A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, IDAHO,
REGARDING THE SUSPENSION OF THE OPEN CONTAINER ORDINANCE
FOR SPECIFIED TIMES AND LOCATIONS AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Chamber of Commerce is sponsoring the 4th of July
Celebration, to be held on July 4, 2002; and
WHEREAS, the Chamber of Commerce is planning a food court in Carey
Park and wishes to sponsor a beer court within the same; and
WHEREAS, the Council finds a temporary and limited suspension of the
open container ordinance would be in the public interest and would further
McCall's economic well-being or development.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL
OF THE CITY OF McCALL THAT:
Section 1. The property described below, and more commonly known as
Carey Park, is authorized as a food court:
The area known as Carey Park bounded on the west by the Hotel
McCall, on the east by Bev's Cafe, on the north by Lake Street and
on the south to the end of the green belt at Carey Park.
Section 2. The provisions of McCall City Code 5-5-030(F), prohibiting the
possession of an open container of an alcoholic beverage, are
hereby suspended within the food court described above.
Section 3. This resolution shall be in effect only on July 4, 2002, between the
hours of 10:00 am and midnight and only after the obtaining of
catering permit(s) or Section 23-1007(A)(2) permit(s) for this activity
and the furnishing to the City Clerk of a certificate of insurance
naming the City as an additional insured with a combined single
limit of at least $500,000 and not exceeding $1,000,000, such
amount being subject to the discretion of the Clerk.
Section 4. Beverages purchased within or brought into the food court area
must be consumed within the food court area. The Chamber of
Commerce agrees to conspicuously post the boundaries of the food
court signs which make it clear that, "alcoholic beverages are not
permitted beyond this point".

Section 5. In the event the Chamber of Commerce fails to confine the
consumption of alcoholic beverages to the food court, the Police
Chief may order such food court to be closed, and such suspension
of the open container ordinance to be revoked.
