A SPECIAL ORDINANCE AUTHORIZING A GRANT APPLICATION TO
THE INDIANA DEPARTMENT OF TRANSPORTATION
WHEREAS The United States Department of Transportation (USDOT) is authorized to
make grants to states through the Federal Transit Administration to support
capital and operating assistance projects for non -urbanized transportation
systems under Section 5311 of the Federal Transit Administration Act of
1964, as amended; and
WHEREAS the Indiana Department of Transportation (INDOT) through its Public
Transit
Section has been designated to make Section 5311 grants for public
transportation projects; and
WHEREAS contracts for financial assistance impose certain obligations including the
provision for local sharing of project costs, and
WHEREAS it is required by the USDOT in accordance with the provisions of Title VI of
the Civil Rights Act of 1964, that in connection with the filing of an
application for capital and operating assistance under the Federal Transit
Administration Act of 1964, as amended, the applicant will give an
assurance that it will comply with Title VI of the Civil Rights Act of 1964;
and
WHEREAS it is the goal of the City of Richmond that minority business enterprises be
utilized to the fullest extent possible in connection with this project and that
definitive procedures shall be established and administered to ensure that
minority businesses shall have the maximum feasible opportunity to
compete for contracts when procuring construction contract, supplies,
equipment contracts or consultant and other services.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana that:
A. Mayor Dennis Andrews is authorized to execute and file an application on
behalf of the City of Richmond, Indiana with the INDOT to aid in the financing of
the Operating Assistance Project pursuant to Section 5311 of the Federal Transit
Administration Act of 1964, as amended.
B. That Mayor Dennis Andrews is authorized to execute and file with such
application the assurance required by the U.S. Department of Transportation
effectuating the purposes of Title VI of the Civil Rights Act of 1964.
C. That Terri Quinter, Operations Manager of Rose View Transit, is authorized to
furnish such additional information as INDOT may require in connection with the
project.
D. That Mayor Dennis Andrews is authorized to set forth and execute affirmative
minority business policies in connection with the project's procurement needs.
E. That Mayor Dennis Andrews is authorized to execute grant contract agreements
on behalf of the City of Richmond, Indiana, with INDOT for aid in the financing of
the Operating Assistance Project.
