This ordinance relates to the rezoning request of 639 South Fifth Street from M-1 Light
Industrial District to C-4 General Business District. To determine if the request meets the
requirements you can review Richmond Code 154.33.00. The property is owned by
Robert and Martha Sigmon.
The ordinance should be referred to Plan Commision for public hearing at its meeting on
June 25, 1996.

ORDINANCE 45-1996
A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 639 South
Fifth Street, Richmond, Indiana.
WHEREAS the zoning map designates real estate at 639 South Fifth Street
as M-I Light Industrial District, and
WHEREAS it is desirable to change the zoning designation to C-4 General
Business District,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana, that the zoning designation of the real estate at 639 South Fifth Street, which is
more particularly described in Exhibit A attached hereto, is hereby changed to C-4
for the purpose of carry out sales of alcoholic beverages and retail sale of motor vehicles
and repair of motor vehicles.
Passed and adopted this � 5 day of 191-`1 1996, by the Common Council
of the City of Richmond, Indiana.

Real Estate Description for Zoning
A part of lot number four (4) in that part of the City of Richmond, laid out by Christian
Schwegman, beginning at a point north five (5) degrees east seven and eighty (80) hundredths
(7.80) rods, one hundred thirty and two hundredths (130.02) feet north of the southwest corner of
said lot number four (4); running thence south seventy seven (77) degrees east fourteen and fifty
two hundredths (14.52) rods, or two hundred thirty nine and fifty eight hundredths (239.58) feet;
thence north nineteen (19) degrees east thirty five (35) feet; thence in a northwesterly direction to
the west line of said lot number four (4) at a point forty (40) feet (at right angles) of said lot
number four (4) to a point thirteen and eighty six hundredths (13.86) feet to the place of
beginning. EXCEPTING fifteen (15) feet in width off the entire east end of said real estate
hereby conveyed to be used as a private alley, excepting from said above described real estate all
of that part of lot number four (4) heretofore conveyed by Michael A. Mayerhoefer and wife, to
the Cincinnati, Richmond and Muncie Railroad by deed dated December 5th, 1900 and recorded
December 5th 1900 in Deed Record 114, page 378 of the records in the office of the Recorder of
Wayne County, Indiana.
ALSO, a part of lot number eleven (11) in E. G. Vaughan's Addition to the City of Richmond,
Indiana, and a part of out lot number four (4) in C. Schwegman's Addition to the City of
Richmond, Indiana and described as follows:
Beginning at the intersection of the east line of South Fifth Street, and the southeast line of
Garden Avenue; thence north along the east line of South Fifth Street ninety (90) feet, more or
less to the south line of the right of way of the Chesapeake and Ohio Railroad of Indiana,
formerly the Richmond, Cincinnati and Muncie Railroad; thence southeasterly along the south
line of the right of way of said railroad to the north line of the first above described tract; thence
westerly along the north line of the part of said lot number four (4) described above, ninety (90)
feet to the easterly line of Garden Avenue; thence southwesterly along the southerly line of
Garden Avenue to the place of beginning.
TRACT II:
A part of Lot Number Four (4) of certain outlots laid out by Christian Schwegman in the City of
Richmond, Indiana, bounded as follows: Beginning at a point in the east line of South 5th Street
one hundred thirty (130) feet North of the north line of South "G" Street and running thence
South seventy-six and one-half (76-1/2) degrees East one hundred forty-three (143) feet to the
westerly right-of-way line of the Chesapeake and Ohio Railroad; thence Southeastwardly with
said right-of-way line eighty-four (84) feet; thence North seventy-six and one-half (76-1/2)
degrees West two hundred two (202) feet to the east line of South 5th Street; thence North
fifty-five (55) feet to the place of beginning.
Part of Lot Number Four (4) of certain outlots laid out by Christian Schwegman in the City of
Richmond, bounded and described as follows:
Beginning at the Southwest corner of said Lot Number Four (4); running thence North on the
East side of South Fifth Street seventy-five (75) feet; thence South seventy-six and one-half
(76-1/2) degrees East to the West line of the right-of-way of the Chesapeake and Ohio Railroad;
thence Southeastwardly along said line to the South line of said Lot Number Four (4) on the
North side of South G Street; thence West along said line to the place of beginning.
SUBJECT to the Permanent Easement and right-of-way for a sanitary and/or storm sewer
granted to the Richmond Sanitary District of the City of Richmond, Wayne County, Indiana, by
instrument recorded November 19, 1981 in Deed Record 417, page 50 of the records in the office
of the Recorder of Wayne County, Indiana.
SUBJECT to the Temporary Easement and right-of-way for a sanitary and/or storm sewer
granted to the Richmond Sanitary District of the City of Richmond, Wayne County, Indiana, by
instrument recorded November 19, 1981 in Deed Record 417, page 46 of the records in the office
of the Recorder of Wayne County, Indiana.
