Board of Commissioners Monthly Workshop
Monday, February 27, 2006 – 7:30 p.m.
Town Barn
The Town of Hillsborough held a Closed Session on February 27, 2006 in the Hillsborough
Town Barn. Present for the Closed Session were Mayor Tom Stevens, and Commissioners
Frances Dancy, Brian Lowen, Eric Hallman, Michael Gering, and Evelyn Lloyd. Staff present
were Town Manager Eric Peterson, Assistant Town Manager/Public Works Director Demetric
Potts, Town Clerk Donna Armbrister, Planning Director Margaret Hauth, and Town Attorney
Bob Hornik.
Closed Session
a. Update on Weaver Street Litigation
10:00:34 PM Town Attorney Bob Hornik reported that he had met with George Horton and his
attorney, LeAnn Brown. He stated that he had received a letter from LeAnn Brown outlining
proposed terms of resolution of George Horton’s challenge to the Town of Hillsborough Board
of Adjustment’s decision on the Gateway Commons’ site plan. A copy of that letter is hereby
incorporated by reference and made a part of these official Minutes as an Attachment.
10:13:28 PM By consensus, the Board authorized Town Attorney Hornik to finalize the
agreement.
b.Update on Potential Litigation with Atlantic Skanska
10:15:59 PM Town Manager Eric Peterson reported that he heard back from Bob Rose with
Atlantic Skanska today who stated that their final offer is $350,000. By consensus, the Board
authorized the Manager to accept the offer calling it liquidated damages. If they want to change
the terminology, it will cost an additional $25,000-$50,000.
c.Update on Coleman/EYC v. Town Litigation (i.e., Corbinton Commons Retirement
Home)
10:21:43 PM Town Attorney Hornik reported that there are hearings scheduled for next
Monday. He reported that a third lawsuit has been filed against the Town this afternoon.

d. Update on Robbins v. Town Litigation (i.e. Asphalt Plant lawsuit)
10:31:55 PM Town Attorney Hornik reported that he feels that the League of Municipalities will
appeal this decision. But, if the League chooses not to appeal, the Town can still proceed with
an appeal if the Board desires.
e. Property Acquisition
10:58:58 PM Town Manager Peterson reported that this property acquisition is related to the
Fire Department. There is 3.84 acres that may be available for $125,000-$150,000 per acre.
11:04:31 PM Upon a motion by Commissioner Dancy, seconded by Commissioner Lowen, the
Board moved to return to Open Session by a vote of 5-0. The motion was declared passed.
