ORDINANCE NO. to I
AN ORDINANCE DESIGNATING EDGEMOOR AS A MAIN
TRAFFICWAY WITHIN THE CITY OF BEL AIRE,
KANSAS; AUTHORIZING THE IMPROVEMENT OR
REIMPROVEMENT OF SAID MAIN TRAFFICWAY; AND
PROVIDING FOR THE PAYMENT OF THE COSTS
THEREOF.
WHEREAS, K.S.A. 12-685 provides that the governing body of
any city is authorized and empowered to designate and
establish, by ordinance as a main trafficway any existing or
proposed street, boulevard, avenue or part thereof, within
such city, the primary function of which is, or shall be, the
movement of through traffic between areas of concentrated
activity within the city or between such areas within the city
and traffic facilities outside the city performing the
function of a major trafficway; and such designation by the
governing body shall be final and conclusive; and
WHEREAS, K.S.A. 12-687 provides that the governing body of
any city shall have the power to improve or reimprove or cause
to be improved or reimproved, any main trafficway or
trafficway connection designated and established under the
provisions of K.S.A. 12-685 et seg., and such improvement or
reimprovement may include grading, regrading, curbing,
recurbing, guttering, reguttering, paving, repaving,
macadamizing, remacadamizing, constructing, reconstructing,
opening, widening, extending, rounding corners, straightening,
relocating, building any necessary bridges and approaches
thereto, viaducts, overpasses, underpasses, culverts and
drainage, trafficway illumination, traffic control devices,
pedestrian ways, or other improvements or any two or more of
such improvements or reimprovements and the acquisition of
right-of-way by purchase or condemnation when necessary for
any of such purposes; and
WHEREAS, K.S.A. 12-689 provides that all costs of
improvements or reimprovements authorized under the provisions
of K.S.A. 12-687, including acquisition of right-of-way,
engineering costs, and all other costs properly attributable
to such projects, shall be paid by the city at large and may
be funlled. among others, by the issuance of general
improvements bonds; and

WHEREAS, the governing body of the City of Bel Aire,
Kansas, hereby finds and determines that a certain street
within the City of Bel Aire, Kansas, should be designated and
established as a main trafficway as provided by and under the
authority of K.S.A. 12-685; and
WHEREAS, said governing body hereby further finds and
determines that it is necessary to improve or reimprove said
main trafficway, as provided by and under the authority of
K.S.A. 12-687, and to provide for the payment of the costs
thereof as provided by and under the authority of K.S.A.
12-689.
THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY
OF BEL AIRE, KANSAS:
SECTION 1. It is hereby authorized, ordered and
directed that Edgemoor in the City of Bel Aire, Kansas, shall
be and hereby is designated and established as a main
trafficway within the City, the primary function of which is
the movement of through traffic within the City, under the
authority of K.S.A. 12-685.
SECTION 2. It is hereby deemed and declared to be
necessary to improve or reimprove said main trafficway within
the City, and it is hereby authorized, ordered and directed
that said main trafficway be improved or reimproved under the
authority of K.S.A. 12-687, in the following particulars:
Remove and replace the asphalt paving,
including base of Edgemoor Street.
SECTION 3. The total estimated costs of the above
described main trafficway improvements or reimprovements,
including construction, engineering fees, acquisition of
right-of-way and easements; contingencies, administrative
expenses and expenses of financing the improvements or
reimprovements, is the sum of $66,000.00, and said costs shall
be chargeable to the city at large and will be paid by the
issuance of general obligation bonds of the City of Bel Aire,
Kansas under the authority of K.S.A. 12-689.
SECTION 4. The above described main trafficway
improvements or reimprovements shall be made in accordance with
the Plans and Specifications therefor prepared by Reiss &
Goodness, Engineers of Wichita, Kansas, which Plans and
Specifications are hereby approved by the governing body of the
City of Bel Aire, Kansas. Said Plans and Specifications are on
file in the Office of the City Clerk.

SECTION 5. This Ordinance shall take effect and be of
force from and after its passage and approval and publication
one time in the official city newspaper.

ADOPTED AND APPROVED by the Governing Body of the City of
Bel Aire, Kansas, on September 22, 1983.
