AN APPROPRIATION ORDINANCE REQUESTING THE RECOVERY OF
COSTS REGARDING THE FURNISHING OF WATER FOR PUBLIC FIRE
PROTECTION PURPOSES
WHEREAS, Indiana Code 8-1-2-103(d) allows for a municipal governmental unit to
recover its costs previously directly paid to a public water utility regarding
the furnishing of water for public fire protection purposes; and
WHEREAS, pursuant to the above Indiana Code, a City's Common Council may
request, by Ordinance, that the water utility serving its area recover its
current revenue received from the City for the above purposes, from the
customers of its utility based upon a new schedule of rates; and
WHEREAS, the allocation of such cost to all customers of the utility living in Richmond
is deemed to be a reasonable and equitable means of paying the cost of the
described services, while still providing for the health, safety and welfare of
the City's citizens.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana as follows:
Section 1. The City of Richmond hereby adopts this Ordinance to recover all costs
incurred for the production, storage, transmission, sale and delivery, and
furnishing of water for public fire protection purposes, and in conjunction
therewith, hereby incorporates by reference all applicable provisions of I.C. 8-1-2-
103(d) and I.C. 8-1.5-4-14(b) in order to recover such costs.
Section 2. Notice of adoption of this Ordinance and the request for such charges to be
included in the basic rates of customers, shall be immediately provided to the
applicable Public Water Utility Company, to -wit: Indiana -American Water
Company.
Section 3. The City of Richmond acknowledges that the construction cost of any fire
hydrant installed at the request of the City shall still be paid for by the City,
notwithstanding the cost recovery provisions of this Ordinance.
Section 4. This Ordinance shall be in full force and effect from and after January 1,
1997; or thirty (30) days after any new required rate is filed by the above water
utility with the Indiana Utility Regulatory Commission; whichever event is last to
occur.
