Tnat all poles erected by said Company snail be neat, s5^rmetrical and painted, and the len8tn thereof shall not be less than twenty (20) feet above the surface of the ground, and shall be sc loeu�ed us in no aay to interfere 'with the safety or convenience of persons traveling on or over the said streets, :alleys, highways and other public places•'and in the installation and maintenance of its undergrcund system, said Company shall not open or encumber more of any street, alley, highway or other public place than will be necessary to enable it to perform the work with proper economy and effic- iency. SECTIOF 2. That the erection of poles and construction Of conduits under the provisions of this ordinance, shall be subject to the supervision of the Chairman of the Street Committee or some other representative appointed by said Common Council, and said <11. replace and properly relay any side- r?. ::ave been djaplaasd au < 14, damaged by it in the construction and maintenance of its system, SECTION 3, That space on one (1) erossarm of the poles erected, or in one (1) duct of the conduits constructed under the provisions of this ordinance, shall be reserved, free of charge, for the purpose of carrying wires of any fire -alarm or police telegraph system owned and maintained by said Town, Provided the said wires are placed and maintained in such a manner as may be prescribed by the said Company, and in no case used to carry electric light or high-tension currents. SECTION 4. That the said Company shall maintain its lines in good and safe order and condition; and shall at all times fully indemnify, protect and save harmless the said Town from and against all claims arising from the erection, construc- tion or negligent maintenance of its said lines. SECTION 5. Said Company shall at all times be subject to the Torn ordinances now in existence, or which may hereafter be passed relative to the use of the streets by tele- phone companies. SECTION 6. That nothing in this ordinance shall be construed to grant unto the said Company any exclusive rigrt or to prevent a grant of similar privileges to other companies. SECTION 7. This ordinance shall be in force from its passage. BE IT FURTHER ORDAINZED that The Chesapeake and Potomac Telephone Company of Virginia, before proceeding to act under this ordinance, shall execute a bond in the penalty of Five Hundred Dollars (Y500.00), with good and sufficient security, in favor of the Town of Leesburg, conditioned upon the construction and putting into operation and maintaining in good order, the plant provided for in this franchise, and the furnishing of efficient telephone service at reasonable rates. Richard, Recorder of the Common Council of the Town of Leesburg, Loudoun County, Virginia, hereby certify that the above and foregoing is a true, accurate and complete copy of the ordinance granting a franchise to The Chesa- peake and Potomac Telephone Company of Virginia, enacted by said Comunon Council on the ',) L- day of 1917 by a recorded affirmative vote of three-fourths of all the members elected thereto; and I further certify that the requirements of the laws of the State of Virginia, regulating the grant of franchise, et cetera, by cities and to:;ns, were duly complied with.
