AN ORDINANCE CONCERNING
FLOOD HAZARD AREAS
Be it ordained by the City Council of the City of Greencastle, Indiana, as follows:
SECTION 1. STATUTORY AUTHORIZATION
The Indiana Legislature granted the power to local units of government (IC 36 -7 -4) to control
land use within their jurisdictions in order to accomplish the following.
SECTION 2. STATEMENT OF PURPOSE.
The purpose of this ordinance is to guide development in the flood hazard areas in order to
reduce the potential for loss of life and property, reduce the potential for health and safety
hazards, and to reduce the potential for extraordinary public expenditures for flood protection
and relief. Under the authority granted to local units of government to control land use
within their jurisdiction, which includes taking into account the effects flooding, the
Greencastle City Council hereby adopts the following floodplain management regulations in
order to accomplish the following:
a. to prevent unwise developments from increasing flood or drainage hazards to others;
b. To protect new buildings and major improvements to buildings from flood damage:
C. to protect human life and health from the hazards of flooding;
d. to lessen the burden on the taxpayer for flood control projects, repairs to flood -
damaged public facilities and utilities, and flood rescue and relief operations;
e. to maintain property values and a stable tax base by minimizing the potential for
creating flood blighted areas; and
f. to make federally subsidized flood insurance available for structures and their contents
in the City by fulfilling the requirements of the National Flood Insurance Program.
SECTION 3. DEFINITIONS. For the purpose of this ordinance, the following definitions are
adopted:
a. Building - see "structure."
b. Development - any man -made change to improved or unimproved real estate including
but not limited to:

s i m i l a r p r o j e c t s ;
4 . c o n s t r u c t i o n o f f l o o d c o n t r o l s t r u c t u r e s s u c h a s l e v e e s , d i k e s , d a m s , c h a n n e l
i m p r o v e m e n t s , e t c . ;
5 . m i n i n g , d r e d g i n g , f i l l i n g , g r a d i n g , e x c a v a t i o n , o r d r i l l i n g o p e r a t i o n s .
6 . c o n s t r u c t i o n a n d / o r r e c o n s t r u c t i o n o f b r i d g e s o r c u l v e r t s ;
7 . s t o r a g e o f m a t e r i a l s ; o r
S . a n y o t h e r a c t i v i t y t h a t m i g h t c h a n g e t h e d i r e c t i o n , h e i g h t , o r v e l o c i t y o f f l o o d
o r s u r f a c e w a t e r s .
