• Tiffin City Council October 10, 2001
A regular meeting of the Tiffin City Council was brought to order Wednesday, October
10, 2001 at 6: 30 p.m. by Mayor Glenn R. Potter at the Tiffin Fire Station. Council
members present: Mike Gericke, Rodney Walls, Karin Dils and Jim Bartels. Absent:
Mike Ryan. Also present: Engineer Mike Hart, Attorney Stephen Greenleaf, PZ Dave
Shaffer, PZ Melvin Reeve, Darla Bartels, and Greg Schott arriving 7:00 p.m.
Motion Gericke, second Walls to approve printed agenda and mintues. Ayes: Walls,
Gericke, Dils and Bartels. Absent: Ryan. Motion carried.
Residents of Potter Street were present to explain unsafe water connections protruding
from sidewalks in that area. Attorney will send contractor Joe Johnston a letter regarding
repairs needed in the 513 — 523 Potter Street area.
Residents of Potter Street also explained that it had appeared that junk articles of the area
had been moved by Joe Johnston to an area near the southwest corner of his property, but
that most of the junk articles appeared to still be in the area. Objects including a large
unused truck, tires, and other items. It did appear that the old shed had been removed
from the area. Attorney will send owner Joe Johnston a letter regarding untended items
in this area.
• Sidewalks with sever tilting on two lots in the area were also discussed, the building
inspector will be asked about these sidewalks along Maddie Lane.
Dorothy Allen and Attorney Jay Sigafoose were present to answer any questions
regarding Mrs. Allen's voluntary request for annexation. Dorothy would like to sell her
home and Attonrey Sigafoose asked if the city thought there would be any problem with
subdivision request that Mrs. Allen would make. Neither city attorney or city engineer
could see any problem.
Motion Gericke, second Walls to approve a RESOLUTION #2001-22. A RESOLUTION
APPROVING A ANNEXATION REQUEST FROM DOROTHY ALLEN.
Ayes: Gericke, Dils, Bartels, and Walls. Absent: Ryan. Nays: None. Motion carried.
Motion Gericke, second Bartels to approve a RESOLUTION #2001-23, A
RESOLUTION APPROVING IOWA DEPARTMENT TRANSPORTATION ROAD
USE REPORT Ayes: Walls, Bartels, Gericke and Dils. Absent: Ryan. Nays: None.
Motion carried.
Motion Walls, second Dils to approve recommendation of a conditional use permit
request made by Cleo Beckler to Johnson County. CU. Ayes: Dils, Gericke, Bartels,
and Walls. Absent: Ryan. Motion carried.
• Rolling Hills Estates is making request for final plat approval for Phase One of the
Rolling Estate platting. The final plat is approved contingent upon earlier preliminary

platting requirements made by city engineer Mike Hart including 1) 10' trail easement
through out entire plat 2) sidewalk easement between Lot 18 and Lot 19 including
drainage easement 3) access easement point and crossing in Lots 15 and 16 (thus
negating the necessity of placement of a bridge) 4) adherence to Subdivision Ordinance
Section 4.08 G. 5) provision for trail easement on north side of detention area 6) Croell
Avenue as 80" ROW for provision to future arterial use 7) 31' rodeway with 5' sidewalk
on one side 6' sidewalk on opposing side 8) 29' rodeway with 4' sidewalk on one side
and 6' sidewalk on opposing side and in addition noted by city engineer 9) additional
drainage easement for future planning needs required along Roberts Ferry Road 10)
notation that park space and storm water requirements are met, shown and included in
phases of the entire platting that are at present preliminary and that park space
requirements will be met by developer in the entirety of the plat 11) that engineering
reports, tests and requirements including grade and seeding will be submitted as
necessary for review, inspection and approval of city engineer 12) that all legal
documents will be completed in entirety and subject to review, and approval of city
engineer. Motion Bartels, second Gericke to approve Resolution # 200124 subject to all
recommendations of council, city engineer and city attorney and authorizing the Mayor to
execute approval of same. Ayes: Gericke, Bartels, Walls and Dils. Nays: None.
Absent: Ryan. Motion carried.
Attorney Greenleaf is fmishing US Cellular agreement including a provision for
noninterference with South Slope frequency waves. Attorney Greenleaf has reviewed •
city easement and it can be used by US Cellular.
Mayor Potter commended Council member Rodney Walls on how good the ball diamond
work looks. Walls is now working on fence bids.
Engineer Hart reported that the Water SRF would probably be at 3% interest rate.
Works continues on the IDOT sewer line.
Council member Walls reported that the recent Friends of the Springmier Library Chili
Supper earned $500.00 with $12.00 of expense. This Friday is a Supper benefit
sponsored by the community for past Fire Chief Tom Bigelow.
No bids yet received for drainage work along west Marengo Road. Engineer Hart works
on this.
Kevin Hackathorn of Johnston County has contacted Rodney Walls to work out
agreement and cooperation details for covering winter work along mutually held roads.
Bartels will work on getting help with the road grader. Crowning of roads and clearing
of roadside debris and gravel needs to be done before snow.

Dog letters sent by Attorney Greenleaf to Spivey tenant, Ryan, Miller and Johston in
regard to barking dogs and loose dogs. Problems with parked cars and vans will be
checked also.
Parking in IDOT right-of-way along Hwy #6 was considered, Building Inspecter Greg
Schott will get parking plan for the area.
Building Inspector Schott set up meeting for Wade, Wenman, Rose and Nevaraz to solve
drainage problem on Maddie Lane. Only Nevarez came to the time set. City Engineer
and attorney will help the inspector get this problem corrected if possible. Problem with
tilting sidewalk along Maddie Lane was discussed by council with building inspector, he
will get problem corrected.
Clerk explained notice of an error made by the Johnson County Auditor in tax
distribution, the mistake will mean that the City will need to send the Clear Creek
Amana School a refund of taxes in the amount of $ 7,296.79.
Emergency Management Bylaws for Johnson County have recently been updated and
made complete.
$5,000 yearly fee will be paid to the Springmier Community Library for one year of
• public library service.
$4,629.49 will be paid to the Tiffin Fire Association %Gene Charbon for second 1/2 of
00-01 Fire Protection Agreement and requesting finance report for period ending
12/31/00.
$7,296.79 will be sent to the Clear Creek Amana School District for refund of money
sent in error to the City of Tiffin by the Johnson County Treasuer's Office over the 00-01
year.
Motion Gericke, second Walls to approve clerk and treasurer's report. Aye: Walls,
Gericke, Bartels, and Dils. Absent: Ryan. Motion carried.
Motion Walls, second Bartels to pay bills and accept receipts. Ayes: Bartels, Walls,
Gericke and Dils. Absent: Ryan. Motion carried.
