PRESENT: Mayor Dan Gubler,-- Council President Rob Geray, Council Member Peter Wadsworth, Council Member Michael Thompson, Council Member Kathy McNamara, City Attorney Andrew Rawlings, Public Works Director Zech Prouse (via teleconference) and City Clerk/Treasurer Keri West. ABSENT: None. VISITORS: Bill Koester, Brian Smaka, Evan Mann, Mary French, Gary French, Clark Morsbach, Rachel Keppner, Amanda Keppner and Brennan Keppner. Mayor Gubler welcomed everyone and Council Member Thompson led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of September 28, 2021 were reviewed. Council reviewed the finance reports for the period ending September 30, 2021 (100% of the fiscal year elapsed). The City had $1,710,887.10 in the bank and routine bills had been paid,"Exhibit A". Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the consent agenda as presented. Council President Geray seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Discussion of City Events — Assistant Farrens was unable to attend in person, but called in to discuss upcoming City Events. She stated that she has spoken with Iona Elementary School regarding the City's desire to join them in a Veterans Day program. However, the staff at Iona Elementary informed her they are not planning on holding a Veterans Day program this year. Assistant Farrens continued and asked the Council if they would like to hold a flag ceremony at the City Building on Veterans Day and distribute appreciation gifts to all City veterans. Council President Geray stated if we are able to confirm someone to come to the City Building that morning and hold a flag raising ceremony with refreshments at 11:00am, he thinks that would suffice. Assistant Farrens stated in previous meetings the Council has expressed the desire to hold some kind of Christmas event. She continued and stated Council Member McNamara has confirmed volunteers to do free "sleigh rides" around the City Park. Council Member McNamara stated they notified her their intended date for this activity is Saturday, December 4th at 3:30pm. Assistant Farrens asked the Council if they would like to also light the City Building or a tree in the City Park with Christmas lights. She continued and stated in her volunteer meeting it was suggested to do a City Building lighting ceremony with music and light refreshments. She also suggested incorporating the existing activities the City does every year such as a food drive and the Mayor's Youth Advisory Council (MYAC) Angel Tree. All Council Members stated approval of this activity. Council President Geray asked if cost estimates have been determined. Assistant Farrens stated she received a quote from a company to do all the lights on the building IONA CITY COUNCIL REGULAR MEETING—OCTOBER 19,2021 for $2,500. However, Director Prouse has stated his department would be willing to hang the lights on the building. She continued and stated if they do the labor,the City would be paying the upfront cost of the lights and a lift rental. Council Member Thompson stated he has experience with lighting commercial buildings and will communicate with Assistant Farrens directly to determine cost. Clerk West stated when they have estimates on cost, she will send an email out to all the City Council to confirm approval prior to moving forward. All Council Members agreed. Assistant Farrens then stated one of the volunteers suggested having the Belnap Family be at the event to plug in the lights. She continued and stated the intention would be to come together and mend any hurt feelings from the past. Council President Geray stated he agrees it is a good concept, but believes most people will view that as a negative act. Ordinance to Amend Iona City Code §§ 11-1-5, 11-11-6 and 11-11-2; specifying requirements for accessory buildings, adding detail on converting dwellings to more units and adjusting various definitions in the Zoning Title of the Iona City Code (Ord. 272-10- 21)—Attorney Rawlings stated the Council has had previous discussions on basement dwellings and the Conditional Use in the R-I Zone which allows basements to be rented out. He continued and stated that discussion involved the concern of increased density in the R-1 Zone. Attorney Rawlings continued and stated Clerk West has also received numerous questions and requests regarding Accessory Buildings with additional dwelling space inside. Attorney Rawlings stated this situation could also present concerns regarding increased density, parking and utilities. He continued and read aloud the proposed amended definition for Accessory Use or Buildings as: "A subordinate use or building customarily incident to and located upon the same lot with the primary use or building, which does not duplicate or replace the primary use, but which is normal given such primary use and is merely supportive of the primary use." Attorney Rawlings also read aloud the proposed amendment to I 1-11-6(D): "In any residential zone (i.e. the Residential Agricultural (R-A) Zone, the Single Family Residential (R-1) Zone, the Residential Townhouse (R-T) Zone, and/or the Residential (R-2) Zone), no accessory building may be a dwelling, residence,habitation,apartment,or house." Council President Geray asked if the amendment to the Accessory Building section is necessary if they amend the definition of Accessory Buildings to state the primary use cannot be duplicated. Attorney Rawlings stated this is an attempt to clearly define what the intent is regarding dwellings in accessory buildings without creating ambiguity. Mayor Gubler stated this amendment does not restrict someone from building a shop with a mother-in-law suite, it simply requires them to go through the process of changing their zoning to a zone that allows it. Attorney Rawlings stated accessory buildings are currently listed as a"Permitted Use" in the R-1 Zone, so without amending the section regarding accessory buildings it could create further confusion as to what is allowed as an accessory building. Attorney Rawlings continued and stated someone would need to re-zone their property or apply for a Variance to have an accessory building with a dwelling inside. Mayor Gubler stated this is a Public Hearing and asked if anyone from the audience would like to speak for or against this proposed Code Amendment. 2 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 19,2021 Rachel Keppner of 2765 N. Barnes Way stated they purchased their home in October 2019 with an existing shop on the property. She continued and stated there was a framed apartment in the shop that they have now finished and currently allow their son and his young family to live. She asked what the argument is against allowing more people to live on one property. She also asked if there is a grandfathered clause to allow existing accessory buildings with dwellings to continue. Mayor Gubler stated there is a grandfathered clause, but building an apartment in an accessory building to create multiple dwellings in the R-1 Zone was already prohibited. He continued and stated she would need to go through the process of changing the zoning of her property to allow this type of use. Attorney Rawlings clarified that a non-conforming use is allowed to continue after a code amendment. Mayor Gubler stated it is not allowed to continue if the use was already prohibited. He continued and stated the City Code has never allowed a home in the R-1 Zone to have a shop turned into an apartment because the R-1 Zone does not permit multiple dwellings. Council President Geray asked Mayor Gubler where that is prohibited in the current code. Mayor Gubler stated again the R-1 Zone only permits single family dwellings. Council President Geray stated he understands the R-1 Zone was designed with single family dwellings as a permitted use, but "Accessory Buildings and Uses" is also listed as a permitted use. He continued and stated there is nothing in the current code that prohibits accessory buildings to be used in that manner. Mayor Gubler stated the whole point of the R-1 Zone is for single family dwellings. Council President Geray stated he understands the intent of the R-1 Zone is to only allow single family dwellings, but he is having a hard time finding anywhere in the current code that specifically prohibits the use of an accessory building as an apartment. Council President Geray continued and stated this situation has uncovered a loophole on how to allow more than one dwelling on the property and that is why this amendment is being proposed. Council Member Wadsworth stated the Council has previously approved for residents to rent out their basement to family members. He continued and asked if there is any way to allow dwellings in accessory buildings and add the stipulation that they can only be rented by family members. Attorney Rawlings stated the Council has gone through and made amendments to basement dwellings as a Conditional Use. He continued and stated the Council could amend the Conditional Uses section of the R-1 Zone to address "Accessory Buildings". Council President Geray stated "Accessory Buildings"are currently listed as a Permitted Use and there are not many restrictions on how the accessory buildings may be used. He continued and stated the main concerns with allowing additional dwellings in an accessory building include population density and added use on the water system. Council President Geray also stated this is the reason basement rentals have to pay a second water bill. He continued and stated population density is a concern because of the additional load on City infrastructure to accommodate added residents in a more dense area. Mrs. Keppner stated her house was built in 1995, but is unaware when the shop was built. Mayor Gubler stated he believes her shop was granted a variance when it was built. Mrs. Keppner asked what the process is to change the zoning of her property to allow the apartment in the shop. Council President Geray admitted that is a difficult request because he would be reluctant to allow one lot to change to the R-2 Zone if it was located in an established R-1 Zone. Mayor Gubler then asked Attorney Rawlings if the City allows Mrs. Keppner to continue renting her apartment to her son, what recourse does the City has if she decides to rent it to a non-family member after her son moves out. Attorney Rawlings stated if the City determines Mrs. Keppner has a non-conforming use, she can continue using it as she has previously. However, non- 3 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 19,2021 conforming uses cannot be changed or intensified in any way without being brought into compliance. Mayor Gubler then questioned whether building regulations are being followed in these situations and stated he believes Certificate of Occupancies should be issued in these circumstances. He continued and stated an accessory building is inspected differently than an apartment would. Clerk West stated when a permit is issued for an accessory building, all inspections are still required and completed based on mechanical, electrical and building requirements for the use of the space. Mayor Gubler then stated a dwelling needs to be inspected and deemed safe for residents to live in the space. He continued and stated a shop does not require the same inspections as a dwelling unit. Council Member Thompson stated he does not agree and stated many shops are built with an apartment and are required to meet the same standards. Mayor Gubler then asked Attorney Rawlings if the City can now require Mrs. Keppner to obtain building permits and have inspections completed prior to allowing habitation in the apartment. Attorney Rawlings stated he would need to research that. Council Member Wadsworth stated he does not consider this a problem. He continued and stated the City has never received any complaints about Mrs. Keppner's apartment in the shop. He stated it is the Keppner's property and he doesn't see the need to prohibit her son living in an apartment in a shop on their property, but allowing him to live in their basement. Council Member Wadsworth stated he does not see the difference in those two situations. He continued and suggested allowing accessory buildings with living quarters, but setting regulations on doing so. Council Member Thompson agreed and stated the City could include the second water bill requirement, just as was done for basement rentals. Council President Geray stated this code amendment is intended to close the loophole to protect the intent of the R-1 Zone as a single family dwelling zone. Council Member Wadsworth stated he does not agree with the code amendment as written. He continued and stated he does not have a problem with the situation Mrs. Keppner has presented and does not want to prohibit other families in the City from doing the same thing on their property. Council President Geray stated he understands, but if there is nothing in the code, the City has nothing to stand on when a problem arises from similar situations. Council Member Wadsworth agreed, but stated he feels there are additional amendments to consider that maintain the family atmosphere of the City and accomplishing the same goal to limit use in accessory buildings. Attorney Rawlings stated he is unsure if the City can limit rentals of accessory building apartments to family only. He continued and stated the basement rental policy the City approved specifies that the basement can be rented to anyone as long as someone with ownership interest also lives on the property. Mayor Gubler stated he understands the Keppner's situation would qualify as a non-conforming use and will be grandfathered in if this code amendment passes. He also stated any other residents currently in the same situation will be considered non-conforming also. Mayor Gubler then asked if anyone else from the public would like to address the City Council for or against this code amendment. No response. Mayor Gubler then closed the Public Hearing portion of this agenda item to allow further deliberation amongst the City Council. Council Member Wadsworth asked if they could allow dwelling units in accessory buildings but restrict them from being rented. He elaborated and asked if the City could allow residents to have an accessory building dwelling specifically for guests or an adult child to occupy the dwelling, 4 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 19,2021 but not allow it to be rented as income. Council Member Thompson agreed and stated when a shop permit is submitted with living quarters included, the inspections for mechanical, electrical and building are required to ensure it is safe for human habitation. He continued and suggested adding a subsection in the"Accessory Building" section to allow living quarters with restrictions such as square footage, etc. Council Member Thompson continued and stated he is currently building a shop. He does not have plans for living quarters, but would like the option to add it later and realizes he would need to pull a permit at that time to meet building code for human habitation. Attorney Rawlings stated one option the Council could consider would be to change the Accessory Buildings to a Conditional Use, rather than a Permitted Use. This would allow restrictions on how the accessory buildings are being used. Clerk West asked if that would require every shop permit to be approved by Council. Attorney Rawlings stated it could be written to only require accessory buildings with living quarters be approved by Council. Mayor Gubler stated he does not agree with this suggestion and believes allowing another building with a residence inside defeats the purpose of the R-1 Zone. Council Member Thompson stated he understands that perspective, but feels it is appropriate for residents to have the option of having guests stay in their shop rather than in the home. Clerk West then stated if this amendment is passed. it prohibits the City Office staff from issuing an accessory building permit if it has living quarters outlined in the plan. Mayor Gubler confirmed and stated if a resident wants to build an accessory building with living quarters they would need to go through the process of changing their zone. Council Member Wadsworth asked if this would disallow a shop with a bathroom. Mayor Gubler stated the shop can have a bathroom, but no living quarters. Council President Geray stated he does not want to consider changing this to a Conditional Use because it creates too much subjectivity. He continued and stated this amendment will help to protect the intent of the R-1 Zone. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Ordinance No. 272-10-21. an Ordinance of the City of Iona, Idaho; amending Section 11-1-5 of the Iona City Code; adjusting various definitions for purposes of Title II of the Iona City Code; amending Section 11-11-6 of the Iona City Code; specifying requirements for Accessory Buildings; amending Section 11-11-2 of the Iona City Code; adding detail on converting dwellings to more units; providing methodology; preserving prior ordinances in each instance; providing for severability; and establishing an effective date. Council President Geray also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions.Council Member McNamara seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: NO Council Member Thompson: NO Council Member McNamara: YES Mayor Gubler voted YES as the tie breaker vote. Motion carried. Variance Application; Ellsworth & Associates, PLLC; Harvest Cove; a Variance relating to the length of the road allowed for permanent dead-end streets as stated in § 10-1- 17(B)(4) of the Iona City Code — Mayor Gubler asked if anyone representing Ellsworth & Associates or this development was in attendance. No response. Attorney Rawlings stated the Variance requested is related to the 400' depth of the dead end road that it would create. He continued and stated it is difficult to discuss a Variance request without the applicant present to answer questions and allow the Council to determine if they qualify. Attorney Rawlings then 5 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 19,2021 recommended tabling this agenda item until next month to have the applicant present. Mayor Gubler then asked if this development has a hardship that would qualify for a Variance. Attorney Rawlings stated that is hard to determine without additional information from the applicant. Council President Geray stated he would prefer to table this discussion and vote on the Variance request and the Preliminary Plat until next month. All in agreement. Gary French of 4983 E. Hansen Avenue approached the podium and stated he lives adjacent to this proposed subdivision. He stated his concern regarding the water system. He continued and stated his neighbor's water line comes from lona Road, but his water comes from Hansen Avenue and he always has low water pressure. He then asked if his neighbor sells his property to a neighboring developer, would they be allowed to put a road in through that property. Mrs. French then stated the private road there is not wide enough to create a public road. Mayor Gubler stated it would have to be a flag lot with an alleyway entrance. He continued and stated he has discussed the water lines there with Director Prouse and have discussed ideas on how to install the water line to create a continual loop, rather than allowing it to dead end as it does now. Mayor Gubler then discussed the importance of the Planning& Zoning Commission and the City Council to view these developments as they are presented to determine their effect on existing and future infrastructure. Preliminary Plat Application; Ellsworth & Associates; PLLC; Harvest Cove, a Subdivision located on the North side of Iona Road to the East of Elim Estates Subdivision— Council President Geray made a motion to table the Variance and Preliminary Plat Application for Ellsworth & Associates for Harvest Cove due to the absence of the applicable parties. Council Member Wadsworth seconded the motion.All in favor. Motion carried. General Water System Discussion —Mayor Gubler stated the new well was turned on today for the first time. Clerk West displayed a video of the water being turned on. Mayor Gubler then stated this water is full of sediment so it is being pumped to waste right now. But that will clear up the longer it runs and will be clean before they begin filling up the new tank. He continued and stated there will be a small BBQ to celebrate the completion of the project, but a date has not been set. STAFF REPORTS: Director Prouse reported a few instances where people have illegally connected to our fire hydrants. He continued and asked the Council to keep an eye out if they see this happening. Clerk West stated she has paid the deposit to have the network upgrade and digital recording completed for the City Building. She also stated there is a Meet the Candidate Night at the City Building on Saturday, October 23nd at 6:00pm. She continued and stated there are 4 candidates running for the two open City Council seats and the election will be held on Tuesday,November 2'4 Clerk West also reported there will be a City Halloween Carnival on Saturday, October 30th from 2:00pm-4:00pm. She continued and stated this is a family event and there will be something for everyone. Council Member Wadsworth stated his appreciation for the Council and everyone's ability to hold a professional conversation,even with differing opinions. 6 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 19, 2021 Council President Geray, Council Members Thompson and McNamara all stated nothing to report. Deputy Chris Williams stated they will begin targeted enforcement areas for speeding very shortly. Mayor Gubler then stated he gave Deputy Williams a list of items that needed to be addressed a few weeks ago and was very impressed with how quickly and efficiently everything was rectified.
