Dear Council Member:
This ordinance relates to Vacation 2-1996 petition for the east/west alley between North 3rd
Street and North 4th Street in the block bounded by North A Street on the south and North
C Street on the north.
The ordinance should be referred to Plan Commision for public hearing at its meeting on
June 25, 1996.
The ordinance should be back to Council for second reading on July 1, 1996.

ORDINANCE 44-1996
A SPECIAL ORDINANCE VACATING THE ALLEY BETWEEN NORTH
3RD STREET AND NORTH 4TH STREET IN THE RECTANGULAR
BLOCK BOUNDED BY NORTH A STREET AND NORTH C STREET.
Whereas TerKel Building Group, LLC has petitioned Common Council of
Richmond, Indiana, requesting the vacation of the alley between North
3rd Street on the west and North 4th Street on the east in the rectangular
block bounded on the south by North A Street and on the north by
North C Street, the same being Vacation Petition No. 2-1996, and
Whereas one of the two owners of all land abutting the above described public way
have joined in said petition requesting vacation, and
Whereas the abutting land owner who did not join in said petition has been notified
by the City Clerk as required by statute, and
Whereas said Council, pursuant to Indiana Code 36-7-3-12, conducted a public
hearing on said petition July 1, 1996, after publishing legal notice thereof
at least 10 days in advance of said hearing as required by statute, and
Whereas the Richmond Advisory Plan Commission, pursuant to Richmond Code
155.04(b), conducted a public hearing on said petition June 25, 1996, after
publishing legal notice thereof at least 10 days in advance of said hearings
as required by ordinance, and
Whereas it is desirable to vacate said public way,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana, that subject to the preservation of easements for existing utilities, the public way
described below is hereby vacated and the abutting property owners shall acquire
ownership of the land heretofore dedicated as a public way as indicated below, to wit:
The alley between North 3rd Street on the west and North 4th Street on the east
in the rectangular block bounded on the south by North A Street and on the north
by North C Street in the City of Richmond, Indiana, which alley is more
particularly described on Exhibit A attached hereto, with TerKel Building Group,
LLC,acquiring a strip equal to one-half of the width of said vacated alley abutting
the north side of Auditor's Map No. 46-32-430-223.00-29 and abutting the south
side of Auditor's Map No. 46-32-430-228.000-29, and Otis F. Garner and Mattie
E. Garner, as tenants -by -the -entireties, acquiring a strip equal to one-half the width
of said vacated alley abutting the south side of Auditor's Map No.
46-32-430-222.000-29.
Passed and adopted this 1st day of July, 1996, by the Common Council of the City of
Richmond, Indiana.

Richmond. Lots Numbered Fifteen (15), Sixteen (16),
Seventeen (17), Eighteen (18), Nineteen (19), Twenty (20),
Twenty-one (21), Twenty-two (22), Twenty-three (23), and
Twenty-four (24), and all of the vacated alley lying between
said lots, all in John M. Laws Addition to the City of
Richmond, Wayne County, Indiana, in accordance with the
recorded plat of said Addition.
