HomeMy Public PortalAbout072-1996 The Collection of an application fee tax abatementsORDINANCE NO. 72-1996 AN APPROPRIATION ORDINANCE AUTHORIZING THE COLLECTION OF AN APPLICATION FEE IN CONJUNCTION WITH A TAX ABATEMENT/STATEMENT OF BENEFIT REQUEST, AND THE SOLICITATION OF DONATIONS IN CONJUNCTION WITH SUCH REQUESTS WHEREAS, Common Council has previously designated eight economic revitalization areas within the City of Richmond, and WHEREAS, I.C. 6-1.1-12.1 requires the Common Council as the designating entity to approve all Statements of Benefits required to be filed by property owners applying for deductions in assessed valuations for the installation of new manufacturing equipment or for the redevelopment or rehabilitation of real property, and WHEREAS, Indiana law allows Common Council to impose an administrative fee for a property owner who requests an approval of a Statement of Benefits, which fee may be sufficient to defray the actual processing and administrative costs for such approval; and WHEREAS, Indiana law further allows Common Council to request donations from property owners who benefit from any deductions in assessed valuations provided that such request and/or solicitation is made perfectly clear that it is a voluntary request and has no connection to any approval or disapproval of the relevant Statement of Benefits; and WHEREAS, Common Council has an interest in using any funds received in response to the above donation request, as available funds for local business loans and local infrastructure improvements. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, as follows: 1. Any Property owner apply for an approval of a Statement of Benefits with Common Council, shall pay to the City of Richmond, an administrative fee of $100.00 for each new Statement of Benefits form. Such fee shall be placed into the City's General Fund. 2. The City of Richmond, through its Department of Finance, is hereby authorized to request on a yearly basis, from any property owner who has received an approved Statement of Benefits from Common Council and a deduction in assess value for real or personal property as a result thereof, a donation equal to ten percent (10%) of the amount of tax abated for such property owner during the course of that year. Such request for a donation shall make it clear on its face that it is a voluntary request and is not connected to any approval or disapproval of the Statement of Benefits. 3. All monies received by the City of Richmond in response to the request for donations shall be used as follows: (a) Fifty percent (50%) shall be forwarded to the City Revolving Loan Fund Board for use and application within any fund associated with making City loans to local business. (b) Fifty percent (50%) shall be used to establish an infrastructure, non -reverting fund to be used for local curb and sidewalk improvement program, to be administered by the Department of Finance.
