HomeMy Public PortalAboutOrdinance 00-853U1 1 1 ORDINANCE NO. 00 -853U AN URGENCY ORDINANCE OF THE CITY OF TEMPLE CITY EXTENDING ORDINANCE 00 -852 RELATING TO A MORATORIUM ON NEW DEVELOPMENTS AND DEVELOPMENT ENTITLEMENTS IN THE COMMERCIALLY ZONED PROPERTIES WITHIN THE PROJECT AREA FOR THE COMMUNITY REDEVELOPMENT AGENCY SURVEY AREA AS ADOPTED BY RESOLUTION 00 -3960, The City Council of the City of Temple City does ordain as follows: Section 1. Ordinance No. 00 -852U was adopted by this City Council on October 25, 2000 for a period of 45 days as an urgency ordinance under California Government Code Section 65858 imposing (pursuant to the findings set forth therein) a moratorium on all new construction and development entitlements within the commercial zones of the new Survey area adopted by this City Council in Resolution No. 00 -3960. As a means of protecting the areas in its present state pending the completion of the Redevelopment Plan for such area, and to avoid developments inconsistent with such plan, the Council further finds that said Ordinance 00 -852U and this Ordinance 00 -853U are exempt from CEQA both as emergency and temporary action, but also because under the citations contained in Ordinance 00 -852U these Ordinances are designed to protect the environment during a sensitive and developing period. Section 2. The Council further finds that progress has been made since the adoption of Ordinance 00 -852U on the development of the Project Plan for the Survey area and in particular for the commercial areas thereof. RFPs have been issued and consultants have been retained, preliminary sketches have been developed, and studies are underway with regard to public hearings. Section 3. It is necessary that Ordinance 00 -852U be extended beyond the initial 45 day period in order to protect the environment and permit the full development of the proposed Project Plan. Staff has published the requisite Notice for a hearing on December 5th 2000 for an extension of ten months and 15 days. Section 4. Except as set forth below, any and all development within the commercially zoned property (Downtown Specific Plan Boundaries) of the CRA Survey Area as established by Resolution No. 00 -3960 is hereby prohibited, and the Community Development Department is instructed to issue no entitlement permits during the term of this Ordinance. Ordinance No. 00 -853U Page 2 The following are exempt from this Ordinance: 1) Any project for which a building permit has been obtained prior to the effective date of ordinance no. 00 -852U. 2) Any facade improvement. 3) Any remodel or routine maintenance which does not result in the addition of more than 500 square feet of new floor area. 4) Any tenant improvement to accommodate a re -use of an existing structure, provided the haw use does not require discretionary review. 5) Any minor alteration or remodel to comply with current Code requirements such as seismic safety or ADA standards Section 5. Ordinance 00 -852U is hereby extended for an additional period of ten months and 15 days based upon the findings contained in this Ordinance as well as Ordinance No. 00 -852U as well as findings set forth and discussed in the City Council Staff Reports relative to this matter. Section 6. The City Clerk shall certify to the passage and adoption of this urgency Ordinance and shall cause the same to be published according to law. Section 7. The effective date of this urgency ordinance shall be December 5, 2000. PASSED, APPROVED, AND ADOPTED this 5th day of December, 2000.
