HomeMy Public PortalAbout03/26/92 CCMThe Medina City Council met for a special session on March 26, 1992 at 6:00 p.m. Present: Mayor, Gary Acromite, Councilmembers Ann Thies, Philip Zietlow, Acting Clerk -Treasurer, Laura Monroe, Public Works Director, Jim Dillman, Engineer, Glenn Cook, Planning & Zoning Administrator, Loren Kohnen, Police Chief, Rick Rabenort Absent: Councilmembers Robert Mitchell and Wilfred Scherer Tax Increment Financing Project for Sewer Extension Gary Acromite asked about the assessments for residential property, and what was required for assessments. Ron Batty said that at an earlier council meeting it was scheduled to have both the assessment hearing and improvement hearing on April 21, 1992, and that those property owners effected would be notified with letters that told them of the improvement, and what their assessment would be. The maximum amount of the assessment would be indicated, and that amount can be less when actually assessed, but never more without another hearing. Glenn Cook said that it would make sense to stagger the meetings, to notify everybody along the route so that everyone would be informed about what's going on. Ron Batty said that petition and waiver agreements were needed along the route from those who easements are needed from. Gary Acromite thought that both the public hearing on the project and the assessment should be held the same night, so that those who are interested in the amount of the assessment would also come for the project. He asked about those who might charge for the easements, if they could be charged for the lateral benefits of the sewer line, or if it could be explained that if they did not charge for the easement, that the assessment for the sewer line could be deferred to another time. Ron Batty said Glenn would have to calculate dollar amounts. He could talk to those from whom we would require easements and tell them that they would be excluded from paying the assessment, that it could be deferred, if they gave the city the easements now. Terry Forbord, of Lundgren Brothers said that in other communities they have an informational hearing to explain about the improvement, otherwise if people just receive an assessment notice all they realize is that they are being assessed and they have questions about the project. Gary Acromite was concerned about doing an informational hearing, because he wanted to accelerate the project because of the 52 building season, and it would put it off another 30 days. Ron Batty said that the council may want to hold off ordering the project unless there are enough assessment dollars. Petition and waiver agreements should be sent out to those who have agreed that they want the project. Gary Acromite said that Jeannie Vanda should be consulted regarding the Tax Increment dollars available for the project. He also asked if perhaps people along the route who don't want the project could be passed by and property owners who do want the project could be put in. He said that the Met Council should be asked about that. He asked if the cost estimates included acquiring the easements. Glenn Cook said that the costs were not included for acquiring the easements. He said he would like to see the public hearing scheduled for April 21, 1992. Gary Acromite said then the assessment hearing could then be scheduled for May 5, or perhaps May 19. Phil Zietlow asked if the $98,000 costs were talked about before. Glenn Cook said that they had only talked about the trunkline costs, not the lateral costs, which the $98,000 is for. Terry Forbord said that they were being more than fair, that costs usually cannot be communicated until at least a feasibility report is done. vCt iC c. 1 Ann Thies said that the amountshould be included in the petition and waiver agreements for those who have been involved in this project who will be assessed. Phil Zietlow agreed that they should be talked to about the additional costs. Glenn Cook said that he would need to finalize the feasibility report and include the cost per unit for the residential property. Ann Thies asked if people on the north side of Highway 55 should also be notified as to what is happening. Moved by Acromite, seconded by Thies to schedule the improvement hearing to April 21, 1992, to direct staff to prepare letter to all effected property owners describing the information in parts 1-4 of the feasibility report and the public hearing; to direct staff to prepare the assessment estimates and the petition and waiver agreements for all property owners and the Doerr residential property; to direct staff to talk with Jeannie Vanda of Ehler's to recap the figures from the Tax Increment funds that can be used for this project.
