Transcript of the Proceedings of a Meetint;
held August 14, 1946 for
Incorporation of a Town to be Known as
PAL HARbQP VI1d.AGE
Pursuant to the notice hereto attached, a meeting was called to order on
the 14th day of August, A. D., 1946, at the hour of eight o'clock P. M., in
what 0 known as the Administration bui:dine located on the property herein-
after described, for the purpose of or;an'zint; a mur:lnipal government for the
territory described in the said notice.
On motion, duly made, seconded and carried, 0. J010 505TA IAIANP was elec-
ted to serve as Chairman of the meeting and w. A. vYET to serve 6s Clerk of the
meeting.
The Chairman and the Clerk assumed '.heir renj ective duties and the Chairmar.

The Clerk of the meeting submitted a list of tho male registered voters re-
siaing within the territorial limits of Ve prop sed municipality, certified by
the Supervisor of Registrations for Dade County cn the 12th da;, of Auquot, 1946,
showing that there reside in that territory thirty -four registered male voters.
The Chairman then stated that it was necessary to have present at this meet-
ing two - thirds of the registered male voters residing Within the proposed cor-
porate limits. Upon, roll call of the registered voters residing within the pro-
posed corrorate limits. At was found thet there were present twenty- ei..;ht of
such registered male voters, constituting wove th:.n wo-- thirds of the qualified
male electors; and the Chairman declared tnat thy meeting was qualified to pro-
ceed with the business for which it was called.
The Chairman requested the Clerk to read to the assembly the notice calling
the meeting, and the Clerk th.ronron read the nu ;i e, as follows:

PROPOSED INCORRPORATION OF TOWN
TO WHOM IT MAY CONCERN:
Take notice that on the 14th day of August, A.D. 1946, at the hour
of 8:00 o'clock P. M. in that is known as the Administration Building,
located on the property hereinafter described, there will be an assembling
and meeting of all persons who are registered voters in Dade County, State
of Florida, residing in the territory in Dade County, Florida, embraced
within the following described boundaries, to wit.:

Beginning at the intersection of the center line of 96th
Street in the Town of Surfside, Florida, or the South line
of Section 26, Township 52 South, Range 42 East, Dade
County, Florida, with the westerly line of Harding Avenue
(in said Town of Surfside) produced northerly as same Is
shown on a plat entitled "Near. Front Section of Hay har-
bor" as recorded in Flat book 44, Page 17, of the Public
Records of Dade County, Florida, run in a westerly direc-
tion along the southerly line of said Section S6 a distance
of 1269.4 feet to he westerly facer of a eGncrete bulkhead,
Thence, continue westerly along, '.He sou" lint of said Sec-
tion 26 a distance of 150 feet plus or minus tw the center
line of Indian Creek,
Thence, run in a northwesterly direction deflecting 79 degrees
to the right from the south lire of sold Section 16 alonk the
approximate center line of Indian. Creek a distance of 4600 feet
plus or minus to the southerly line of the Baker's HaKover
District property,
Thence, run easterly along, the southerly line of the Baker"•;

above described tract of land and to 8,lect a name for the proposed town.

went , and to do such other acts and deeds as may be necessary and proper
for the establishment of a town gov crnment, as provided in Sections 165.61 -
165.04, Florida Statutes, 1941.

The Chairman then announced that the next business before the meeting was
the question of whether or not the territory described in the notice of the
meeting should be incorporated into a muninipality. Thereupon, Mr. Glenn E.
Massnick presented the following motions

this meeting, which notice has just been read by the Clerk of
the meeting, be incorporated into a twn ur:der the laws of the.
State of Florida."

The Chairman, then announced that the motion had beer carried unani.mously,

The Chairman stated that the next buninpas before the: meetinz was the
ado�.tion of a name !,'or 1,he municipality. Thereupon, Mr. Charles R. Graham
moved that the name of the town i:e "hAv, H ^RbOUF VI1 :1GE"; and this motion was
seconded by Mr. Robert 'l..ill, and upon a vote was unanimously carried.

tion of a corporate seal for the mur.icipaliLy, and on motion of Mr. George
Whittaker, seconded by Mr. Herold T. Dickey. '.ho followin mnt on we.s unani-

"The Corporate seal of the municipality of BAL HARECUR
VIUAGE shall be as follows:
A round seal with the words 'Hal Herbour Village'
arranged in a semi - circle in the upper portion;
the words, 'Dade County, Florida' arranged in a
semi - circle in the lower portion; and the: words
and figures 'Incorporated 1946' in a wirole within
the outer circle, and the word. 'Seal' in the center."
The Chairman announced that the next business before the meetinE, was the
election of the following officers to msinl.sin and operate the municipal govern-
ment: A Mayor, a Town Clerk, a Town Marshalt, and nun less than five and not
more than nice Aldermen.
On motion of Mr. Ray Semmes, Jr., seconded by Mr. John L. Whitlock, Jr.,
it was unani-mously voted that the number of .Aldermen Shall be five.
The Chairman than announned that nominations were in order for the various
offices. Thereupon, Mr. Ueorge Melvin nominated J. JULIEN SOUTHERLAND far the
office of Mayor, MISS MARY WLTTE;RFR f.,r the office of Clerk, and HfROD 'i'. DICKEY
for the o.'rice or M:,rshal, and the following far the office of Alderman:

These nominations were seconded by Mr. Paul Black. The Chairman called for ft -
ther nominations, but none were made. A motion was then made by Mr. John +'o„an
and seconded by Mr. Robert Morard and carried that the nominations be closed.
Thereupon, the Chairman salted for a vote on the que.ation, following which twerit..-
ei,,ht votes were cast in favor of each of the nominees named, that bei.n; ev * ?ry
qualified vote that could be cast at the meeting.

MINUTES OF THE FIRST METING OF THE COUNCIL
AUGUST 15, 1946
The first meeting of the c -uncil of Sal Harbour Village was held in the
"Administration Building" in the Village at eight o'clock P. M. on Thursday,
the 144 day of Auju;t, 1046.
There were present in person: J, Julien ,^,outheriand, Mayor; ^,hsrles R.
::raham, Glenn E. Massni ;k, Willard H. Webb, Geor;e M, Whittaker and Ray Semmes,
Jr., beint= the Aldermen of the Town and constituting the full membership of the
Village founcil; M.ry 'Wetterer, "own Clerk; and Jerold T. Dickey, Town Marshal.
The Mayor and the Town ",lerk reported that pursuant to 3wcti 3 161.01 and
164.07 of the Florida Statutes of lg4l, a nomwiete record of the meeting held by
the registered voters within Bal Harbour Village an the 14th data of .Auk =ust, 1 «;.h
at eight o'clock P. M., signed by the Mavo r, the five Aldeenaen and the Town Cleric,
have been recorded in the office of the Clerk of the Circuit Court of Dade
County, Florida, and this having- been done under &action 165.08, Fl.)r la Statute:.r,
>41, a municipality known as Hal Harbour Village 0 now a body corporate with
full power of a Town under the laws of the State cf F'_oriiv.
The Mayor then reporwed that he had duly taken the oath of office provided
for in Section 169.06 Florida Statutes 1941 and that he would now administer to
the Aldermen and other of 0v ers- elect, a like oath of office; and thereupon each
of the Aldermen and the Town Marshal ;_nd the Town Clerk took the oath of office
prescribed by Section 165.00 Florids Statate:a 1041, and on motion of Hr. Chnrles
R. Graham, seconded by Mr. Glenn E. Massnick, nil of the said oaths of office
were ordered to be attacbod to hnd mad.; a part of the minutes of this meeting.
The Mayor then stated to the meeting that the Town Council having been
organized, the next business before the meeting would be to elect one of the mem-
bers as president of the Council; and thereupon, on motion of Mr. Msssnick,
seconded by Mr. Semmes, Mr, wi.11ard H. 'Hebb was elected President of the Council.
Mr. Webb then assumed the Chair as President of the Council, and snnornced that
all the preliminaries having been complied with according to law, and all mem-
bers of the Council being, present., he Coun,til was qualified to proceed with
6he business of the Village and would be now officially convene}.
It. was pointed out to the meeting that by Section 165.05 Florida Statutes
1941, it is provided that the Aldermen, members of the Council, shall hold office
for two yearo, but that at their first me='.i.ug they shall by lot divide their
body into two classes, as nearly equal in number as possible, one of which shall
hold office for two years and the other fur one ,year. Thereupon, on motion of
Mr. Graham, seconded by Mr. Whittaker, it wns voted that as there were an odd
number of councilmen three of them serve for two years and two of them for one
year, and that the members of the Council proceed by lot to determine the length
of their terms. Five slips of paper, three .:umbered "two" and two numbered "one"
were then placed in a hat, and each of the councilmen drew one of the slips, the
result of which drawing showed that the five Councilmen should servo for the
following periods:

On motion of Mr. Massnick, seconded by Mr. Whittaker, it was voted that
the result of the drawing by lot be confirmed and that Alderman Graham, Whit-
taker and Massnick would serve for two years and Alderman Webb and Semmes
for one year.

and made a part of the minutes of this meeting.
The President stated that the neat order of business was the consider-
ation of Resolution No. I which would create certain offices for the Vil-
lage, etc, The resolution numbered "I" was read to the meeting are+ an motion
of Mr. Whittaker, seconded by Mr. Graham the resolution was adopted as
Resolution No. 1 of the Village entitled:

Mr. Graham voin:ed out that it would be necessary for the Town Mar -

thereupon, on motion of Mr, =ex res, seconded by Mr. Whittaker, the fol-

On motion of Mr, 'Whittaker, seconder', by Mr. Graham, it was voted that
the Town. Clerk shall also act as tax assessor and tax collector.
On motion of Mr. Mnssnick, seconded by Mr. Graham, Mr, Willard H. Webb
was designated to act as building inspector for the Village_.
There was presented t.; the meeting for consideration a plat of the
RESIDENTIAL SECTION OF BAL HARBOUR prepared by Zurwelle- Whittaker, Inc.,
and dated July 29, 1946, which divides into lots and blocks certain parts
of the municipality between Collins Avenue `,Bel KrUcur Boulevard? and

the seawall on the west of the Village and between the southern and north-
ern boundaries of the Village; after discussion, upon motion of Mr. Mnss-
nick, seconded by Mr. Charles R. Graham, the following resolution was
adopted:

hereby approves the plat entitled "Residential Section of
BPI ilarbour" as prepared by Zurwelle- Whittaker. Inc. and bear-
ing date July 29, 1946, which plat. is .o be recorded in t.h<.

Town Clerk.
Mr. Scutherland, as attorney for the Village, presented to the Coun-
cil a Proposed Ordinance No, I establishing the municipal court and re-
latinq in detail to the procedure therein and to the punishment of of-
fanses against the Village. The prorased ordinance was reed section b
section, and after dispassion nra nonaiderstion, on motion of Mr. Massnick,
seconded by Mr. Whittaker, the said -dinance No. I entitled:

was unanimously adopted.
The Village Attorney, presented to the Council proposed Ordinance
No. 1. which was designated to define offenses against the Village and to
provide for punishments and fines and to make certsin provisions for evi-
dence in the Vilbge Court and to regulate searches and seizures, to pres-
cribe traffic regulations and to provide for mechanical inspection of
mctor vehicles. They proposed ordinance was read section by section, and
zfter discussion it waa voted to delete the sections with reysrd to the
motor vehicle inspection and on motion of Mc. Graham, sec.,rdnd by Mr.
Sammo:;: the said Ordinance No. 2 entitled:

DEVOE IN THE MUNICIPAL. COURT, hr,OULATING
GEARCHES AND SEIZURES, TRAFFIC REGULATIONS"
was unanimously adopted.
The Village Attorney presented to the Council proposed Ordinance No, ,
�hlch provides %a' the adoption of builaing, electrical and plumbing codes
for the Village and for licenses by reciprocity for contractors and sub-
contractors and for bonds and insurance by each contractor. The ordinance
was read section by Section, and after discussion and consideration, on
:notion of Mr. Semmes, seconded by Mr. Whittaker, the said Ordinance No. 3
