A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 501, 509,
and 529-533 South Fifth Street; and 515, 517, and 519 South `E' Street
WHEREAS the zoning map designates real estate located at 501, 509, and 529-
533 South Fifth Street ; and 515, 517, and 519 South `E' Street as
M-1 Light Industrial District, and
WHEREAS it is desirable to change the zoning designation to C-4 General
Business District,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana, that the zoning designation of the real estate located at 501, 509, and 529-533
South Fifth Street; and 515, 517, and 519 South `E' Street which is more particularly
described in Exhibit A attached hereto, is hereby changed to C-4 General Business District
for the proposed use of retail and co ercial purposes.
Passed and adopted this �5 1— day 1996, by the Common Council
of the City of Richmond, Indiana.

Dear Mrs. Allen:
Please advise the members of Common Council that the Richmond Advisory
Plan Commission conducted a public hearing, Tuesday, August 27, 1996, on
the petition of the Richmond City Plan Commission, petitioner; Robert B.
Goodwin, agent; requesting a rezoning from M-1 Light Industrial District to C-
4 General Business District, at 501, 509, and 529-533 South 5th Street; and at
515, 517, and 519 South 'E' Street, Richmond, Indiana.
Seven properties are involved in this rezoning request and the owners of all
seven properties were contacted by the Plan Department staff. One owner,
Mr. J. F. Austerman, was opposed to the change; one had no opinion; and the
others were in favor of the proposed change. Additionally, notices were
delivered to twenty-six surrounding property owners, with no comments in
favor or opposed returned to this office.
Planning staff pointed out that the growth over the years for this area was of
the Commercial variety and that industrial growth, because of the location,
was not likely to happen. In addition the Comprehensive Plan designates
this area for future C-4 growth.
The Plan Commission voted 10 in favor, with 1 absent, to recommend the
passage of Ordinance No. 54-1996.

This ordinance relates to the rezoning request located at 501, 509 and 529-533 South Fifth
Street; and 515, 517, and 519 South `E' Street from M-1 Light Industrial District to C-4
General Business District.
The staff has expanded the original petition, which is the second in as many months, to
include the entire area east to Garden Avenue and north to South `E' Street.
To determine if the request meets the requirements you can review Richmond Code
154.33.00. The property is owned by Grimes Real Estate, Inc.; Joseph F. Austerman;
Frederick J. And Alice F. Austerman; Greg Brookbank; Scott Porter and Greg
Merchanthouse; Dallas E. And Marilyn A. Corder; and M. Keith and Priscilla D. Hawley,
contract with Stephen and Judy Starkey.
The ordinance should be referred to Plan Commision for public hearing at its meeting on
August 27, 1996.
The ordinance should be back to Council for second reading on September 3, 1996.
