HomeMy Public PortalAboutResolution 02-27 Open Container SuspensionRESOLUTION NO. 02-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, IDAHO, REGARDING THE SUSPENSION OF THE OPEN CONTAINER ORDINANCE FOR SPECIFIED TIMES AND LOCATIONS AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Lardo Grill & Saloon is catering a wedding, to be held on August 24, 2002; and WHEREAS, Lardo Grill & Saloon is planning to cater the wedding at Brown Park; and WHEREAS, the Deputy City Clerk has issued a parks reservation permit with the Police Chief's approval allowing beer, wine, kegs, pony kegs, party balls and other alcoholic beverages; and WHEREAS, the McCall City Council finds a temporary and limited suspension of the open container ordinance would be in the public interest and would further McCall's economic well-being or development. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL THAT: Section 1. The property described below, and more commonly known as Brown Park, is authorized as the area for catering for the wedding. Section 2. The provisions of McCall City Code 5-5-030(F), prohibiting the possession of an open container of an alcoholic beverage, are hereby suspended within Brown Park. Section 3. This resolution shall be in effect only on August 24, 2002, between the hours of 3:00 pm until 8:00 pm and only after obtaining a catering permit from the City of McCall for this activity and the furnishing to the City Clerk of a certificate of insurance naming the City as an additional insured with a combined single limit of at least $500,000 and not exceeding $1,000,000, such amount being subject to the discretion of the Clerk. Section 4. Beverages purchased within or brought into Brown Park must be consumed within Brown Park. Lardo Grill & Saloon agrees to conspicuously post the boundaries of the food court signs which make it clear that, "alcoholic beverages are not permitted beyond this point". In the event Lardo Grill & Saloon fails to confine the consumption of alcoholic beverages to Brown Park, the Police Chief may order such event to be closed, and such suspension of the open container ordinance to be revoked. Section 6. This resolution shall be in full force and effect upon its passage and approval.
