HomeMy Public PortalAbout11/21/1994 special® GREENCASTLE COMMON COUNCIL Special Session November 21, 1994 The Greencastle Common Council met in special session in conjunction with the County Commissioners on November 21, 1994 at 5:00 p.m. at the courthouse. Representatives of the City who were present included: Councilor Tom Roach, Councilor Jerry Calbert, Councilor Sue Murray, Councilor Mike Rokicki, Mayor Harmless, City Engineer Chris Barnes, City Attorney John Zeiner. Councilor Charles Miles was absent. Commissioner O'Hair opened the meeting with the Pledge of Allegiance. Mr. Barnes distributed a memo describing a method of sharing bridge repair expenses based size criteria. The memo stated the small classification includes 48" culverts and smaller serving a 100 acre water shed. The intermediate classification included structures between the 48" culvert and the 20' plus span. The large classification included structures with a span of 20' or greater abutment to abutment. Concerning responsibility for structures inside the city limits, Mr. Barnes suggested the city assume the small structure classification; the city and county share responsibility for intermediate structures, and the county assume responsibility for large structures. Mr. Walton thanked Mr. Barnes for his efforts and continued that he did not feel the county had a responsibility for structures underthe 20' span criteria. Mr. O'Hair noted that he needed further clarification. Mr. Clodfelter indicated that the county does have responsibility for the first bridge on Albin Pond Road and would consider splitting the cost of the repairs to the second bridge. Mr. Lowe, County Attorney asked if such an agreement would be binding if the state legislature ® changes its definition of a bridge for the purpose of expending cumulative bridge funds. Mr. Calbert responded that he would expect it only to be binding while the statute maintains the current definition. He also noted that if it were allowable for the city to pull out of the county cumulative bridge fund and levy its own cumulative bridge fund and repair its own bridges, that would also be a solution. Discussion continued concerning the repairs made on Albin Pond Road and the College Street bridge. Mayor Harmless indicated that the city sewage department would be willing to evaluate moving the sewer line at the College Street bridge site. Mr. Walton indicated that no decision could be made at this time. Councilor Murray asked that the issue be listed on the agenda of December 13. County Clerk Marty Watts informed Council that a portion of property inside the city limits had not been annexed according to the records she had reviewed.
