ORDINANCE NO. 02 -873
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY AMENDING SECTION 4400 OF THE TEMPLE CITY MUNICIPAL
CODE RELATIVE TO ALLOWING ALCOHOLIC BEVERAGES TO BE
SERVED IN CONJUNCTION WITH A SIDEWALK CAFE.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY HEREBY ORDAINS AS FOLLOWS:
SECTION 1. WHEREAS the City Council amended the Downtown Specific Plan to allow sidewalk
cafes in conjunction with bona fide restaurants, the City Council hereby amends the Municipal Code to
provide an exception for the serving of beer or wine to be consumed on a public sidewalk.
SECTION 2. The City Council amends paragraph 1 of Article IV, Chapter IV, Section 4400 as shown
below:
4400 DRINKING UPON PUBLIC STREETS
No person shall drink any alcoholic beverage containing more than one -half of one percent of alcohol by volume
1) upon any public street, alley, sidewalk or parkway (except for the sale and consumption of beer and wine in
conjunction with an approved sidewalk cafe operated as a permitted accessory or incidental activity at a "bona
fide restaurant" as that term is defined by Temple City Municipal & Zoning Codes and the Department of
Alcoholic Beverage Control); nor 2) in any public building, public lavatories, auto park; nor 3) within the public
lobby or entranceway of any public or private business or commercial building within the City; nor 4) within any
City park or other City owned property.
SECTION 3. Except for the above enumerated amendment, the remaining text of Section 4400
shall remain in its existing form.
SECTION 4. The City Clerk shall certify to the passage and adoption of this Ordinance and to its
approval by the Mayor and shall cause the same to be published according to law.

introduced at the regular meeting of the City Council of the City of Temple City held on the 6th day of August,
2002, and was duly passed, approved and adopted by said Council, approved and signed by the Mayor and
attested to by the City Clerk at a regular meeting held on the 20th day of August, 2002, by the following vote:
AYES: Councilman - Souder, Wilson, Vizcarra, Gillanders
NOES: Councilman -None
ABSENT: Councilman -Zovak
