HomeMy Public PortalAbout2022.02.24 Payette Pedal Party BoatCity of McCall PARKS AND RECREATION www.mccall.id.us 216 East Park Street McCall, Idaho 83638 Phone 208-634-3006 Main 208-634-7142 Fax 208-634-3038 COMMERCIAL CONCESSION COMMUNICATION OUTLINE: In Regard to the recent concession application for the Payette Pedal Party Boat Concession at Art Roberts Park Commercial concession proposals to operate within public parks and facilities are required to follow a multistep process as outlined in RESOLUTION NO. 11-25 and attachment A: Guidelines for Commercial Activity Concessions Sales within McCall City Parks. The process involves staff review, a review and recommendation to City Council by the Parks and Recreation Advisory Committee who are property owners/residents appointed by City Council to be a community voice in Parks and Recreation business matters. Concessions then go before City Council for comments and final .. approval or disapproval. The following concession was first brought before staff via email in June of 2021 with a request (or information regarding the application process. The applicant then submitted a proposal to staff and the Parks and Recreation Advisory Committee for review in October during the concession calendar window. The Parks & Recreation Advisory Committee had two touches on this proposal. All of the Committee's meetings are open meetings with published agendas and notice to the public. The Committee first reviewed with staff during the Committee's October meeting and provided feedback to the applicant. The applicant then presented to the Committee and discussed the proposal at length with the Advisory Committee during their November 24 meeting. The Advisory Committee moved and voted in support of the concession, pending the conditions outlined in the minutes from the November 24 Committee meeting. The applicant and Parks staff then presented to the McCall City Council on December 16, 2021, requesting feedback to staff and the applicant. Then, during the January 28, 2022, Council meeting a revised proposal was presented addressing previous questions and concerns. McCall City Council approved the attached proposal and draft agreement for concession under the condition that staff create a communications plan. CONCESSION DESCRIPTION Overview Summary: To operate a human pedal driven paddle boat on Payette Lake during the regular boating season. The pedal boat will provide passengers a unique charter experience on board a 16-passenger pedal boat. Participants will pedal power their way across the lake under the steering of a licensed captain to ensure safety of those on board the vessel as well as the safety of other lake users . Experience can be booked as a private event or passengers can book individual seats and the experience is estimated to last 90 minutes. Hours of operation will be negotiated with eh concessionaire by Parks and Recreation Director after consideration of public comments received. If this business were to operate from a private location the City would have little to no regulation over how they operated on the water. Location Options: • Art Roberts Park Docks : Either dock has been considered and the pros and cons discussed at length with the applicant, City Staff, and Sheriff Marine Deputies . We have now heard numerous concerns from May Marina Slip holders and owners and will consider these as we get closer to the boating season . • Legacy Park Public Docks: There are two public dock systems that can be utilized and very well may get utilized . The pros and cons have been discussed at length with the applicant, City Staff, Parks & Recreation Advisory Committee, and the Sheriff Marine Deputies. Given the significant power boat traffic in this area associated with the public ramp and the two marinas the Art Roberts dock systems are desired to support this non -motorized concession. • Private Docks: The applicant is still exploring opportunities to operate from a private dock location and may go that route if opportunities present themselves. There would be no city regulation from a private dock. Primary Concerns to Date with response: Followi ng the January 13 , 2022 , City Council Meeting we have documented all comments of support, concern, and opposition through emails and phone calls. The following summarizes the primary concerns to date . • Concern regarding the approval of all concession activity on or within public facilities: The City of McCall has an adopted resolution for commercial and concession activity within City Parks that includes a process which has been followed . The City is committed to assessing this process and making improvements as needed. In addition, the Parks & Recreation Department is in the development phase of updating our Master Plan document over the next 18 months and we will be engaging the public and referencing the soon to be complete Valley County Waterways Management Plan on this topic. All current concession agreements are set to expire in three years which fits well with current planning work and decisions regarding existing and future concessions and either party also hold the ability to terminate the concession with 90 days written notice. • Concern regarding location at Art Roberts Park: We recognize that the east side of the east dock is encumbered by a narrow navigable passage between the marina and the dock. We are also familiar with the types of public use characteristic of Art Roberts Park and are committed to maintaining this through the management of this concession . No matter the location in which the concession operates, we will continue to monitor, assess, and manage it appropriately as it relates to location, public safety and public comments as we do for all permitted concessions . • Noise and Concerns as a Public Nuisance: The concession agreement will cover this concern and staff will take no ise co m pla ints and address them with the applicant . If the business were to operate from a private location, w e wo uld not have the authority to manage o r m it iga te th is co ncern on the water. • Fee Schedule : The concession agreement gives us the flex i bility to review and adjust after the first year of operation once the proposed business model and impacts to public facilities are better understood. CONCESSION COMMUNICATIONS PLAN • Throughout the life of the concession , comments are accepted and can be submitted by the public at any time in writing, via email (kwolf@mccall.id .us) or U.S. Mail. Staff is also available to schedule appointments for discussion in person or over the phone. • The concession details, changes and updates will be listed in an obvious location on the Parks webpage (https://www.mccall.id.us/parksrecreation ). • Changes and updates to the concession will be posted on the City's homepage under "Latest City News" and Parks social media pages (https://www.facebook.com/mccallparksandrec I https://www.instagram .com/mccall parksrec/)
