Regular Session
April 12, 1994
The Greencastle Common Council met in regular session on Tuesday, April 12, 1994 at 7:30 p.m.
at Tzouanakis Intermediate School. On call of the roll the following members were shown to be present:
Councilor Tom Roach, Councilor Jerry Calbert, Councilor Sue Murray, Councilor Charles Miles, Councilor
Mike Rokicki. Also present was City Attorney John Zeiner.
Public Petitions and Comments:
A letter of request for street closings on campus for the purpose of Commencement Exercises for
DePauw University was presented to Council. It was the consensus of Council to allow the annual street
closings.
A letter of request for street closings on the square for the purpose of Heritage Preservation Fair
was presented to Council. It was the consensus of Council to allow the annual street closings.
Mr. and Mrs. Don Moore requested that Council consider the rezoning of a piece of property on the
south side of Martinsville Street from C3 to residential to allow for the construction of a single family
dwelling. Mayor Harmless noted that the request would first be heard by the Plan Commission with
subsequent recommendation coming to Council.
Public Hearing:
A Public Hearing on the following items was opened by Mayor Harmless.
Resolution 1994 -8, A Resolution to Re- establish a Cumulative Capital Development Fund, was
presented and read in its entirety by Mr. Zeiner. Initial discussion occurred concerning the allowable uses
possible for CCD funds and Council came to consensus as to the allowable uses to include in the
resolution. Councilor Murray moved to approve Resolution 1994 -8 as decided upon. This motion was
seconded by Councilor Roach also indicating that as I.C. 36- 9 -16 -3 (11) is not applicable to the City, to
too, should be stricken from the resolution. Mayor Harmless asked for any comments or questions. There
were none. On call for the question the motion to approve Resolution 1994 -8 was carded by an aye
unanimous vote. Mayor Harmless declared Resolution 1994 -8 to have been passed and adopted this date.
Resolution 1994 -9, A Resolution Authorizing An Additional Appropriation for the Cumulative Capital
Improvement Fund, was presented and read in its entirety by Mayor Harmless. Councilor Rokicki moved
to approve Resolution 1994 -9 as presented. This motion was seconded by Councilor Miles. Discussion
ensued with explanation of the projects. Mayor Harmless asked for any comments or questions from the
public. There were none. On call for the question the motion to approve was carded by an aye unanimous
vote. Mayor Harmless declared Resolution 1994 -9 to have been passed and adopted this date.
Mayor Harmless closed the Public Hearing.
Approval of Minutes:
The minutes of the March 8 regular session, March 16 executive session and the April 5 public
hearing were distributed to Council. Councilor Calbert requested clarification of the statement in the April
5 minutes concerning correction the advertisement. The Clerk- Treasurer explained that because of the lack
of a preposition, the sentence sounded like the $500,000.00 CF grant was reduced by $460,000.00 instead
of to $460,000.00. Councilor Roach moved to approve the minutes as presented. This motion was
• seconded by Councilor Murray and was carried by an aye unanimous vote.

• Department Reports:
In addition to the monthly statistical reports, the following comments were made.
Mayor Harmless introduced Curt Cooley as the new Park and Recreation Director. He also
announced the Arbor Day Celebration at the park Sunday, April 17 at 2:00 p.m. Councilor Murray asked
if the pool had lost water over the winter. Park Board member Leslie Hanson explained that it was partially
drained last fall.
Councilor Rokicki asked Fire Chief O'Hair when building inspection would start again. Chief O'Hair
explained that the department is still short staffed and every effort would be made to begin soon.
Police Chief Hanlon reported that training with the new firearms would begin in June.
Councilor Roach asked Mr. Phillips to investigate water leakage at the corner of Washington and
Madison Streets.
Mr. Lawrence noted that a concerned citizen had asked about the side of the quarry adjoining the
Gardenside Drive neighborhood, and whether it could be fenced. Mr. Lawrence indicated that he would
investigate the issue with the owners of the property.
Mr. Wright reported that the drain has been installed at the corner of Gardenside and Hammond
Streets and paving was all that is left to do on the project. Councilor Calbert asked about a patching
schedule. Mr. Wright noted that he has outlined the areas to be patched.
Mayor Harmless announced that Don Monnett, Cemetery Superintendent, would be retiring as of
April 29.
Mr. Zeiner reported that three property owners had been given ten day notice to abate nuisance
and if the time limit is not met court action would be taken. He also indicated that an executive session
of the County Commissioners is to take place Monday concerning the culvert repair issue. Councilor
Calbert moved to execute the complaint this date with instructions to the City Attorney to file the complaint
the day after the County Commissioners meeting if the issue is not satisfactorily resolved. This motion was
O seconded by Councilor Rokicki and was carried by an aye unanimous vote.
Recommendations and Requests from Officers and Departments:
Ordinance 1993 -15, An Ordinance Authorizing Conveyance of Real Estate By Greencastle
Community School Corporation to the City of Greencastle, was presented and read in its entirety. Councilor
Rokicki moved to approve Ordinance 1993 -15 as presented. This motion was seconded by Councilor
Calbert and was carried by an aye unanimous vote. Mayor Harmless declared Ordinance 1993 -15 to have
been passed on first reading. Councilor Rokicki thanked the Greencastle Community School Corporation,
the School Board and the Park Board for the efforts in reaching this agreement, noting that the land is much
needed by the park.
Resolution 1994 -5, A Resolution Authorizing the Expenditure of Industrial Development Funds, was
presented and read in its entirety by Mayor Harmless. Councilor Murray moved to approve Resolution
1994 -5 as presented. This motion was seconded by Councilor Miles. Mayor Harmless indicated that the
level of funding for Main Street Greencastle to be $5400.00. The motion was carried by an aye unanimous
vote. Mayor Harmless declared Resolution 1994 -5 to have been passed and adopted this date.
Resolution 1994 -10, A Resolution Authorizing Modification of the CFF Grant No. 93 -127 for
Foxridge (Phase 11) Water and Sewer Project, was presented and read in its entirety by Mayor Harmless.
Councilor Murray moved to approve Resolution 1994 -10 as presented. This motion was seconded by
Councilor Roach and was carried by an aye unanimous vote. Mayor Harmless declared Resolution 1994 -10
to have been passed and adopted this date.
Resolution 1994 -11, A Resolution Establishing a Capital Improvement Plan for County Economic
Development Income Tax, was presented and read in its entirety by Mayor Harmless. Councilor Rokicki
moved to approve Resolution 1994 -11 as presented. This motion was seconded by Councilor Murray and
was carried by an aye unanimous vote. Mayor Harmless declared Resolution 1994 -11 to have been passed
and adopted this date.
