23, 1962, page 3 Councilman Merritt moved that the City accept the responsibil- ity of watering and maintenance of the trees to be planted in the sidewalk on Las Tunas Drive, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 9. FINAL ACCEPTANCE OF LIVE OAK RE- CONSTRUCTION FROM BODDUM CON- STRUCTION COMPANY. The City Manager advised the project is completed with additons and changes made and requested the Council to authorize the additional work as detailed on a report from the Road Dept., to accept the work on the cash contract and to approve the es- timate and pay the contractor, Councilman Fitzjohn so moved, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 10. PUBLIC HEARING: 8:00 P. M. Proposed ANNEXATION NO. 4 -A, WEST TEMPLE CITY, UNINHABITED. Mayor Tyrell declared the Public Hearing opened, and asked the City Manager for a report on any protests received. City Mana- ger Woollett advised he had received no written protests and there is no reason why the City Council cannot proceed and introduce Ordinance No. 62 -86. Mayor Tyrell asked if anyone in the audience wished to speak for or against this annexation. No one came forward. Councilman Nunamaker moved to close the Public Hearing, Councilman Dickason seconded, and carried. Councilman Merritt moved that the City Council find that less than 50% protests have been filed, Councilman Nunamaker second- ed, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Shatford read title to Ordinance No. 62 -86 AN OR- DINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRI- TORY, DESIGNATED "ANNEXATION NO. 4-A, WEST TEMPLE CITY" TO THE CITY OF TEMPLE CITY. RESOLUTION NO. 62 -220: appointing personnel City Manager Woollett read title to Resolution No. 62 -220 A - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AP- POINTING DONOVAN- R. JOHNSON AS PARK MAINTENANCE MAN, MARLA SILVEY AS CLERK- TYPIST, LEONARD BURWELL AS RECREATION LEADER,, AND STEVEN VANNATTA AS RECREATION HELPER. Councilman Fitzjohn moved to adopt Resolution No. 62 -220, Councilman Nunamaker seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 12. PROPOSED CONTRACT FOR LEGAL SERVICES - PROPOSED PARKING DISTRICT, City Attorney Shatford presented the proposed contracts to- gether with a Resolution appointing O'Melveny & Myers as Speci- al Counsel in respect to establishment of a parking district or districts. He explained the various ramifications of the pro- posal. Councilman Dickason moved to hold this over until the next Council meeting for further study, and also the proposed 13. contract and resolution appointing William H. Krelle as Engi- neer for services re the proposed parking district be held over until next Council meeting for the same reason, Councilman Nun - amaker seconded, and carried. 313 Council Minutes, July 23, 1962, page 4 14. APPOINTMENT OF TRAFFIC COMMISSIONER: City Manager Woollett advised the term of Commissioner Georgia Maxey runs out in August and proposed the Council re- appoint her for a four year term. Councilman Fitzjohn so moved, Coun- cilman Dickason seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 15. PLANNING COMMISSION RECOMMENDATIONS: (1) Zone Variance Case #62 -37, request for permission to con - struct apartment house south side of Olive St. just east of Baldwin Ave. at 10034, 10040, 10048 Olive St., Spotts, Mcllroy & Tolbert. Planning Commission recommend denial. Ray Cushman, Planning Advisor presented the variance case and advised at the Planning Commission Hearing five people spoke in favor and 20 property owners spoke in opposition. City Manager Woollett advised a written appeal had been presented by the Applicants. Following discussion Councilman Merritt moved to set a Public Hearing for 8 :00 P. M. on August 13, 1962, in the Council Cham- bers, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None (2) ORDINANCE NO. 62 -85: Re- access strips. 1st reading. City Attorney Shatford read title to Ordinance No. 62 -85 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE MUNICIPAL CODE TO EXCLUDE ACCESS STRIPS FROM REQUIRED MINIMUM AREA OF TANDEM OR FLAG LOTS IN ZONES R- 1,R -A, AND A -1. Councilman-- Nunamaker moved to waive further reading of Ordinance No. 62 -85, Council- man Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None As this was the first reading of Ordinance No. 62 -85 no further action was taken. 16. TRAFFIC COMMISSION RECOMMENDATIONS: 11. Fairhall St. Recommend placement of tut -hill panels east end of Fairhall St. Traffic Engineer Envall explained traffic was crossing the curb in the cul de sac on Fairhall St. to gain access to commercial properties on El Monte Ave., and that ad- joining property owners on Fairhall St. objected to this, and the thought was by installing a tut -hill panel it would block traffic from crossing this curb and private property. Council- man Dickason moved to approve, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 13. Placement of stop sign on private street west side of Golden West south of Val St., and also that a speed check be made on Golden West after school opens. Mr. Envall advised this was a safety measure as coming from a private street on to a heavily traveled street it would halt entry, and also that_the sign itself would be placed on right of way. Councilman Merritt moved to approve both these recommendations, Councilman Nuna- maker seconded, roll call vote as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett stated the Traffic Commission requested permission to appear before the School Board to discuss the Bicycle and Pedestrian Program. CURB & GUTTER IMPROVEMENT: SERENO DR, BETWEEN ROSEMEAD & ENCIN- 1TA. City Manager Woollett recommended the City Council set a public hearing for August 13, 1962, at 8:30 P. M. to complete the re- mainder of the curb on Sereno Dr. between Rosemead & Encinitas Councilman Nunamaker so moved, Councilman Dickason seconded, and carried. 18. RESOLUTION NO. 62 -219: WARRANTS & DEMANDS Following discussion Councilman Fitzjohn moved to adopt Resolu- tion No. 62 -219 in the sum of $7326.36 Demand Nos. 1678 through No. 1718, Councilman Merritt seconded, roll call vote as follows AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 19. COMMUNICATIONS: City Manager Woollett presented a letter from the County Boun- dary Commission regarding Annexation 1962 -3, City of San Gabriel Councilman Merritt moved to receive and file, Councilman Nuna- maker seconded, and carried. City Manager Woollett read a letter from SERVE, Family Service Club, requesting Sept. 1 -7 be proclaimed National Fiesta Week. Councilman Dickason moved to so proclaim, Councilman Fitzjohn seconded, and carried. 20. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr. Gurevitz, 616 W. Sierra Madre Blvd., stated he and a partner proposed to open a restaurant and wished to have music and dances ing after 2 A. M. until 7 A. M., the proposed location is at Rosemead and Las Tunas and will be strictly an eating establish- ment with no alcoholic beverages served. The Cty Manager will make a report back to the Council at their next meeting regard- ing this request. Mrs. Phyllis Hall, 4847 Kauffman, asked if when the reports are given following the investigation regarding the water problem on Kauffman, if they will be brought before the Council and before the public. The City Manager advised that he expected to receive reports back on Friday of this week and then he and the City Attorney will try and make a determination of what the solution of the problem is, and that all of this information will be presented at the next Council meeting on August 13. Mr. Harker, Chairman of the Planning Commission, reported on the joint meeting with the Planning Commission of Arcadia, and advised it was an informal discussion and he felt it very worth- while and informative to both Commissions. Also that it was agreed that they continue these joint meetings quarterly which may enable them to solve similar problems. Mrs. Norma Crouch of Fairhall street requested help as she is having a problem regarding a yard light shining into a neighbors window. The City Attorney reported on similar situations and . suggested she do something to shield the light so it did not annoy the neighbor. 21. MATTERS FROM CITY OFFICIALS: Councilman Nunamaker brought up the question again regarding better lighting for apartments and garages and it was agreed that any legislation would be difficult.. The City Attorney advised that this could come in on building requirements and be considered in the Building Code. City Treasurer Walter Griesmeyer reported on City funds and requested the City Council set a policy of 40% of funds to active account and 60% to inactive account at both First West- ern Bank and Security First National Bank. Following discussion Councilman Nunamaker moved to instruct the City Treasurer in 315 1 1 Council Minutes, July 23, 1962, page 6 investing city funds to maintain a balance of 40% active ac- count and 60% inactive account in both banks, Councilman Mer- ritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Vtzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None Councilman Nunamaker brought •Forth "sweet treats" for those present and the Council in response to various reminders that he was in the Candy business. Everyone enjoyed the "surprise!'. 22. ADJOURNMENT: Councilman Nunamaker moved to adjourn, Councilman Merritt se- conded, and carried. Council adjourned at 10 :05 P.
