A SPECIAL ORDINANCE AUTHORIZING AND/OR CONFIRMING A
CONTRACT FOR SEWAGE TREATMENT SERVICE BETWEEN THE
CITY OF RICHMOND SANITARY DISTRICT AND THE TOWN OF
BOSTON
WHEREAS, Boston, a municipality, proposes to construct, maintain, own and operate a
sewer works for the purpose of collecting and disposing of the sewage of
the Town of Boston and other users in a sanitary manner; and
WHEREAS, the City of Richmond, Indiana, a municipality, has heretofore constructed
and now operates a sewage treatment plan; and
WHEREAS, I.C. 36-9-23-16 permits the municipality of Richmond, Indiana as the
owner of the sewage treatment plant to authorize the execution of a contract
to teat all of the sewage of the municipality of the Town of Boston, Indiana;
and
WHEREAS, I.C. 36-9-23-16 permits the municipality of the Town of Boston to contract
for the treatment of its sewage; and
WHEREAS, the Board of Richmond Sanitary District Commissioners has previously
approved a Contract for such services, a copy of which is incorporated by
reference and attached to this Ordinance, subject to confirmation and
approval by Common Council; and
WHEREAS, the Sanitary Board may be allowed to execute such Contract on its own, but
certain statutory provisions make it prudent for Common Council to
authorize and/or confirm the execution of the Contract.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana, that the City of Richmond Sanitary District may enter into the attached contract
with the Town of Boston regarding sewage treatment services, and that the execution of
such contract by the Board of the Sanitary District is hereby authorized, confirmed and
approved.
Passed and adopted this day of 996, by the Common Council of
the City of Richmond, Indiana.
