ALSO PRESENT: PLANNING AND ZONING ADMINISTRATOR LOREN KOHNEN AND PLANNING AND ZONING ASSISTANT SANDIE LARSON ABSENT: SUSIE MACKAY, JERRY BROST AND TOM SUPEL The meeting was called to order by chairperson Lenny Leuer at 8:08 p.m. 1. JEAN DIDIER/NEW CONCEPTS, INC. 2992 ARDMORE AVE - VARIANCES FOR FRONT AND REAR YARD SET -BACKS - PUBLIC HEARING CONTINUED FROM OCTOBER 1999 Tom Velner, New Concepts, was present representing the applicants. Loren Kohnen read his memo to the planning commission . He added that everything presently on site would be removed. Loren put up an overhead of the existing house and then put up an overhead of the proposed house. Richard Inselman, 2982 Ardmore Ave., said that his main concern was all the debris that was on site and that it would be removed. Tom Velner, New Concepts, said that everything would be removed and hauled away. Elizabeth Weir questioned the 3' elevation above the flood plain and asked if dirt had to be hauled in to accomplish that. She also asked about the proposed deck shown on the plans. T. Velner said that there would be a crawl space and the dirt excavated for that would be spread out. He also said there would be no deck, it is a patio. L. Kohnen explained that a variance would not be needed for an on grade patio. If it is 8" or more above grade, then it is considered an encroachment. Lenny Leuer asked what the significance was of the 17.3 feet shown on the survey L. Kohnen pointed out that it was the distance to the 100 year flood plain line. L. Leuer asked if all three lots were combined. Staff will check and make sure they are. He then asked about the furnace room in the house and if there will be a floor drain there. 1 T. Velner said that a floor drain is required and most likely would put the drain into the sump basket. The public hearing was closed. MOVED BY ELIZABETH WEIR AND SECONDED BY BRUCE WORKMAN TO RECOMMEND APPROVAL OF THE FOLLOWING VARIANCES: 14.5 FOOT FRONT SET -BACK VARIANCE AND 23.2 FOOT LAKE SET -BACK. THE HARDSHIPS BEING: EXISTING LOT, DIMENSIONS OF THE LOT STREET TO LAKE AND THE EXISTING 100-YEAR FLOOD ELEVATION. THE FOLLOWING CONDITIONS TO APPLY: 1. All buildings and foundations and debris to be removed from the site. 2. Any materials be removed from City property. 3. A dumpster be placed on site and used during construction. 4. Silt fencing be installed on site at the direction of city staff before any construction or removal of debris is started. 5. A survey of the property and home be done to establish a 3' elevation above the 100-year flood plain by any inhabited areas in the home. MOTION PASSED. 2. MINUTES OF JANUARY 11, 2000 MOVED BY ELIZABETH WEIR AND SECONDED BY BRUCE WORKMAN TO APPROVE THE MINUTES AS PRESENTED. MOTION PASSED. Lenny Leuer welcomed new planning commissioner Jim Lane. Lenny also mentioned that we would be sending a letter of thanks to Kathy and Frank. 3. ELECTION OF CHAIR AND VICE -CHAIR Bruce Workman nominated Lenny Leuer for chairperson and Elizabeth Weir seconded the nomination. Lenny Leuer elected chairperson for 3-2000 to 3-2001. Bruce Workman nominated Elizabeth Weir for vice -chairperson and Lenny Leuer seconded the nomination. Elizabeth Weir elected vice -chair for 3-2000 to 3-2001. 2 4. PLANNING COMMISSIONERS FOR CITY COUNCIL ATTENDANCE Sandie Larson mentioned that in the past she had done a schedule for the entire year for which planning commissioner to attend which council meeting. She suggested that instead, at the planning commission meetings, commissioners were selected for the next 2-3 meetings. All agreed. Representatives are: March 21 st April 4th April 18th Elizabeth Weir Lenny Leuer Lenny Leuer Lenny then talked of the proposed ordinance from the Sarah -Pioneer Creek Watershed. There was some discussion of this. Representatives of the watershed will be at the April 18th city council meeting to discuss this. MOVED BY ELIZABETH WEIR AND SECONDED BY BRUCE WORKMAN TO ADJOURN.
