PRESENT PLANNING AND ZONING ADMINISTRATOR LOREN

1. MINUTES OF FEBRUARY 10, 1998
Minutes were approved unanimously with a correction to page 3, last line. The word
"where" should be changed to "were".
2. COMPREHENSIVE PLAN COMMITTEES
The memberships of the committees were reviewed:
A. General Development Policies Elizabeth
City Wide Lane Use Susan
Housing Carolyn
Kathy
Committee to meet and review sections then meet with Loren before bringing
recommendations to the full commission.
B. Sanitary Sewer Anne Jerry
Transportation Lenny Frank
Committee to meet and review sections then meet with Jim prior to bringing to
full Commission.
C. Section 3 - population, household and employment Staff
D. Factors influencing development All to review
E. Mission Statement Elizabeth Jerry

Commission members were reminded that if meetings have 3 or more
commissioners meeting, then it must be posted as a public meeting and must be held at
City Hall. Sandie should be notified at least 3 days in advance in order to post the
meeting notice.

3. ELECTION OF CHAIR AND VICE -CHAIR
Anne Heideman was nominated for Chair and was voted in unanimously.
Frank Mignone was nominated for vice -chair and was voted in unanimously.
Thanks to them both.
4. TREE ORDINANCE
Draft tree ordinance was reviewed. This draft was just also reviewed by a
regional climatologist, Hannah , and additional language has been
suggested by her that is not yet incorporated into the current draft. Modifications to
language were suggested and noted on draft which Elizabeth will edit and return to the
commission. The committee was commended for the detailed work, the clarity and the
scope of the ordinance. Jim Dillman's contributions were recognized as very valuable
to the work. Issues of concern to the commission:
• Language regarding penalty for violation of the ordinance needs reworked.
• Issue regarding the cutting of significant trees on private property after development
has been concluded needs further discussion.
• The commission was somewhat divided on how it would support the ordinance if it
applied to residential parcels developed for two or more homes, vs single lots
developed by private parties as their own home. (assumed it would apply to all
commercial developments)
• Commission raised the question should new or additional buildings developed on
existing developed property (i.e. barn, garage, other accessory buildings, etc. ) be
required to follow the same preservation and replacement policies? General sense
was they should.
• Commission members felt that we need an ordinance that is reasonably
enforceable. Enforcing damage or destruction of trees within 2 years of application
seems a difficult thing to enforce.
• Question raised whether we can identify particular/designate/special trees or
woodlands in Medina that would have special protective language. Special priority
preservation areas(and reasons for) would need to be reviewed and clarified for the
commission.
• Definition of Woodlands needs to be clarified.
• Preservation, Replacement and Forestation needs to be clarified.
• Significant trees excluded needs further work.
• Suggested that language re: protection from livestock (cows, horses) be
incorporated into ordinance.
• The concept of a Conservation Easement should be looked into.
The chair duly noted the "beating" that the commission gave to the ordinance draft and
thanked Elizabeth for her openness to the critiques.
