ALSO PRESENT: PLANNING AND ZONING ADMINISTRATOR LOREN KOHNEN AND PLANNING AND ZONING ASSISTANT SANDIE LARSON. ABSENT: SUSIE MACKAY The meeting was called to order by chairperson Lenny Leuer at 7:34 p.m. 1. BILL NUNN - 2825 WILLOW DRIVE - CONDITIONAL USE PERMIT AMENDMENT FOR ADDITIONAL SQUARE FOOTAGE FOR AN ACCESSORY STRUCTURE - PUBLIC HEARING - 7:35 P.M. Loren Kohnen read his memo to the planning commission and put up overheads of the site and proposed structure. Bill Nunn said that since he had submitted the proposal he has talked to his builder and he would like to extend the additional 10' farther than it shows on the plan. That would mean that he could leave the end trusses and posts that were already there instead of putting new in. Everything else would be as shown. Lenny Leuer wanted to know if all the accessory structures were included in the calculations and Loren said yes. Robert Etem, 2705 Willow Drive, said he was a neighbor to Mr. Nunn and mentioned the music coming from the carousel. He asked whether this addition would be utilized for the use of music - he said he had no objection to the building, but does have an objection to the indiscriminate use of music. B. Nunn said that they did have a band for a party that was loud and carried the music out of the yard. He said that is the reason for the insulated building. R. Etem said that satisfies his concern, because that was very loud last year. Bruce Workman asked for clarification on the ordinance on the size and number of accessory buildings. He said it was a good idea to put the noise inside. There was discussion of total square footage of the accessory buildings. Lenny Leuer mentioned the 150' setback for animal structures and said on the buildings on this site was not that far back - He wondered if now was the time to acknowledge and recognize that one of the buildings did not meet that setback. 1 L. Kohnen said the building in questions was the existing barn from many years ago. Carolyn Smith asked if that barn was destroyed, could it be rebuilt and Loren said no. She then said they should address the music. There are hours of operation for the use of the stable and could maybe have the music allowed those same hours. B. Nunn said that would be fine with him. Elizabeth Weir asked Mr. Nunn how much noise he anticipated. B. Nunn said hopefully none - he said he did not want to annoy anyone. Jerry Brost said that he had visited the site and he did not hear the music in the building until he opened the door. Frank Mignone asked how large this property was and Bill said 10.9 acres. C. Smith said she thought it would help if hours were noted for the music. R. Etem said he appreciated the planning commissioners opinions. He said he was content for Bill to operate his equipment as he sees fit and if it violates him, he will call Bill. He said he does not anticipate a nuisance from his standpoint. B. Workman said that Mr. Nunn was a responsible citizen and has done everything very well at his stable, etc. and will continue to do so in the future. There was a straw vote on whether to restrict the hours and the vote was to leave it as is. MOVED BY FRANK MIGNONE AND SECONDED BY JERRY BROST TO RECOMMEND APPROVAL OF A CONDITIONAL USE PERMIT AMENDMENT FOR BILL NUNN AT 2825 WILLOW DRIVE WITH THE FOLLOWING CONDITIONS: 1 Total square footage of buildings not to exceed 26,250 square feet. 2. The use of the carousel is for personal/private use only. 3. The building is to meet all building and fire codes. 4. If number of accessory buildings should change, the amended CUP must again be amended. 5. Any existing CUP's and amendments are to be combined into one document. 6. #12 in 89-45 to be updated, #12 in 89-45 to be eliminated and #7 in 89-45 to be changed to 7 days per week from 9-9. MOTION PASSED. 2 2. VALVOLINE INSTANT OIL CHANGE - CLYDESDALE TRAIL - CONDITIONAL USE PERMIT FOR INSTANT OIL CHANGE OPERATION - PUBLIC HEARING - 8:07 P.M. Loren Kohnen read his memo to the planning commission and put up overheads of the site, building, etc. He stated that the lower level would be for the bulk oil. He also said that no building permit would be issued until the final plat if filed at Hennepin County for this parcel. Sandie Larson said that Joe Francis, owner of the Holiday station next to this property has called and said that he supported this application. Mark Gilbertson, Valvoline, showed the planning commission a colored site plan. He pointed out where the exterior lights would be and stated that they were adequate for safety, but were not bright. The hours of operation are Monday thru Friday 8 -8; Saturday 8-5 and Sunday 11-4. He said that they capture and recycle the oil. Julius Dorweiler, 5022 County Road 101, said that he had no concern with this business, but questioned the cul de sac on Clydesdale and would it disappear. L. Kohnen said yes, that Clydesdale will go through farther onto the Cates property and cul de sac farther in. J. Dorweiler asked when it will go through all the way, that the cul de sac is a problem with trucks that can't go thru the station and have to back up. He said that the radius is too short for them to turn into the station, they back up with their beepers going and then they turn around, park and leave their lights on. There was discussion of the Holiday site, traffic on the hill, etc. J. Dorweiler said that the problem is Holiday, the entrance and now moving it 200 feet down the road. Frank Mignone asked how it could be rectified. M. Gilbertson said that Valvoline had bulk oil and cube vans that bring weekly delivery of oil. L. Kohnen said to remember that this is commercial property we are talking about. Carolyn Smith said that if trucks cannot get into Holiday to deliver - we need to solve that. There was further discussion of Clydesdale, parking, the cul de sac, etc. 3 J. Dorweiler said that if the cul de sac is big enough to turn around in, it would not be a problem. Jerry Brost asked about the height of the light poles and Mark said under 20'. J. Dorweiler asked how we would know that we won't have glare from the lights. M. Gilbertson said that he has provided the specs and that there will be no spillage off the property lines. J. Brost said that on the south side of 55 the property is elevated, can something be done so that you would not be looking at the bottom of the light from the highway. M. Gilbertson said they could turn it at an angle so that it pointed more toward the building than straight down. He said that Valvoline generally leaves the lights on until midnight. L. Leuer asked why you would need lights on when you are closed. M. Gilbertson said that they could be turned off when we close, but would like the sign on. He said that the barrel fascia is red and all lit and that shuts off at midnight. L. Kohnen said that the barrel is considered exterior lighting. L. Leuer said that he saw the Valvoline in Crystal and the `V' is lit, but not the entire barrel. C. Smith asked what was being counted as sign and what isn't. There was discussion of the barrel lighting on the building and discussion of the exterior, the green area, the fencing, etc. L. Kohnen read part of the glare ordinance and said that the proposal meets all of the ordinance. Elizabeth Weir said she would like to see the barrel light turned off after closing. F. Mignone asked if it met the glare and lighting ordinance. There was continued discussion of the barrel lighting, when to turn it off, etc. L. Leuer asked if there was any roof top mechanical equipment. M. Gilbertson said there is a ventilation fan that will be 30" above the roof, but not screened. 4 L. Kohnen said that it should not be a problem - that is cannot be blocked or it would not work properly. L. Leuer said that it shows a sewer hookup to the west, where from there. L. Kohnen said down the ditch to the north side of Highway 55. L. Leuer mentioned no outside storage and asked about a flammable waste trap - periodic inspections? B. Workman said that if it is not pumped, it moves into the septic system. M. Gilbertson said that the stores have a monthly check list. There was further discussion of where things are kept, etc. L. Leuer wanted to know if people could purchase bulk oil if they brought their own containers. M. Gilbertson said that it has never been brought up before, but he didn't know why not. Kathy Cook asked if the landscaping was adequate for screening. C. Smtih asked about the sign on the west side of the building - what kind of trees are there and if they are big enough to shade, etc. M. Gilbertson said that there are trees there now, mostly scrub trees - they would keep what they could. The public hearing was closed. MOVED BY CAROLYN SMITH AND SECONDED BY KATHY COOK TO RECOMMEND APPROVAL OF A CONDITIONAL USE PERMIT FOR VALVOLINE INSTANT OIL CHANGE WITH THE FOLLOWING CONDITIONS: 1. Clarified that the NURP pond can continue to be used as long as it is maintained. 2. Total building square footage allowed onsite not to exceed 2,300 square feet onthe main level. 3. All requirements of city engineer to be met. 4. All requirements of Elm Creek Watershed to be met. 5. All lighting to be downcast only - shoebox style - all sides enclosed except the bottom with the globe and light source not visible. 6. Parking lot and barrel lighting to be on from hours of 7 a.m. to 10 p.m. 7. All lighting to meet lighting and glare ordinance. If barrel fascia does not meet the glare ordinance it must be off until it does meet the ordinance. 8. Maximum height for any light pole to be 20 feet. 9. Paving and curbs as per city engineer. 5 10. No building permit to be issued until roadway (Clydesdale) is graded and base material installed and approved by city engineer. This to include the cul de sac. 11. No occupancy of building until street, parking, cul de sac, storm water, sewer and water have been completed and approved by city engineer. 12.Building to meet building and fire codes. 13.Valvoline to pay for 2 SAC units and 2 sewer and water connection fees at time of building permit. 14. Four (4) - 2 1/2" maple trees provided adjacent to Clydesdale and all landscaping to be maintained or replaced. 15.No outside bells or loudspeakers permitted. 16.No outside storage. 17. Maintenance log for flammable waste trap to be available for city staff review. 18.Acknowledge that the rooftop 30" ventilator need not be screened. 19. No business may be conducted until all conditions are met in the conditional use permit. 20. Final plat must be approved and registered before conditional permit is finalized. MOTION PASSED. 3. HENNEPIN PARKS - 2330 COUNTY ROAD 19 - CONDITIONAL USE PERMIT FOR EXPANSION OF MAINTENANCE FACILITY LOCATED IN BAKER PARK PUBLIC HEARING - 9:27 P.M. Sandie Larson read the memo to the planning commission and put up overheads of the site. Elizabeth Weir said that Loren's memo mentions using Black Hills spruce trees and wondered what would fit in instead of that, since they are not native to the area. Alex Meyer, Hennepin Parks, said that native red cedar would fit in and eventually would help with the screening. There was discussion of reforesting around NURP ponds, plantings, etc. A. Meyer said that the light standards would be 20 feet high. Lenny Leuer asked if the lights would be on all night. A. Meyer said they are on from 5 a.m. til dawn and then again from dusk to approximately 9 p.m. There was discussion of outside storage. Jerry Brost asked about the horse trail that goes to County Road 24 and wondered if it would be affected at all by this building, etc. and he was told it would not be affected. 6 There was discussion of sewer hookups in the park. L. Leuer asked if there would be a wash bay and a flammable waste trap. He also asked about vehicle washing and what the water tank was for. A. Meyer said yes. He said the water tank under the building was for the sprinkler system and they have welding in the building. Carolyn Smith asked what would be in the flammable storage building. A. Meyer said oil, grease, etc., the things that the mechanics use. There was discussion of flammable storage. MOVED BY ELIZABETH WEIR AND SECONDED BY KATHY COOK TO RECOMMEND APPROVAL FOR AN AMENDED CONDITIONAL USE PERMIT FOR HENNEPIN PARKS FOR THE EXPANSION OF THE NORTHERN DIVISION MAINTENANCE CENTER WITH THE FOLLOWING CONDITIONS: 1. Total square footage not to exceed 12,000 square feet. 2. Pioneer -Sarah Creek Watershed district to review and approve the site drainage plan. 3. City engineer to review and approve site plans, drainage plans, parking areas and storage yard construction. 4. Building to meet building and fire codes. 5. Sprinkler plans reviewed and approved by Maple Plain fire chief. 6. All lighting on proposed building, existing building, parking and storage areas must be downcast only, shoe box style, all sides enclosed except bottom with the globe and light source not visible. 7. Trash enclosures to be constructed of materials similar to proposed building. 8. All roof -top mechanical equipment to be screened. 9. The use of city sewer for this proposed building and entire park facility must be discussed and reviewed with city staff and park personnel before building permit is issued. 10. The two(2) SAC units must be paid for the new facility at the time building permit is issued and also two connection charges. 11.Additional reforestation to be provided using native plantings by the NURP pond. Also additional reforestation to be done to break up the visual impact from the park and trail system. 12. Hennepin County roads to review and approve existing driveway for the increased use. 13. Letter of credit to be provided for site and utility improvements. Costs to be supplied to city engineer to determine amount for the letter of credit. 14. All existing conditional use permits for this area to be combined with this amended CUP into one updated document. 15. Parking lot lights on at 5 a.m. and off at 9 p.m. 16. Flammable waste trap records to be available for review by city staff. 7 17. Height of light poles not to exceed 20 feet. MOTION PASSED. 4. MINUTES OF FEBRUARY 9, 1999 The following changes and corrections were noted: 1st page: - - -Lenny asked if they were - - -; - - - no plans for there - - - ; page 2: - - - Paul said he would change that; top of 3rd page: pressure on the city to upgrade more roads - - -; at the end of the last paragraph - - -shows 0 candle power at the edge of the parking lot. Page 6 correct the spelling of number; page 12, Madeleine Linck's statement should read: - - the bottom line is we should stay as is, with fewer buildable lots, people agree with "so why fix it if not broke" and on page 14 - - Susie will draft a letter - - - MOVED BY FRANK MIGNONE AND SECONDED BY ELIZABETH WEIR TO APPROVE THE MINUTES WITH THE NOTED CORRECTIONS. MOTION PASSED. Elizabeth Weir said that Susie had written a letter to Hennepin County regarding the award that the Hennepin County Public Works facility in Medina had been received and also about the "Elwell" property. Lenny Leuer felt that the letter should be joint authorship with the city council and suggested that it be put in the city council packets for the council to review. Carolyn Smith said it would be good to come from both the council and the planning commission. There was further discussion and it was felt that there should be joint signatures only if the council and planning commission were harmonious about the content. The letter will be sent to the council for the next council meeting. Julius Dorweiler, 5022 County Road 101, brought up a number of issues he felt needed clarifying in the city ordinances, including what is meant by outside storage for service stations and what is meant by allowing items for sale on the "islands" He stated how upset he was on the length of time it is taking to resolve the issues with the Holiday station - he mentioned the outside speakers being used at night, the signs on the fences, the lights. The planning commission feels that the city should respond to Mr. Dorweiler as to what the city is trying to do to alleviate the problems at the Holiday station. 8 MOVED BY FRANK MIGNONE AND SECONDED BY ELIZABETH WEIR TO ADJOURN.
