HomeMy Public PortalAboutOrdinance 02-8741 1 ORDINANCE NO. 02 -874 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY ZONING CODE RELATIVE TO LOT SPLITS AND FLAG LOTS THE CITY COUNCIL OF THE CITY OF TEMPLE CITY HEREBY ORDAINS AS FOLLOWS: SECTION 1. Based upon the findings contained in the Planning Commission Resolution No. 02 -2025 and the discussion of pertinent information provided in Planning Commission Staff reports and based upon the minutes of the Planning Commission for April 9 and May 14, 2002 and based upon the Public Hearing conducted before the City Council on June 18, 2002, and further, based upon a joint meeting between the Planning Commission and City Council held on July 30, 2002, and based upon a revised Planning Commission Resolution, which was adopted after conducting a new noticed public hearing, held on August 27, 2002, and based upon the Public Hearing conducted before the City Council on September 17, 2002, the City Council amends the Temple City Zoning Code as described in Section 3 below. SECTION 2. This project should result in no significant effects upon the environment, and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates that there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 3. The City Council amends the Temple City Zoning Code as recommended by the Planning Commission in Resolution No. 02- 2025PC. The Zoning Code shall be amended as follows: ARTICLE IX PART XIII — RESIDENTIAL DISTRICTS DIVISION 1 — ZONE R -1 SECTION 9333 STANDARDS OF DEVELOPMENT All premises in the R -1 zone shall comply with the following standards of development. B. Lot Width. Each lot or parcel of land in Zone R -1 shall have a minimum lot width of not less than 50 feet, provided that no lot shall be created after the effective date of these regulations having a lot width of less than 60 feet. Exception: R -1 zoned lots in existence on the effective date of this Ordinance (October 31, 2002) may be subdivided as described below: 1. Flag Lot Subdivision: With the approval of a Conditional Use Permit, an existing lot may be subdivided in a flag lot configuration subject to the following limitations: j a. No existing lot shall be subdivided into more than two lots b. Each subdivision shall be subject to the approval of a Parcel Map as well as a Conditional Use Permit c. The original existing lot to be subdivided shall have a street frontage of at least 80 feet, and Ordinance 02 -874 Page 2 Zoning Code Amendment d. Each such subdivision shall be limited to the creation of no more than one flag lot, with a minimum street frontage of 20 feet; within the required 20 foot wide minimum accessway to any newly created flag lot, no more than 12 feet may consist of hardscape, the remaining 4 feet on either side shall consist of landscaping. The abutting landscape strips shall be fully irrigated and shall be improved with shrubbery and tall, fast growing plants as opposed to ground cover and low lying plants. The driveway shall contain decorative brickwork, stamped concrete and /or landscaped pavers, subject to review and approval of the granting body. No Parking or storage shall be permitted in the 20 foot wide accessway; and e. A minimum of 7,200 square feet of lot area shall be provided per newly created lot, exclusive of any "pole" portion of a flag lot, which provides access from the street, and f. No such "flag lot" subdivision shall be created on Halifax Road between Daines Drive and Live Oak Avenue, legally described as Lots #1 -12, Block A, Lots #1 -8, Block B and portions of Lots #9 -11, Block B of Tract No. 11695, Los Angeles County Recorder Map Book 215 -23 -24 and a portion of Lot 32 of E.J. Baldwin's addition #1 to Santa Anita Colony, Los Angeles County Recorder's Miscellaneous Records 52 -60, as shown on Exhibit "A" attached. {ova. No. 89 -645} g. No "flag lot" created under the provisions of this section shall be improved with any structure which exceeds one story or twenty feet in height' {ova. No. 98 -82o} 2. Lot Split: With the approval of a Conditional Use Permit, an existing lot may be split into no more than two lots, subject to the following limitations: a. Each subdivision shall be subject to the approval of a Parcel Map as well as a Conditional Use Permit, and b. The original existing lot to be subdivided shall have a street frontage of at least 100 feet and each of the newly created lots shall have a street frontage of at least 50 feet, and c. A minimum of 7,200 square feet of lot area shall be provided per newly created lot. ARTICLE IX CHAPTER 1 — ZONING CODE PART VI — ZONE VARIANCES AND CONDITIONAL USE PERMITS DIVISION II — CONDITIONAL USE PERMITS 9202 - CONDITIONAL USE PERMITS. WHEN REQUIRED. The following verbiage shall be added to the list of uses which require a Conditional Use Permit: - Subdivisions, including tract maps and parcel maps for flag lots, lot splits and condominium projects 1 1 1 1 1 1 Ordinance 02 -874 Page 3 Zoning Code Amendment SECTION 4. The City Clerk shall certify to the passage and adoption of this ordinance and to its approval by the Mayor and shall cause the same to be published according to law.
