The Tybee Island City Council met in special
called meeting, announced in advance, and so advertised, at
7:00 p.m. on Tuesday, September 16, 1986 for the purpose of
considering a Resolution and Deed to property in Memorial Park
adjacent to City Hall to be transferred to the CEL Library
Board for the purposes of constructing a public library. This
one item of business was postponed from the regular meeting
at the request of the City Attorney.
No one in the audience wished to speak on
the subject, although the local librarian, Martha Walsh, and
several members of the local library committee were3present.
A Resolution, and the deed, were read by the
Clerk, after which Councilmember Jackson moved adoption of
the Resolution, with a second from Councilmember O'Dell. The
vote was unanimously in favor by those who were present: Council -
members Jackson, O'Dell, McCutchen, Solomon and Walsh. Council -
member Davis was absent due to her work.
There being no other business which could
legally be conducted at this time, the meeting was adjourned.

A R E S O L U T I O N
WHEREAS, the City of Tybee Island, Georgia, is d sirous of
having a library established in said City for educational and recreational
purposes; and,
WHEREAS, the Georgia State Board of Education, the Library
System, and the Library Board of Trustees and Managers, have determined
that the need exists for the construction, maintenance and operation of
a public library in the City of Tybee Island, Georgia; and,
WHEREAS, the State of Georgia and the City of Tybee Island,
Georgia, will provide the initial construction costa for said facility;
and,
WHEREAS, the operating costs and maintenance costs will be
paid from County tax revenue of Chatham County; and,
WHEREAS, the City of Tybee Island, Georgia, has been assured
that said facility will be operated fully, completely and forever as a
public library facility, open to all, for educational reference and
recreational purposes; and,
WHEREAS, it is necessary for purposes of uniformity and for
other purposes for the City of Tybee Island, Georgia, to transfer the
legal title in and to the property on which said library facility is to
be built to the Chatham - Effingham- Liberty Regional Library Board of
Managers:
NOW, THEREFORE, LET IT BE RESOLVED, that the City of Tybee
Island, Georgia, in open meeting duly assembled, hereby authorizes the
transfer by fee simple deed the title in and to the property on which
the Regional Library is to be built within the confines of the City
Limits of the City of Tybee Island, Georgia, and being a portion of
Memorial Park located therein, unto the Chatham - Effingham *Liberty
Regional Library Board of Managers.

THIS INDENTURE, made this 16th.day of September
1986, between THE MAYOR AND COUNCIL OF THE CITY OF TYBEE ISLAND, GEORGIA,
a municipality of Chatham County, Georgia, as party of the first part, and
CHATHAM - EFFINGHAM- LIBERTY REGIONAL LIBRARY BOARD OF MANAGERS, of Chatham
County, Georgia, as party of the second part,
W I T N E S S E T H:
That said party of the first part, for and in consideration
of the sum of Exactly One ($1.00) Dollar to it in hand paid, tie receipt
and sufficiency of which is hereby acknowledged, HAS granted, bargained,
sold and conveyed, and by these presents DOES grant, bargain, sell and convey
unto the said party of the second part, its successors and assigns, all
the following described real property, to -wit:
ALL that certain tract or parcel of land
situate, lying and being In the City of Tybee
Island, Chatham County, Georgia, and being known,
and designated as the Library Site surveyed for
the City of Tybee Island upon a map or plat of
said property prepared by Barrett Land Surveying,'
Bert B. Barrett, Sr., Surveyor, R.L.S. 1239,
dated August 15, 1985, and being more particularly
described as follows: Commencing at the southwest
corner of the intersection of Fourth Street and
Butler Avenue; proceeding thence along the western
right -of -way line of Butler Avenue South 22° 00'
West for a distance of 155 feet to the point of
beginning; proceeding thence, continuing along
the western right -of -way line of Butler Avenue,
South 22° 00' West for a distance of 130 feet to
a point; proceeding thence North 68° 00' West for
a distance of 160 feet to a point; proceeding
thence North 22° 00' East for a distance of 130 j
feet to a point; proceeding thence South 68° 00'
East for a distance of 160 feet to a point, which
point is the point of beginning. Said tract or
parcel of land hereby conveyed is more fully
described and delineated upon a boundary map of
a theodolite survey of said lands, made and
prepared under the direction of and certified by
the said Bert B. Barrett, Jr., a copy of which
map is filed in Map Record Book , Folio ,
in the Office of the Clerk of the Superior Court
of Chatham County, Georgia, to which reference ishereby expressly
made for better determining the
metes, bounds and dimensions of the property herein
conveyed.

TO HAVE AND TO HOLD the said property and premises, together
with all and singular, the rights, members and appurtenances thereof to
the same belonging or in anywise appertaining, unto the said party of the
second part, its successors and assigns, forever, IN FEE SIMPLE.
IN WITNESS WHEREOF, the said party of the first part has
hereunto caused these presents to be duly executed by its proper officials
and the affixing of its Seal on the day and year first above written as
the date hereof.
