M. The Mayor then led the Pledge of Allegiance to the flag. INVOCATION: Invocation was given by Rev. Roger Hillis of West- minster Presbyterian Church, 9642 Live Oak Ave., Temple City. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Merritt, Tyrell ABSENT: Councilmen - Fitzjohn, Nunamaker ALSO PRESENT: City Attorney Shatford & City Manager Wonllett APPROVAL OF MINUTES: Councilman Dickason moved to approve the minutes of the regular Council Meeting of September 10, 1962, as mailed, Councilman Merritt seconded, and carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen - Fitzjohn, Nunamaker UNFINISHED BUSINESS: 6, ORDINANCE NO. 62 -89: Urgency Ordinance City Attorney Shatford read in full Ordinance -No. 62 -89, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY MUNICIPAL CODE TO PROVIDE FOR OPERATION OF MON- COMMERCIAL SOUND TRUCKS IN EXCESS OF THREE HOURS PER DAY. Councilman Dickason moved to adopt Ordinance No, 62 -89 as an urgency ordinance, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen - Fitzjohn, Nunamaker 7. ORDINANCE NO. 62 -90: 1st reading. City Attorney Shatford read title to Ordinance No. 62 -90 AN OR- DINANCE OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY MUNICIPAL CODE BY ADDING TIME LIMITATIONS ON PARKING OF VEHICLES EXCEEDING A MAXIMUM GROSS WEIGHT OF THREE TONS ON STREETS OTHER THAN "TRUCK ROUTES ". Councilman Merritt moved to waive further reading of Ordinance No. 62 -90, Councilman Dickason seconded, roll call vote as follows: AYES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen - Fitzjohn, Nunamaker ORDINANCE NO. 62 -92; 1st reading. City Attorney Shatford read title to Ordinance Mo. 62 -92 AN OR- DINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISH- ING TIME LIMITATIONS ON PARKING OF VEHICLES EXCEEDING EIGHTY INCHES IN OVERALL WIDTH ON STREETS OTHER THAN TRUCK ROUTES. Councilman Merritt moved to waive further reading of Ordinance No. 62 -92, Councilman Dickason seconded, roll call vote as fol- lows: AYES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen - Fitzjohn, Nunamaker 8, PAYMENT FOR AMERICAN LEGION PROPERTY: DISCUSSION The City Attorney advised that he was certain that in the next day or two he would receive the title policy from Title Insur- ance Co. They have advised him on the title search up to date nothing appears and only easements on the property are general easements of public utilities and nothing further that will effect construction on the property. He stated the check for $37,160.00 appears on the warrant Resolution for payment to the Legion forthis property and he urged the Council to approve 341 Council Minutes September 24, 1962, page 2 payment subject to receipt of the Title Insurance and fire in- surance with payment not being made until all necessary require- ments are completed, as the Legion is in escrow and need this money also to complete their transaction. City Manager Woollett advised the certificate concerning insurance only had been re- ceived today, and we are only awaiting for title insurance. Councilman Dickason moved to approve the expenditure of $37,160.00 in payment of the American Legion property, Post 279, subject to receipt of Title Insurance, Councilman Merritt se- conded, roll call vote as follows: AYES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen - Fitzjohn, Nunamaker 9. PROPOSED INCREASE OF LAW ENFORCEMENT COSTS: Discussion. Mayor Tyrell stated on Wednesday, September 26, at 10 A.M. we go to the Grand Jury to make a presentation to them regarding law enforcement costs, and today received from four cities re- ports from individual auditors concerning costs. 4e hope we will be able to influence the Board of Supervisors to determine the .issue. 10. PUBLIC HEARING 8:00 P. M. Proposed Zone Chancre R -2 to R -3, 8917, 8919, 8923 Elm St., Anton and Mary Scherer. Planning Advisor presented the request for chance advising 130 ft. of property faces Elm St. and 96 ft. on Rosemead with R -2 zoning since 1947 and there are six duplexes to the west, and one immediately adjacent, and mixed commercial on Rosemead Blvd. Mr. Scherer, owner of the property advised the neighbors in the area were in accord with the zone change to R -3 and there was no opposition at the Planning Commission meeting. The Mayor asked if anyone else wished to speak in favor of the chance. No one came forward. The Mayor then asked if anyone wished to speak against the zone change. No one came forward. Councilman Dickason moved to close the Public Hearing, Council- man Merritt seconded & carried. The Mayor declared the Public Hearing closed. City Attorney Shatford read title to Ordinance No. 62 -88 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING RECOMMENDATIONS OF THE PLANNING COMMISSION AND GRANTING A CHANGE OF ZONE FROM R -2 TO R -3 ON THE REAL PROPERTY LOCATED AT 8917, 8919 AND 8923 ELM ST., TEMPLE CITY, CALIFORNIA, AS REQUESTED BY ANTON AND MARY SCHERER IN CHANGE OF ZONE CASE NO. 62 -39. Councilman Dickason moved to waive further reading of Ordinance No. 62 -88, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen - Fitzjohn, Nunamaker First reading so no further action was taken. 11. NEW BUSINESS: RECREATION ACTIVITIES REPORT FOR MONTH OF AUGUST: Director of Recreation Victor Kobett reported to the Council on the summer recreation program and it's closing the latter part or August. There was some discussion regarding the check- out system of games, etc. Councilman Merritt moved to receive and file, Councilman Dickason seconded, and carried. 12, REPORT ON ANNUAL AUDIT; In the absence of City Treasurer Griesmeyer, City Manager Woollett read a letter from the City Treasurer advising the Finance Committee together with a representative of Lawson & Co. went over the annual report who advised the Committee that he could not make any recommendations for any improvement to our present system of recording City funds and City accounts. He felt the books were set up properly; and there were no addition- al suggestions to be made. Councilman Dickason moved to receive and pile, Councilman Merritt seconded and carried. Councilman Dickason suggested that City Treasurer Griesmeyer attend the next Council meeting and this report be on the Agenda again then, 342 Council Minutes, 'September 24, 1S.'62, page 3 13. RESOLUTIONS NO. 62 -236 & NO. 62 -237 City Manager'Woollett advised these two Resolutions were to authorize the City Manager to go ahead and invite bids according, to the Government Code, one for picnic shelters at the Live Oak Park, and one for installation of a lighting (outdoor) system at Live Oak Park. Councilman Merritt moved to adopt Resolution No. 62 -236, Councilman Dickason seconded, roll call vote as fol- lows: !YES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen - Fitzjohn, Nunamaker Councilman Merritt moved to adopt Resolution No. 62 -237, Coun- cilman Dickason seconded, roll call vote as follows: AYES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen- Fitzjohn, Nunamaker 14. CURB & GUTTER IMPROVEMENTS: EAST & WEST SIDE FARAGO AVE. 5000 to 5200 blocks. City Manager Woollett advised the petitions re- presented more than 60% on both sides of the street and recom- mended the Council set a Public Hearing. Councilman Dickason moved to set a Public Hearing for these improvements for 7:45 P. M. on October 3, 1962, after proper notification, Councilman Merritt seconded, and carried. 15. PARKS & RECREATION COMMISSION RECOMMENDATIONS: City Manager Woollett presented Resolution No. 62 -239 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING' SUPPORT FOR THE COUNTY PARKS AND RECREATION CHARTER AMENDMENT Following discussion Councilman Merritt moved to adopt Resolu- tion No. 62 -239, Councilman Dickason seconded and carried. 16. PLANNING COMMISSION RECOMMENDATION: ORDINANCE NO. 62 -87 :1st read City Attorney Shatford advised the Commission felt if the driveway was 125 ft. or less a 12 ft width was adequate but if over 125 ft. the width should be 20 ft. to provide adequate ingress and egress, with unobstructed height limits. Following discussion the City Attorney read title to Ordinance No. 62 -87 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE MUNICIPAL CODE TO ESTABLISH DRIVEWAY WIDTH AND HEIGHT CLEARANCE REQUIRE- MENTS FOR ALL ZONES PERMITTING APARTMENT HOUSES AND IN PARTICU- LAR ZONE R -3. Councilman Dickason moved to waive further read- ing, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen- Fitzjohn, Nunamaker As this was the first reading no further action was taken. 17. TRAFFIC COMMISSION RECOMMENDATIONS: George Envall, Traffic Advisor, presented the recommendation to the Council from the Traffic Commission, regarding installation of east -west alleys north and south of Las Tunas, for recon- sideration by the Council. On the south side of Las Tunas Dr. from Golden West to Cloverly they recommend one -way alleys west - bound, and on the north side of Las Tunas Dr. they recom1 mend east bound one -way alleys from Kauffman to Oak Ave. The felt it .definitely a safety measure for fire equipment and police, as well as trucks delivering and loading, and a safety measure for the pedestrian. Councilman Dickason suggested due to the fact two Councilmen were not present and both are mer- chants and thereby effected, that this matter be held over for decision and also to have all reasons pro and con in writing for study and consideration by the Councilman. Councilman Dickason so moved, Councilman Merritt seconded and carried. 18. RESOLUTION NO. 62 -238: WARRANTS & DEMANDS Following discussion Councilman Merritt moved to adopt Resolu- tion No. 62-238, warrants and demands in the sum of $55,978.41, Nos. 1866'through 1891, Councilman Dickason seconded, roll call vote as follows: 343 Council Minutes, September 24, 1962, page 4 AYES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen -F i tz j ohn, f\!unamaker 19. COMMUNICATIONS: (a). City Manager. Woollett read a letter from the Temple City P. T. A. requesting the City to proclaim Oct. 1 -6 as "Temple City P, T. A, Membership Week ". Councilman Merritt moved to have the Mayor so proclaim, Councilman Dickason seconded, and carried, (b) The City Manager read a letter from the L. A. County Heart Assn. requesting a charitable solicitation permit for use in the City for annual drive from Febr. 1 through 28, 1963. Councilman Dickason moved to approve, Councilman Merritt seconded, and carri ed. (c) The City Manager read a letter from Muscular Dystrophy Inc. requesting a charitable solicitation permit for the month of December, 1962. Councilman Merritt moved to approve, Councilman Dickason seconded, and carried. (d) City Manager Woollett read a letter from CARE U. S. A. re- questing the City to adopt a resolution going on record as being fully in sympathy and supporting additional help to be given Iran due to the severe earthquake there. Councilman Merritt mov- ed to approve, Councilman Dickason seconded, and carried, 20. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK R. J. Rodenbeck, 9220 Sparta St., Temple City, requested informa- tion regarding the truck parking ordinance which had its first reading before the Council tonight. The City Attorney clarified the interpretation of the proposed ordinance. Frank Parrington, 5709 N. Temple City Blvd., referred to Ordin- ance No. 62 -87 which was first read tonight, regarding driveways and clearances for R -3 properties stating it would create a hard- ship to him with reference to his property. The City Attorney explained what procedure he could follow at present, and if not accomplished before the Ordinance becomes effective, how to apply- for a variance. 21. MATTERS FROM CITY OFFICIALS Councilman Dickason asked regarding Annexation No. 4 -A, West Temple City, and was advised it was completed on September 13, 1962, City Manager Woollett presented three letters from the L. A. Co. Boundary Commission regarding annexations #296 and #301, El Monte and #33, So. El Monte. Councilman Merritt moved to receive and file, Councilman Dickason seconded, and carried, The City Manager read a letter from the Temple City Business & Professional Women's Club requesting Oct. 7 -13 be proclaimed as "National Business Women's Week in Temple City ". Councilman Dickason moved to so proclaim, Councilman Merritt seconded, and carried. A letter from Supervisor Warren Dorn was read by Mr. Woollett requesting the Council to prepare a Resolution commending Maury Wilts for his national recognition for stealing bases in the game of baseball. Councilman Dickason moved the Mayor sign a letter written by the City Manager regardino . this function, Coun- cilman Merritt seconded, and carried. The City Manager read a letter from the Community Chest of Temple City requesting Oct. 18 -25 be proclaimed as ''Community Chest Week ", Councilman Dickason so moved, Councilman Merritt seconded, and carried, The City Manager read a letter from the Temple City Lions Club 344 Council Minutes, September 24, 1x62, page 5 requesting the Council to set aside Oct. 5 and 6 for annual White Cane drive of the Lions Club, to proclaim these days as "White Cane Days" and grant a charitable solicitation permit for this purpose. Councilman Merritt so moved, Councilman Dickason seconded, and carried. City Manager Woollett read a letter from Wm. Geller, Asst. Count Librarian, advising the Council that the County was willing to pay the additional cost to provide for exterior face brick and carpeting throughout the new Library in the amount of $15,000. Following considerable discussion regarding this and also the placing of the mechanical room in the basement of the proposed building it was agreed to adjourn this me ?tine until Thursday night, Sept. 27, 1962, at 6:30 P. Councilman Dickason moved to adopt Resolution No. 62.240, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen - Fitzjohn, Nunamaker 22.
