OCTOBER 8, 1962
INITIATION: The regular meeting of the City Council of the Cit:
of Temple City was called to order by Mayor Tyrell at 7 :30 P.M.
The Mayor then led the Pledge of Allegiance to the Flag.
INVOCATION: Invocation was given by Rev. Lyman. Ellis of St.
Paul's Methodist Church, El Monte & Freer, Temple City.
ROLL CALL:

APPROVAL OF MINUTES:
a. Regular Meeting of September 24, 1962.
Councilman Merritt moved to approve the minutes of the regular
meeting of September 24, 1962, as mailed, Councilman Fitzjohn
seconded and carried by the following roll call vote:

b. Adjourned Meeting of September 27, 1962.
City Manager Woollett corrected the last paragraph of page one
to 4 :30 P. M. instead of "4.00" P. M. Councilman Dickason mov-
ed to approve the minutes of the adjourned meeting of September
27, 1962, as corrected, Councilman Fitzjohn seconded, roll call
vote as follows:

At this time City Manager Woollett presented Mr. Hawkins, Prin-
cipal of Cloverly School, and Mr. McAlister, Director of Student
Activities at the High School, who were with a group of fifteen
students observing the Council Meeting. They were welcomed by
Mayor Tyrell in behalf of the Council.
6. ORDINANCE NO. 62 -90: 2nd read. Re- restriction of truck parking
on residential streets by adding maximum gross weight of three
tons. City Attorney Shatford read title to Ordinance No. 62 -90

7. PROPOSED INCREASE OF COSTS OF LAW ENFORCEMENT:
The City Manager stated at the present time we are awaiting thti;
transcript of the petition made by the County and by our Comm-
ittee on behalf of the Contract Cities before the Grand Jury.
We expect to make a presentation before the Board of Supervisors
on this subject.
8. ORDINANCE NO. 62 -88: 2nd read. Re -Zone change Case No. 62 -39,

9. REPORT ANNUAL AUDIT; City Treasurer.
City Treasurer Griesmeyer advised he had given a written report
to the Council as a result of the Finance Committee meeting
consisting of Deputy City Treasurer Lumsdon, Councilman Merritt,
Auditor File, and City Manager Woollett, City Treasurer Gries-
meyer, and Mr. Kiliem, C.P.A. representing Lawson & Co. who
conducted the annual audit. City Treasurer Griesmeyer advised
Lawson & Co. reported nothing detrimental, and complimented
the City on the way the books were maintained and method in
which they were kept. He also reported on the fund balances
at both the First Western Bank and the Security First National
bank for bbth active and inactive accounts with the City having
around $600,000.00 in the bank.
10. ORDINANCE NO. 62 -87: 2nd read. Re -to establish driveway width
and height clearance requirements for all zones permitting
apartment houses, particularly zone R -3. City Attorney Shat -
ford read title to Ordinance No. 62 -87 AN ORDINANCE OF THE CITY
OF TEMPLE CITY AMENDING THE MUNICIPAL CODE TO ESTABLISH DRIVE-
WAY W'I'DTH AND HEIGHT CLEARANCE REQUIREMENTS FOR ALL ZONES PER-
MITTING APARTMENT HOUSES AND IN PARTICULAR ZONE R -3. Council-

11. PUBLIC HEARING: 7 :45 P. M. Curb & Gutter East and West sides
of Farago Ave., 5000 to 5200 blocks

City Manager Wocllett advised this installation of curb and
gutter was requested by over 60% of the property owners. On the
east side of the street 62.44.% of a total footage of 115.5.9
the petition representing 721.90 lineal feet. Mayor Tyrell
asked if anyone present wished to speak for or against the in-
stallation. No one came forward. Councilman Fitzjohn moved to
close the Public Hearing, Councilman Nunamaker seconded, roll
call vote as follows:

Councilman Nunamaker moved to find the improvements in the gen-
eral interest of the public and to instruct the Superintendent
of Streets to cause the work to be done, Councilman Dickason
seconded, roll call vote as follows:

NOES: Councilmen -None

City Manager Woollett advised on the west side of Farago Ave.
68,9'4% of a total footage of 1155.98 ft. had petitioned for the
installation of curb and cutter representing 797.0 ft. Mayor
Tyrell asked if anyone wished to speak for or against this im-
provement. No one came forward. Councilman Dickason moved to
close the Public Hearing, Councilman Nunamaker seconded, roll
call vote as follows:

Councilman Merritt moved to Find the improvements in the general

12. PROPOSED REMOVAL OF TREES AT 6047 Hart Ave,, 9102 Hermosa Ave.
and 6163 Loma Ave.
City Manager Woollett advised this was held over from the last
meeting to give the Councilmen an opportunity to inspect the lo-
cations in question. He recommended that the Council instruct
the staff to go ahead with the necessary repairs, and if when
curbs and gutter and sidewalks are removed, if we find it is
still necessary to remove the trees that the staff be authorized
to do so, but only if at that time it is determined necessary to
remove them, Following discussion it was agreed that the trees
should not be removed unless after the curb and gutter were re-
moved it was determined it absolutely necessary to remove due to
the safety hazard as well as having to cut the roots so severely
as to ruin the tree. Councilman Nunamaker so moved, Councilman
Dickason seconded, roll call vote as follows:

The City Manager advised the Roadside Tree Superintendent was
making a survey of the City to indicate where we do not have
trees in presently. In order to give a complete report on this
with a step by step program and also recommendations, he request-
ed this be tabled, and Councilman Dickason so moved, Councilman
Merritt seconded, and carried.
13. ORDINANCE NO. 62 -86 -A. Amending legal description Annexation 44
West Temple City. 1st read.
The City Attorney advised there was a slight discrepancy in the
legal description which this Ordinance corrects. He then read
title to Ordinance No. 62 -36 -4, AN ORDINANCE OF THE CITY COUNCIL.

PUBLIC HEARING: 8:00 P. M. JOLLY COACHMAN, 151 E. LAS TUNAS DR,
TEMPLE CITY, HAL BROADHEAD , O!NER
City Manager Woollett read the petition received by the City
Council on July 26, 1962, and signed by 4= individuals, request
abatement of the nuisance arising due to the operation of the
tavern known as the Jolly Coachman at 9151 E. Las Tunas Dr.
owned and operated by Hal Broadhead. The petition stated due
to inadequate off street parking the operation prevents reason-
able ingress and egress by the residents, that excessive noise
both by automobiles and by persons, particularly late at night
disturbs the rest and sleep oF said residents, and that such
use and noise by the patrons of the Jolly Coachman is detrimen-
to to the use of the property and to the property values.
City Attorney Shatford advised the Council and audience that thi:
is a public hearing considering the revocation of licenses. 4heri
taking a license the applicant's license is subject to the right
of the City at any time to revoke under certain sections of law
oF this City. This Council is acting in a quasi jurisdictional
capacity and must put aside any personal feelings and hear what-
ever evidence there is pertaining to this particular license.
They must hear what the residents have to sat,', hear a report
from the Sheriff's Dept., and hear from the People in the audi-
ence and must determine whether Section 92 of Ordinance #5860
adopted by this City as a law, from the evidence presented is
sufFicient to revoke. The City has broad powers. The Mayor wi'
conduct the hearing as if he were a judge, first hear thos in
favor of revocation, and then the holder of the license will pre .
sent his case and the Mayor will then call for rebuttal. He
advised a license may be revoked on any one or more of the fol-
lowing grounds:
a Any facts exist upon which a denial of such license wou l d be
authorized,
b licensee or employee violates any law or statute regulating
the operation,
c the license obtained by Fraudulent misrepresentations
e licensee has conducted operation in an immoral or disorderly
manner,
i licensee is an unfit person to be entrusted with the privil-
- eces of the license.
Mayor Tyrell declared the 'ublic Hearing opened. He asked for
any in favor of the petition to step forward and address the
Council.

Morris L. Turner, 9144 Hermosa, spoke representing the property
owners in the area, and elaborated on the c.}mpl a i nt of the nui-
sance regarding inadequate parking, noise and litter late at
night, and intrusion on the privacy of the surrounding area,
well as immoral conduct of the patrons of the Jolly Coachman.
The following people spoke in favor of the petition for abate-
ment as well as some of them spoke in opposition to the kind of
entertainment specifically on Thursday nights as being below
standard:

Mayor Tyrell then asked to hear from those whc are opposing the
petition.

He advised that the day Fell-ming the presentation of the peti-
tion to the Council three de`inite chances were made, 1- Mr,
Broadhead hired a private police officer t patrol the parking'
lot, 2- as the back door cannot be locked due to fire regulation.
he placed a sign "For Fire Use Only" and is attempting to get
all ,patrons to use the front door when leaving the building,
3- retarding the Thursday nicht entertainment arovided by the
Stubb Bros., their program has been changed and up- graded and
if the City has any further suggestions to improve this factor
will be glad to comply. These are three definite changes for
the improvement re -the complaints made by the petitioners. He
also advised not one of the complainants to the best of their
knowledge have ever been inside this place, and no one has ever
complained to him directly. He advised when he was there he ob-
served the young college type of crowd, and did not see any bums
as inferred by the petitioners, and the patrons do not reflect
a vicious element.
Mr. Broadhead spoke in his own behalf advising he will make ary
chances the Council deems necessary. The r_ =uard he hired is for
the outside area to keep peace and quiet, and the entertainment
on Thursday nights has been up- graded, which night was the on;
one complaints were registered against with the exceptions of
the bus trips on Sundays who were noisy coming and going from
the area.
The following spoke in support of Mr. Broadhead and the Jolly
Coachman, several of whom resented very much the inference that
the patrons were of the lower and questionable class of people,.
Mike Dyer, 458 Vineyard Pl. Pasadena, Mrs. Lee Johnson 9045
Youngdale, Bob Halley, 4215 Camero, Los Angeles, David Stubbs,
475 S. Los Robles, Pasadena, and in addition Mr. Jim Harvey
of 6127 N, Kauffman, and Mr. Craig Shoemaker, f.,4J7 E. Olive, who
both stated they together with their wives were frequent patrons
and did not consider they were questionable characters and that
the patrons were a young college crowd, and found nothing wrong
with the entertainment. Mr. Vincent Fazio, °:.412 Las Tunas, owner
of the building, stated he could not see anything wrong with thi:
business and he had visited the place many times.

Rebuttal was called for by the Mayor and Mrs, Jos. W. Lang, x,133

Hermosa, Morris L. Turner, ('144 Hermosa, J. ..1. Cartwright, 9132
Hermosa, all spoke in favor of the petition.
Rebuttal for the Jolly Coachman and Mr. Broadhead was given by
Atty. Jackson, Mrs. Broadhead, 1808 S. First Ave,, Arcadia.
Councilmen Nunamaker moved tc.close the public hearing, Council-
man Merritt seconded, and carried.
The Mayor requested Lt. Baker of the Sheriffs Dept.to report re-
cardinc complaints now and before the chances listed above were
made. Lt. Baker advised For the past three weeks they had prac-
tically no complaints at all whereas previously they had been
called numerous times by the property owners adjoining. He ad-
vised that at the Council's request an investic'ation was initial.

in checking did not find anything comparable to previous report.
Also in checking with the District Attorney in 'asadena who
went over the notes of their report he refused to issue a com-
plaint as he felt the case could not be successrul'ly prosecuted.
City Attorney Shatford again admonished the Council regarding
their position in not considering their personal Feelings but
just the faces, and he stressed that they must be Facts and not
heresay or supposition to hold up in Court. Hz further advised

Councilman Nunamaker moved that the request for revocation of
licenses be denied because of lack of proper evidence that will
stand up in Court of Law but from a nuisance angle it will be
watched closely and if it reverts back to the cause of com -, -
plaints it will be taken up immediately, Councilman Merritt se-

15. ESTABLISHMENT OF ONE -WAY ALLEYS NORTH AND SOUTH OF LAS TUNAS DR, .
Geo. Envall, Traffic Engineer, reported on the recommendation
for the establishment of one -way alleys on the north and south
side of Las Tunas Or., following about a year of consideration
and study by the Traffic Commission who recommend very strongly
the Council approval of these safety measures. This would make
alleys north of Las Tunas from Oak Ave. to Kauffman east- bound,
and the alleys south of Las Tunas Dr. from Golden West to Clover
ly west - bound. Georgia Maxey, Chairman of the Traffic Commis-
sion, spoke in favor of this recommendation, as well as Ray
470 Livia, H. Dobert, 5841 Golden `rest, and Mrs. Geo,
Tercet, Johnston, 6000 N. Rowland Ave. Following discussion Councilman
Nunamaker moved to accept the recommendations of the Traffic
Commission for one way alleys as of January 2, 1963, and i.nstruc
the City Attorney to prepare such an ordinance. Councilman

17. APPROVE SPECIFICATIONS FOR STORM DRAIN BOND ISSUE #521 SOUTH
APCA1)iA, City Manager'WoolLett advised this was one of four
storm drain bond projects going in in this area, this one
pertaining; to Double Drive, and the plans and specifications
have ben approved by the Flood Control,County Engineer, Road
Dept., and the recommendation is that this Council approve these
plans and specifications for storm drain bond issue #521, South
Arcadia, and authorize Los Angeles County Flood Control District
to proceed. Councilman Nunamaker moved to approve plans and
specifications For storm drain bond issue #521, South Arcadia,
and to authorize the Los Angeles County Flood Control District
to proceed with the construction as described therein and to

BLANKET POSITION BOND FOR CITY EMPLOYEES:
City Manager Woollett recommended the City purchase a blanker.

City Treas. This can be accomplished for small additional cost.

TRAFFIC COMMISSION RECOMMENDATIONS:

Traffic Engineer Envall presented the proposal regarding the

22. RESOLUTION NO. 62 -242: 1962 -63 BUDGET REVISION #1.
City Manager Woollett explained this was necessary to permit the
purchase and payment of the American Legion property, and that
the money allocated in last years budget for this was not used
and as a result this year's budget will have to be increased by
that amount. Councilman Fitzjohn moved to ap,rove Resolution
No. 62 -242, Councilman Nunamaker seconded, roll call vote as
follows:

24. COMMUNICATIONS:
a. SAN GABRIEL VALLEY HUMANE SOCIETY
The City Manager advised the S. G. Valley Humane Society had
advised him the 24 hr. answering service has been installed.
They advised a representative from Temple City would be welcome
at the Board meetings as an ex officio member to speak for
Temole City in any matter in which this City is concerned.
Following discussion Councilman Fitzjohn moved that Karl Koski,
Administrative Assistant be designated as the representative
from Temple City, Councilman Merritt seconded, and carried.
b. The City Manager read a letter from the Temple City - Rosemead
Council of United Church Women requesting a permit to solicit
funds for UNICEF on October 31, 1562, in our City. Following
discussion Councilman Merritt moved to table until further in-
formation was available, and suggested Mrs. ' aller appear before
the next meeting of the Council on October 22, Councilman Fitz -
John seconded and carried.

26. MATTERS FROM CITY OFFICIALS:
Councilman Dickason asked the City Attorney regarding the status
of the Kauffman Ave. problem. City Attorney Thetford advised
he is getting all the correct names from the Title Co. and as
soon as received he can file the complaints, possibly next week.
Councilman Dickason brought before the Council observations of
United Nations Day, and made a motion that our Mayor observe the
request he received in respect to observance eF United Nations
Day. The motion died for lack of a second.
City M.:nager Woollett read a request from the Santa Anita Girl
Scouts Council for a charitable solicitation permit to sell the°
calenders on Nov. 9 through. Dec. 6. Councilman Merritt moved
to grant, Councilman Fitzjohn seconded, and carried.
The City Manager asked for a clarification of the over -night
parking' problem due to the many complaints from citizens regard-
ing enforcement. This is st i l l being studied by the Traffic
Commission and they will submit a recommendation in the near
future. Following considerable discussion it was agreed to do
nothing until recommendations are forthcoming from the Commissic
