HomeMy Public PortalAbout6/14/1994" GREENCASTLE COMMON COUNCIL Regular Session June 14, 1994 The Greencastle Common Council met in regular session on Tuesday, June 14, 1994 at 7:30 p.m. at Tzouanakis Intermediate School. On call of the roll the following members were shown to be present: Councilor Tom Roach, Councilor Jerry Calbert, Councilor Charles Miles, Councilor Mike Rokicki. Councilor Sue Murray was absent. Also present were City Engineer Joe Woody and City Attorney John Zeiner. Public Petitions and Comments: A special session of Council was requested to address the vacation of public right - of -way in the Yorkshire Subdivision and the rezoning of a portion of property adjacent to Martinsville Street. Approval of Minutes: The minutes of the May 10 executive session and the May 10 regular session were distributed to Council. Councilor Rokicki corrected the minutes of the May 10 executive session to indicate the absence of Mr. Zeiner. Councilor Rokicki then moved to approve the minutes as corrected. This motion was seconded by Councilor Miles and was carried by an aye unanimous vote of members present. Department Reports: " Mr. Wright reported that Dallas Mangus is filling the position of animal control officer. Councilor Miles commended Mr. Wright for the already apparent difference in animal control. Councilor Rokicki asked if the new valve pit solves the problem at the Lobdell Emery lift station. Mrs. Nichols indicated that they are still working on the issue. He also asked Water Superintendent Phillips about the rusty water. Mr. Phillips reported that the department is looking into the problem. During the park department report Mark Hammer presented draft legislation to establish non - reverting operating and non - reverting capital funds for the park and recreation department. No action was taken. It was also reported that the plans for the new rest rooms at the park have been completed, but further engineering services are necessary to move forward with the project. With the absence of a full time city engineer, the development of specifications, advertisement, bid review will have to be contracted. The Farmers Market is set to open on June 25th. Discussion also ensued concerning the completion of the park house renovation. The cost was reported to be $23,000 to $24,000 plus the work yet to be done on the roof. Mr. Zeiner reported that the procedure for petition to vacate public rights -of -way consists of readings of an ordinance before Council with the first being advertised as a public hearing ten (10) days prior to the first reading. He suggested that Council establish such procedure locally including the petitioners be represented by counsel to insure proper petition format and legal description of the property in question. Councilor Calbert requested that a resolution be drafted to that effect. Council Rokicki asked about � the bridge list. Mr. Zeiner indicated that it had been developed and delivered to the County Commissioners for review. CC 6114194 Page 2 Mayor Harmless indicated that he is taking any and all questions and comments concerning the new traffic light at the corner of Round Barn Road and Indianapolis Road, and any other concerns prior to the city receiving jurisdiction of Indianapolis Road. Councilor Rokicki asked about the flashing light at the corner of First Street and Veterans Memorial Highway. Mr. Wright reported that installation would begin as soon as the new approval is received from the state. Recommendations and Requests From Officers and Departments: Ordinance 1994 -6, An Ordinance of the City of Greencastle Authorizing the Issuance of Sewage Works Revenue Bonds for the Purpose of Providing Funds to Pay the Cost of Certain Additions, Extensions and Improvements to the Municipal Sewage Works of said City, Providing the Safeguarding of the Interests of the Owners of said Bonds, Other Matters connected therewith, including the Issuance of Notes in Anticipation of Bonds, and Repealing Ordinances Inconsistent herewith, was presented and read by title only by Mayor Harmless. Mr. John Seever of HJ Umbaugh made a presentation of new estimates for the bond issue using the actual costs of items already bid. The proposed rate increase was approximately 19 %. Discussion ensued concerning time table for the bond issue and the construction projects, the projects not yet bid. Councilor Calbert moved to table Ordinance 1994 -6 stating that he is not in favor of a parameters bond ordinance with the final projects to be bid in two days. He also indicated that the • information was again not presented with consideration of time for Council review. This motion was lost for lack of a second. Further discussion occurred concerning the ability to adjust the parameters of the bond ordinance after the bid opening on Thursday and before a special session of Council on Friday. At the conclusion of that discussion Councilor Rokicki moved to table Ordinance 1994 -6 until Friday witht the stipulation that the new bid numbers are reflected in the ordinance. This motion was seconded by Councilor Calbert and was carried by an aye unanimous vote of members present. Ordinance 1994 -7, An Ordinance Approving the Petition of Lee and Linda Perry to Vacate Public Right -Of -Way in the City of Greencastle, Indiana, was presented. Councilor Miles moved to table. This motion was seconded by Councilor Rokicki and was carried by an aye unanimous vote of members present. Resolution 1994 -14, A Resolution Approving Petition to I.U.R.C, for Approval of Water Rates, was presented and read in its entirety by Mayor Harmless. After discussion Councilor Rokicki moved to approve Resolution 1994 -14 as presented. This motion was seconded by Councilor Miles and was carried by an aye unanimous vote of members present. Mayor Harmless declared Resolution 1994 -14 to have been passed and adopted this date. Resolution 1994 -15, A Resolution Determining Property Boundaries Between the City of Greencastle and Wood Subdivision, was presented and read in its entirety by Mr. Zeiner. After explanation Councilor Miles moved to approve Resolution 1994 -15 as presented. This motion was seconded by Councilor Roach and was carried by an aye unanimous vote of members present. Mayor Harmless declared Resolution 1994 -15 to • have been passed and adopted this date " CC 6/14/94 Page 3 Council Reports and Comments: Councilor Calbert commented on the tax abatement for the Wal -Mart addition. Mr. Zeiner indicated that Wal -Mart filed for abatement within the parameters of the original allowance and that the State Board of Accounts allowed the tax abatement based on the original approval. Councilor Rokicki thanked Joe Woody for his efforts on behalf of the city concerning the traffic issue on Keightly Road and Bloomington in regard to the Putnam County jail project. A special session of Council was set for Friday, June 17 at 3:00 p.m., location to be announced. With no further business Councilor Roach moved for adjournment. This motion was seconded by Councilor Miles, was carried by an aye unanimous vote of members present, and the meeting was adjourned at 9:55 p.m. Michael M.
