Parrott absent INVOCATION: Mayor Leja PLEDGE OF ALLEGIANCE: Mayor Leja ADJUSTMENTS TO THE AGENDA None. AWARDS & PRESENTATIONS: None. ORAL COMMUNICATIONS: None. CONSENT CALENDAR: 1. Approval of minutes for City Council meeting held March 28, 1994. (CLK) 2. Approval of Warrants and payroll. (FIN) Approved as presented. STAFF RECOMMENDATIONS: 3. Request for fee -exempt permit for operation of Cherry Festival in Stewart Park from May 25 to May 30, 1994. (PWKS) Approved fee -exempt permit w/closure of streets during festival and erection of barricades on 5/28/94 for parade, with the following conditions: a. Temporary fence around beer garden will be 41 mesh and security will be provided by Association. b. Police services will be paid for by Association except for parade -related duties. c. Electrical power usage amount estimated, but Association will bear all of the cost for power used for festival purposes. Agenda - City Council Meeting 4/11/94 STAFF RECOMMENDATIONS: 4. Proposed FY93-94 budget amendment. (FIN) Approved as presented. 5. Request of Banning -Beaumont -Cherry Valley Board of Realtors to place large American flag in the median of Palm Avenue between 5th and 6th Streets. (PING) Approved in concept with location in Civic Center Parking Lot, landscaping to be completed by City contractor and maintenance to be provided by the City in perpetuity. 6. Amendment to Urban Logic Consultants contract to include provision of construction management services. (PWKS) Approved Contract (No. 94-15) amendment as presented. 7. Selection of a transportation consultant for preparation of Beaumont Transportation Model and Circulation Element Update. (PLNG) Approved Contract No. 94-16 with Robert Kahn, John Kain & Associates 8. Second reading and adoption of Ordinance No. 743, entitled An ordinance of the City Council of the City of Beaumont, California, Adopting the development agreement between the City of Beaumont and Omega Homes (pursuant to Government Code Sections 65864-65849.5.10 for Improvement Area No. 11 for CFD93-1. (Hearing was held and ordinance introduced on 2-28-94). (PING) Adopted Ordinance No. 743 and Development Agreement No. 94-17 with Omega Homes. 2 Agenda - City Council Meeting 4/11/94 STAFF RECOMMENDATIONS: (cont) CITY COUNCIL ITEMS/COMMENTS: 9. Request of Mayor Leja regarding formation of two City Council committees related to City boundary issues and related litigation. Mayor Leja organized and made appointments to the following ad hoc committees: a. Formed ad hoc committee to negotiate with City of Calimesa to attempt to reconcile differences regarding boundary issues. Appointed Mayor Pro Tem Parrott and Council Member Berg to serve on the committee. b. Formed ad hoc committee to discuss with Cherry Valley representatives issues related to the Cherry Valley "community of Interest" designation. Appointed Council Members Berg and Brey to serve on the committee. Mayor Leja indicated that she had attended a meeting held by the West Riverside Council of Governments, said that she is the City,s delegate and appointed Council Member Russo as alternate. 3 Agenda - City Council Meeting 4/11/94 CLOSED SESSION: Recessed to closed session at 7:09 p.m. Reconvened at 7:32 p.m. with Council Member Russo absent after attending closed session. 10. Confer with legal counsel regarding the following: A. Consideration of a claim pursuant to Government Code Section 54956.9: Claimant: Lori Jean Howard Agency claimed against: City of Beaumont, CA Rejected claim by unanimous vote B. Anticipated litigation: i. Significant exposure to litigation pursuant to Subdivision (b) of Section 54956.9. One potential case. No action taken. ii. Initiation of litigation pursuant to Subdivision (c) of Section 54956.9. One potential case. No action taken. ADJOURNMENT Adjourned at 7:33 p.m. 4
