October 11, 1994
The Greencastle Common Council met in regular session on Tuesday, October 11, 1994 at 7:30
p.m. at Tzouanakis Intermediate School. On call of the roll the following members were shown to be
present: Councilor Tom Roach, Councilor Sue Murray, Councilor Charles Miles. Also present was City
Attorney John Zeiner. Councilors Calbert and Rokicki were absent.
Public Petitions and Comments:
Ron Smith was present to discuss with Council the issue of the sewer pipe foundation on the
Foxridge project and its impact on the sewers going i to the Woodsedge Subdivision. Mr. Smith indicated
that he has spoken with Mr. Barnes about bringing the issue to the attention of Bonar & Associates, project
engineers. The Mayor indicated that he would set up a meeting with Chris Barnes, Ron Smith and himself.
David Thomas appeared before Council concerning an alley bordering his property. He was
informed by Jim Wright on October 7 that the city abandoned the alley in 1973. Mr. Thomas stated that
he never received notification. Mr. Zeiner explained that if Mr. Thomas wants to challenge the city record
he would have to have the property surveyed and obtain legal representation to review legal description and
petition on his behalf. Councilor Murray asked if the city has been maintaining it as an alley. Mr. Wright
explained that he had until Mr. Lawrence found record of the alley vacation.
Mary Thomas of 1049 Avenue E appeared before Council concerning the issue of the Welty
property at 1041 Avenue E. Mr. Zeiner reported that ordinance violation had been filed in the courts and
he would pass on the court date to Mrs. Thomas.
® A discussion of gang activity in the city ensued with Chief Hanlon noting that the department is
aware of some occurrences and that it is extremely difficult to prove.
Tami Parker of Main Street Greencastle reported that the 60 new parking spaces have been
created in the Moose parking lot and the first set of lights have been installed around the square. She
noted that DePauw donated the banners. Additional lights are available to installed in the spring. She also
reported that Second Hand Sue's needs a loading zone.
John Fajt appeared to thank the city for the repaving of Ritter. He said it was a great job.
Approval of Minutes:
The minutes of August 25 were distributed to Council. Councilor Miles moved to approve the
minutes. This motion was seconded by Councilor Roach and was carried by an aye unanimous vote of
members present.
Department Reports:
In addition to monthly statistical reports, the following comments were presented.
Chief O'Hair noted that ISO will be in Greencastle to do fire ratings on Monday - Wednesday.
Jim Wright noted that the Great Eastside project should start by October 12 and be completed
within 45 days.
Mr. Zeiner reported that Sewer revenue bonds were sold that afternoon with a net effective interest
rate of 6.33 %, noting that the estimated rate was 6.8% and the difference should save approximately
$200,000.00 over the life of the issue. Councilor Murray asked that Mr. Zeiner keep Council informed of
® the action concerning the Welty property.
Discussion ensued concerning the alley downtown. Mr. Wright noted that he has been maintaining
the whole alley. Councilor Murray asked if the issue could be resolved by the next meeting.
