Home My Public Portal About1995-01 Vacating AlleyORDINANCE 1995 -1 ORDINANCE VACATING A TWELVE FOOT ALLEY BETWEEN VINE STREET AND COLLEGE STREET SOUTH OF LOTS 149 AND 156 AND NORTH OF LOTS 155 AND 150 ALL IN 'THE ORIGINAL PLAT OF THE CITY OF GREENCASTLE, INDIANA WHEREAS, Putnam County Public Library has petitioned to vacate a portion of a certain public alley described as follows: Situate in the State of Indiana, County of Putnam and being the platted alley bounded on the North by Lots 149 and 156 and bounded on the South by Lots 150 and 155 in the Original Plat of the City of Greencastle as shown on the plat recorded ill Plat Book- 1, page 6 in the office_ of the Recorder of Putnam County, Indiana, more particularly described to -wit: Beginning at the Southeast corner of Lot 156 in the Original Plat, of' o tine City of Greencastle; thence South 00 degrees 16 minutes 00 seconds West 12.00 feet to the Northeast corner of Lot 155; thence South 89 degrees 58 minutes 55 seconds West 216.26 feet with the North line of said Lot 155 and the North line of Lot 150 to the Northwest corner of said Lot 150; thence North 00 degrees 24 minutes 05 seconds East 12.00 lbet to the Southwest corner of Lot 149; thence North 89 degrees 58 minutes 55 seconds East with the South line of said Lots 149 and 156 to the point of beginning; and . WHEREAS, Notices have been properly sent to all iulcrested parties and the hearing was held hereon before the Plan Conuuissiou of the City of Greencasde on or about December 27, 1994, and the Plan Commission recommends that the Petition be granted; and WHEREAS, the COrllmon Council for the City of Greencastle, Indiana believes that it would be in tlhe best interests of the City and of tine purthes involved that said Petition should be granted. NOW, THEREFORE, BE IT RESOLVED that the above described public ® alley be, and hereby is, vacated; that it shall henceforth cease to be a public alley or right -of -wad; and lhaL tite thereto shall !evert pursuant to law to the adjacent P ® landowners, to -wit: Putnam County Public Library, Perry Wainman, and Dorothea Harbison and Katherine Harbison, subject to any existing utility easements. (� Z Mayor ATTEST: ) Q�r c- Treasurer 6 TATE OF INDIANA IN THE COMMON COUNCIL FOR SS: THE CITY OF GREENCASTLE, INDIANA COUNTY OF PUTNAM 1994 IN RE THE VACATION OF A PORTION OF A TWELVE (12) FOOT ALLEY BETWEEN VINE STREET AND COLLEGE STREET SOUTH OF LOTS 149 AND 156 AND NORTH OF LOTS 155 AND 150 ALL IN THE ORIGINAL PLAT OF THE CITY OF GREENCASTLE, INDIANA, BY PUTNAM COUNTY LIBRARY, PETITIONER Putnam County Public Library ( "Petitioner "), by Fred Silander, President of its Board, petitions the Common Council For The City of Greencastle as follows, to -wit: 1. That Petitioner is the owner of certain real estate in Greencastle, to -wit: ® Parts of Lot Number 149 in the Original Plat of the City of Greencastle as the same appear of record on the plat on file in the office of the Recorder of Putnam County, Indiana, at Plat Book 1, page 6, described as follows, to -wit: Beginning at the North West corner of said lot, and running thence East with the North line of said lot 76 feet and 2 inches to an iron pin; thence South to the South line of said lot thence West to the South West corner of said lot; thence North with the West line of said lot to the place of beginning; the same being a strip of ground 76 feet and 2 inches in width off the West side of said lot. ALSO, beginning at a point on the North line of said lot which is 31 feet and 11 inches West of the North East corner of said lot, and running thence South, parallel, to the East line of said lot, to the South line of said lot; thence East with the South line of said lot 20 feet; thence North, parallel to the East line of said lot, to the North line of said lot; and thence West with said North line 20 feet to the place of beginning; the same being a strip of ground 20 feet in width off the West side of that portion of said lot which Harry M. Smith, et ux, purchased from one George W. Kimble. ALSO: A part of Lots numbered 149 and 156 in the Original plat of the Town (now City) of Greencastle, Indiana, as the same appears of record in Plat Book I, ® page 6, in the office of the Recorder of Putnam County, Indiana, more particularly described as follows, to -wit: Beginning at a point on the North line of said Lot 156, which point is 50 feet West of the Northeast corner of said lot and running West on the North lines of Lots 156 and 149 a distance of 70 feet to a point on the North line of Lot 149, which is 11 feet and 11 inches West of the Northeast ® corner of said Lot 149; thence South parallel with the East line of said Lot 149 to the South line of said Lot; thence East on the South lines of Lots 149 and 156, 70 feet to a point due South of the place of beginning; thence North parallel with the East line of Lot 156 to the place of beginning. ALSO: Lot 155 and the East one -half of Lot 150 in the original Plat of Greencastle, Putnam County, Indiana. 2. That there is a twelve (12) foot alley running from Vine Street to College Street separating the above described tracts and bounded on the north and on the south by said above described tracts. 3. That Petitioner intends to construct its addition to the existing Putnam County Library upon and across a portion of said alley, and said alley to be vacated is not necessary for ingress and egress to Petitioner or any other person. 4. That the legal description of the tract of land to be vacated is as follows: ® Situate in the State of Indiana, County of Putnam and being bounded the platted alley on the North by Lots 149 and 156 and bounded on the South by Lots 150 and 155 in the Original Plat of the City of Greencastle as shown on the plat recorded in Plat Book 1, page 6 in the office of the Recorder of Putnam County, Indiana, more particularly described to -wit: Beginning at the Southeast corner of Lot 156 in the Original Plat of the City of Greencastle; thence South 00 degrees 16 minutes 00 seconds West 12.00 feet to the Northeast corner of Lot 155; thence South 89 degrees 58 minutes 55 seconds West 216.26 feet with the North line of said Lot 155 and the North line of Lot 150 to the Northwest corner of said Lot 150; thence North 00 degrees 24 minutes 05 seconds East 12.00 feet to the Southwest corner of Lot 149; thence North 89 degrees 58 minutes 55 seconds East with the South line of said Lots 149 and 156 to the point of beginning. 5. That the abutting landowners are Petitioner herein, Perry Wainman, Dorothea Harbison and Katherine Harbison, and that said other abutting landowners consent to this Petition. 6. That all of said public ways to be vacated lie wholly within the corporate O undaries of Greencastle City. WHEREFORE, your Petitioner requests the Common Council for the City of Greencastle, Indiana pass an ordinance vacating the described public alley way between Vine Street and College Street South of Lots South of Lots 149 and 156 and North of Lots 155 and 150 all in the original plat of the City of Greencastle, County of Putnam, State of Indiana, and for all other relief which is just and proper in the premises.
