1. Description,of the nature of the variance requested.
2. A narrative statement demonstrating that the requested
variance conforms to the following standards:
a. That special conditions and circumstances exist which
are peculiar to the land, structure, or building involved
and which arc not applicable to other lands, structures
or buildings in the same district.
b. That special conditions and circumstances do not re-
sult from the actions of the applicant.
c. That granting the variance requested will not confer
on the applicant any special privilege that is denied by
this Ordinance to other lands, structures or buildings in
the same district.
3. Post office addresses of all persons entitled to notice.
4. Filing fee of $25.00.
5. Legal Description of Property.
Upon receipt of an application for a variance the Planning Com-
mission shall proceed in accordance with the provision set forth
in Procedures, Appeals and Action by Affected Persons Chpt 24.
SPECIAL USE PERMIT REQUIREMENTS:

2. A plot plan of the property, drawn to scale, showing the
following information:
a. relationship of the proposed development to the Comp Plan
b. the relationship of the property to the surrounding area
c. the plan of sub or resub, if any.
d. land uses, building location and number of dwelling units
e. the arrangement of streets and pedestrian ways
f. the location of off-street parking spaces and loading or
service areas.
g. the location of public or communal open space
h. plans for site grading and landscaping
i. plans for water supply, sewage disposal and storm water
drainage.
j. such additional information as the commission may request.
3. A narrative statement evaluating the effects on adjoining pro-
perty; the effect of such elements as noise, glare, odor, fumes
and vibration of adjoining property; a discussion of the general
compatibility with adjacent and other properties in the district;
and the realtionship of the proposed use to the comp plan.
4. Statements by all property owners within three hundred (300)
of subject property.

Upon receipt of a request for a special use permit the Planning
Commission shall set the date for and hold a public hearing and
subsequently make recommendations to the City Council for approval
or denial of the request in accordance with the provisions set
forth in the chapters concerning Prodedures, Appeals, and Action by Affected
Persons.
THE APPLICANT shall also file a written application on a form
provided by the Planning Commission. Such application shall be
accompanied by the above requirememts.

STANDARDS PERTAINING SPECIAL USES:

A special use permit may be granted only in the Planning Commission finds that the
establishment, maintenance or operation of the construction, development, activity
or use in the particular case:
1. Will, in fact, constitute a special use as established in the Zoning Ordinance
for the zoning district involved.
2. Will be harmonious with and in accordance with the general objectives, or with
any specific objective of the Comprehensive Plan and/or the Zoning Ordinance.
3. Will be designed, constructed, operated and maintained to be harmonious and
appropriate in appearance with the existing or intended character of the general
vicinity and that such use will not change the essential character of the same area.
4. Will not be hazardous or disturbing to existing or future neighboring uses.
5. Is not detrimental to the health, safety, peace, morals, comfort and.general wel
fare of persons residing or working in the neighborhood of such proposed use.
6. Will not cause any substantially harmful environmental consequences on the land
of the applicant or on other lands or waters.

yards, open space, walls, fences, parking areas, loading zones and design standards
applicable to such use as required by this Ordinance.
The Commission, in acting upon an application, shall provide that the approval of
the Special Use Permit be contingent upon acceptance and observance os specific con-
ditions, including, but not limited to the following:
1. Conformity to approved plans and specifications.
2. Performaice characteristics, related to the emission of noise, vibrations and
other potentially objectionable elements.
3. Limits on the maintenace and operation and on the time of day for the conduct
of specified activities.
4. The period within which the permit shall be exercised or otherwise lapse.
5. Guarantees as to compliance with the terms of the approval.
6. Approval of building appearance and landscaping.
7. Limits on the type and amount of traffic, off-street parking, condition and
width of adjoining streets and access.
Upon granting a special use permit the Planning Commission may require more restric-
tive standards than those generally required in an ordinance.

I. Statement of Proposed Change:
The desire of Mr. Kemp to construct a single family residence in the
proposed location would have no impact on the comprehensive plan,
availability of public facilities, or compatibility with the surrounding
area. The desire is, simply, to replace one old dilapidated single
family residence with a new one of attractive design. The reason for
the variance request is that the topography of the lot precludes
locating the dwelling any further from the lake. A stream flows through
the property and moving the dwelling any further from the lake would put
it down the back side of a bank, toward the stream bed. The Kemp's
lot is heavily forested and moving the dwelling to either side would
require removing many mature trees. Mr. Kemp therefor requests a
waiver of Section 9-3B of the Impact Area Ordinances which will allow
him to locate a new dwelling in the approximate location of the existing
one.

you should enjoy all of the recreational activities which are

We are pleased to approve the building plans provided us. Our
approval, however, is contingent on the assumption that you used
the existing survey rods located on the beach and near the rear power
pole for your south boundary corners.
As neighbors, we share in the state -built access road to our
properties. This road traverses both lines. In the past, we have
experienced some traffic and parking difficulties, but I am sure
that with a little neighborly give and take, we can do just fine with
joint use.

At the November 23, 1981, meeting of the Area of City Impact Planning
and Zoning Commission, the following action was taken:
lh• Commission recommends to the City Council the approval of the request
r J. R. Kemp for a Variance and Special Use to construct a house within
the Shoreline and River Environs District 57 feet 6 inches from the high
water mark of the Payette Lake instead or :he required 75 feet, on Lot 14,
Payette Lake Cottage Site, Valley County, Idaho. As required by 3A-20-4:
1. That special conditions and circumstances do exist which are peculiar to
the land involved, 2. That special conditions and circumstances do not
result from the actions of the applicant, and 3. That granting the variance
requested will not confer on the applicant any special privileges that are
denied by this Ordinance to other lands, structures or buildings in the
same district.
