HomeMy Public PortalAboutCity Council_Ordinance No. 04-892_ 5th Amendment to Redevelopment Plan for Rosemead Blvd Redevelopment Area_1/20/2004_Regular1 ORDINANCE NO. 04-892 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING THE FIFTH AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE ROSEMEAD BOULEVARD REDEVELOPMENT AREA WHEREAS, the City Council of the City of Temple City is committed to achieving the goals of the Temple City Redevelopment Agency (AGENCY), including those goals related to eliminating blight, encouraging economic development, and improving the variety of businesses located within the City of Temple City as a whole and the Rosemead Boulevard Redevelopment Project Area (PROJECT AREA) specifically; and, WHEREAS, the AGENCY is one of the most effective tools available to the City Council to attract new businesses to town by overcoming economic and physical barriers to desirable business entry; and, WHEREAS, pursuant to Section 33457.1 of the California Health and Safety Code (CODE), the City Council does hereby reconfirm the following findings to the extent warranted: (1) The carrying out of the redevelopment plan would promote the public peace, health, safety, and welfare of the community and would effectuate the purposes and policies as outlined in Section 33000 et seq. of the CODE; and, (2) The condemnation of real property, if provided for in the Redevelopment Plan for the Rosemead Boulevard Redevelopment Project Area (PLAN), is necessary to the execution of the PLAN and adequate provisions have been made for payment for property to be acquired as provided by law; and, (3) The AGENCY has a feasible method or plan for the relocation of families and persons displaced from the PROJECT AREA, if the redevelopment plan may result in the temporary or permanent displacement of any occupants of housing facilities in the PROJECT AREA. WHEREAS, at the time of the adoption of the PLAN the AGENCY had the power . of eminent domain and retained the power until it lapsed on January 16, 1999; and, WHEREAS, the AGENCY desires to restore the power of eminent domain until the current date of expiration of the PLAN, June 15, 2012; and, WHEREAS, based upon information provided by staff related to current land uses within the PROJECT AREA, the City Council does hereby conclude that there are not a substantial number of low- and moderate income persons residing within the PROJECT AREA; and, WHEREAS, based upon the fact that the great majority of parcels within the PROJECT AREA are zoned Commercial, the prospect of any additional residential dwellings, including dwellings for low- and moderate income persons, being constructed without the assistance of the AGENCY and /or the City of Temple City is highly unlikely. NOW, THEREFORE, the City Council of the City of Temple City does hereby ordain as follows: The Redevelopment Plan for the Rosemead Boulevard Redevelopment Project Area is hereby amended to add at Section 403 the following paragraph: "The power of eminent domain is restored to the AGENCY and may be exercised until the current date of expiration of the PLAN, June 15, 2012."
