ORDINANCE VACATING TWELVE FOOT ALLEY
BETWEEN APPLE STREET AND HOWARD STREET
IN BLOCK 2 OF THE ASH ENLARGEMENT
TO THE CITY OF GREENCASTLE, INDIANA
BY ROBERT LEE PERRY AND LINDA PERRY
WHEREAS, Robert Lee Perry and Linda Perry have petitioned to vacate a certain
public alley described as follows:
Beginning at the Southwest comer of Lot 7 in Block 2, Ash
Enlargement to the City of Greencastle as recorded in Plat Book 1,
page 33; thence North with the West line of said Lot 7 to the
Northwest comer thereof; thence West 12 feet to the Northeast comer
of Lot 6, same Block and Subdivision; thence South with the East line
of said Lot 6 to the Southeast comer thereof; thence East 12 feet to
the point of beginning. Also, beginning at the Southwest corner of Lot
2 in Block 2, Ash Enlargement to the City of Greencastle as recorded
• in Plat Book 1, page 33; thence North with the West line of said Lot 2
to the Northwest comer thereof; thence West 12 feet to the Northeast
comer of Lot 3, same Block and Subdivision; thence South with the
West line of said Lot 3 to the Southeast comer thereof; thence East 12
feet to the point of beginning.
WHEREAS, Petitioners have given notice to the Plan Commission of the City of
Greencastle and the Plan Commission of the City of Greencastle recommends that the.
Petition be granted; and
WHEREAS, a hearing was held before the Common Council for the City of
Greencastle, Indiana on May 16, 1995, and after said hearing the Common Council finds
that it would be. in the best interests of the City and of the parties involved that said
Petition should be granted and hereby approves said Petition.
,MOW, THEREFORE, BE IT RESOLVED that the above desc abed public alley be,
® and hereby is, vacated; that it shall henceforth cease to be a public alley or right -of-
" w a y ; a n d t h a t t i t l e t h e r e t o s h a l l r e v e r t p u r s u a n t t o l a w t o t h e a d j a c e n t l a n d o w n e r s , s u b j e c t
t o a n y e x i s t i n g u t i l i t y e a s e m e n t s .
