HomeMy Public PortalAbout19900111CCMeeting1 1 Tybee Island, Georgia January 11, 1990 The City of Tybee Island held its regular monthly City Council meeting on Thursday, January 11, 1990 at 7:30 p.m. at Tybee City Hall. Mayor Charles J. Hosti presided and the following members of Council were present: Paul Jackson, Jeff Dukes, Jimmy Brown, Bill Walsh, Jack Youmans and Pat Locklear. City Attorney Tom Mahoney was also present. The meeting was opened by the Mayor. The Pledge of Allegiance to the flag was led by Councilman Brown. Councilman Locklear led the Invocation. The public hearings portion of the meeting was introduced by Mayor Hosti. The first petition was that of Dick Smith who wants to develop a single- family planned unit development on 1.6 acres on Pulaski Avenue in Fort Screven. Mr. Smith spoke for his project by saying that he is asking the city to place his development under all the restrictions and covenants that are normally reserved for 10 acres or more. He intends to build a single family subdivision with covenants. The lot values will be $85- 90,000 each. He said that it is his belief that no buffer zone is necessary since the adjoining property is occupied by a like use - residential. He said the street leading into the project is private, and that a 10' pedestrian access easement to the beach will be granted. It was noted that public works wants to be sure storm drainage is adequate. Councilman Youmans questioned whether the covenants guarantee single family occupancy only. Mr. Smith's answer was affirmative. Councilman Dukes informed the group that Mr. Carl Thompson, who has been un- official spokesman for the neighbors, called to say that the project will be acceptable to the neighborhood provided it is single family. He noted that from the city's point of view PUD may be the most desirable zoning since it gives the city controls at several stages of development. The planning commission vote was 7 - 0 in favor of the project, but the law requires 10 acres. Therefore the planning commission's recommendation is for a text change: a one - sentence modification "should include single family PUD on one acre or more" to be inserted into the definition of PUD in the Code. Burt Barrett, Jr. spoke in favor of the developer saying that the planning commission voted for the sketch plan presented giving the impression that the proposed plat would be accepted, and causing the developer to go to additional expense through engineering and attorney fees. He said he'd like to see the project pass. 1 Tybee Island, Georgia January 11, 1990 Page Two John O'Neill spoke to ask if the project couldn't be approved contingent upon the text amendment passing. No one spoke against the project. Dick Smith spoke again, saying that he did seek the advice of the planning commission prior at a pre - application conference. He asked if he could reserve the right to withdraw and resubmit the plan if the Council is going to consider the change. He said his engineer and attorney are both present and willing to speak to any issue the Council wishes. He said he has an option contract on the property which has already expired and is under extension now. The next petition was from Jay Kaminsky, represented by Judy O'Neill. She explained that the plan is to divide the property in half. Since the property borders Alley No. Two, there is good access, and no variances are needed. Councilman Youmans said that there is more than enough land for two lots. No one else spoke, either for or against. The next petition was that of Sea Side Colony for its final plat approval. Extra copies of the covenants were brought since some members of Council have not received copies in the past. Dave Cornelius of 9 Palmwood Drive spoke in favor of the project, with one reservation: a storm drain problem. It was discussed and he was told that the problem of the pile of sand that is impeding the flow of water now will be removed as soon as a final water tap connection is completed. The developer, Steve McCusker, says that the engineering of the project includes drainage not just for the project but for all adjacent lots as well, and that the pile of sand can be removed in a few minutes by a backhoe. Bill Shearouse, a neighbor from 9 -B Oceanview Court, spoke in favor of the development. Jim Kluttz, member of the planning commission, said that it was unanimous in its recommendation that the covenants be recorded with the final plat. A minor subdivision, or recombination, for Sheley /Jackson, on Alger Avenue in Fort Screven. It was explained that the property had been divided into three lots, but a change in family situation has led to the desire to resubdivide the property from three back to two lots. A plat was drawn up, with a line that would allow each existing house to sit squarely within its own lot. The planning commission recommended approval of the plat. There was no comment, pro or con, from the public. 1 1 Tybee Island, Georgia January 11, 1990 Page Three A height variance for Dr. Downing on Chatham Avenue was next discussed. Dr. Downing spoke for himself and his family, saying that they own one of the original Tybee cottages, and that the integrity of the original home has been maintained, even to the expense of extensive interior changes to bring the building to hurricane code standards without affecting the appearance of the exterior. A 5' height variance is being sought so that a bathroom and bedroom may be added to accommodate a family that is growing up, and needs more privacy. He said that an architect and an engineer were consulted and that this plan is the one advocated as offering the best solution to the problem of providing additional space without affecting the integrity of the historical structure. He said that the objections raised at the planning commission by Fire Commissioner Youmans about the department's ability to fight fire at the higher level has led him to offer to put in a sprinkler system in recognition of the increased fire hazard. He informed the group that the lot is large enough to build out toward the river or back toward the street, but that these solutions would affect his neighbors' views and would not be as beneficial to the neighborhood as his pro- posed plan. He said that the house is not now visible from Chatham Avenue. Councilman Youmans announced that Dr. Downing has his support since his offer of the sprinkler system was made. Councilman Brown requested that the plans include the words "to be sprinkled ". Dr. Downing agreed. Margaret Wylly, a neighbor, professed her delight. Jean Davis, a planning commission member, said her only reason for opposing originally had been the fire hazard and that doubt has been removed. It was noted that the vote of the planning commission was for approval by a vote of 4 - 3. Dottie Kluttz spoke about the north beach concessions, giving history of the concession stand, and presenting the City Council copies of a petition signed by those who wish to oppose a commercial operation at the location. She said the majority of the people in the area want the building torn down, seeing no need for the concession stand, which has never been a successful enterprise. Dick Grosse spoke to remind Council of a copy of an attorney's opinion that the building is illegal. He said that if the city wanted to rent it, the fair thing would be to see that the rentor paid the equivalent of what other business people have to pay - about $12,000. per year in rent. Burt Barrett, Jr. spoke in favor of keeping the stand, saying that he has been a patron, buying hot dogs and cokes there. 1 1 1 Tybee Island, Georgia January 11, 1990 Page Four Chris Solomon spoke to contradict some of the history that Mrs. Kluttz had provided, saying that he helped build the little building when Buddy Blair was working with the city in 1967 or 1968 and that it predates the zoning. He also spoke to Council about the intersection of Campbell and U S 80, saying it is a dangerous intersection and should have a traffic light. Mayor Hosti told him that a count will be made in the spring in preparation for proving that a light is needed there. DOT has already been asked to make this count on St. Patrick's Day weekend, or Easter, when the city can expect heavy visit- ation from beachgoers. Charles Usher spoke in favor of some kind of development on the north end of the island, citing the great attraction provided by the Lighthouse- Museum. He said he'd like to see an oyster bar or fishing pier on the north end so that taxes won't jump again by 50% because the people just can't stand this kind of increase and the only way to prevent it is to allow enough development to support local businesses. He said he personally has no financial interest in anything on the island, being a retired physician. Jeanne Hutton said that grandfathering of zoning ends when a business isn't occupied (answering Chris Solomon's comments about the concession stand at the north beach) and that the City Council took an oath to uphold the laws of the town, including the zoning law. Thelma Peterson spoke to say she lives on the north beach and thinks commercial uses are not appropriate and that she would expect a concession stand could easily become a night club. Mayor Hosti stated that he would be dead set against that kind of develop- ment on the north beach. Marjorie Harris said everyone seems to be forgetting that the area is a National Historic District and needs to be maintained as a part of the National Register of Historic Places. The people in Fort Screven have fought hard for that designation and it is one of the island's chief tourist attractions, and therefore valuable from that standpoint as well. Dave Cornelius spoke as a northender who signed the petition, saying he would suggest as an alternative that the organization that operates the museum could operate concessions during museum hours. He said commercial interests at North Beach won't help our taxes - we need to fight for economic prosperity 1 Tybee Island, Georgia January 11, 1990 Page Five in Savannah. Industrial health in Savannah, not a hot dog stand on North Beach, will reduce our taxes. Terry Buttimer of 50 Railroad Avenue complained about his street address on Solomon Avenue, saying that the street sign had been changed with no noti- fication to the owners. He said the city faces another liability due to the lack of storm drainage. After recent rains, children could easily drown in the ditches along Solomon. Mayor Hosti said he'd talked to the developer of Marsh Winds Subdivision, Roy Rowell, and that the water pipe is being moved. He said Mr. Rowell is responsible and not the taxpayers. He said it will take several days to relocate the electric and phone cables and move the pipe. Then he believes the work will be finished quickly. Councilman Youmans said he'd spoken to Mr. Solomon and to Mr. Rowell and that the bad weather has held the job up. Councilman Youmans then spoke of the north beach concessions saying that the actual zoning designation for the land in question is "Public Parks /Conser- vation District ". Palma Mateeive spoke to thank the city for grading Solomon Avenue and for picking up the large number of dumped items along the street. The meeting was opened for business legally presented. Councilman Dukes moved that the City Council declare itself in favor of acting on the Planning Commission's recommended zoning text amendment after properly advertising same. Councilman Youmans seconded. The vote was unanimous in favor. It was noted that a representative of the news media was in the audience, and is therefore aware of the special meeting called for the purpose. Mr. Smith indicated his intention of asking for consideration of his zoning request at the same time that the amendment is considered. The Kaminsky subdivision, a minor one with no access problems, was next approved unanimously. The motion was made by Councilman Youmans with Councilman Brown seconding. Seaside Colony's final plat was considered with Councilman Dukes moving its acceptance. Councilman Locklear seconded and the vote was unanimous. The Sheley /Jackson resubdivision or recombination was next. Councilman Youmans moved its approval, Councilman Brown seconded and the vote was unanimous in favor. 1 Tybee Island, Georgia January 11, 1990 Page Six Dr. Downing's petition for a height variance for his Chatham Avenue home was approved with the addition of the words, "with sprinklers ", on motion of Councilman Youmans, seconded by Councilman Locklear. The vote was unanimous in favor. Councilman Locklear read a suggested set of stringent rules for rental agreement for concessions at North Beach. Councilman Dukes moved that the City Council request and encourage the Tybee Historical Society to provide refreshments through vending machines for the area and that further action be delayed until the October meeting. Councilman Jackson seconded. Council- man Youmans said he hated to delay action since it would affect the opening of any other concessions stand. Councilman Locklear said the museum board is lukewarm about the project and wants to study it, and that the stringent lease needs to be adopted. Councilman Jackson offered an amendment that the rental agreement be accepted and Councilman Brown seconded the amendment with the understanding that any further action would have to come back to Council. The vote was 5 - 1 on the amendment, which passed with the only dissenting vote cast by Councilman Walsh who favors removing the concessions building. Mayor Hosti said he'd like to see the historical society or another nonprofit group take over the concessions. The main motion failed by a vote of 2 (Dukes and Jackson) to 4 (Locklear, Youmans, Walsh & Brown). City Attorney Mahoney took under advisement the question of whether the amendment, standing on its own merits, is still valid, or whether it failed when the main motion failed. His immediate opinion is that the amendment, establishing guidelines, would stand. Councilman Youmans moved to accept rental rules so bids can be taken in near future. Councilman Brown seconded. City Attorney Mahoney questioned whether bids can be taken if there is doubt concerning an acceptable rent fee. Councilman Dukes remarked that it is not, in his opinion, a duty of the City Council to act solely for the benefit of one to make a profit, saying that Council should never impede business but he doesn't believe that this should be the primary motivation here. The vote was 4 (Locklear, Brown, Youmans and Jackson) for and two (Dukes and Walsh) against. Councilman Walsh says he believes the building is illegal and should be removed, so moving. The motion died for lack of a second. 1 1 1 Tybee Island, Georgia January 11,1990 Page Seven Bills for the month of December, 1989 were approved as follows: Water /Sewer $10,557.75 General Government $10,810.81 Police $29,924.62 Police Commissioner Brown noted that $22,611.00 was for housing of prisoners by Chatham County 1 /1- 9/30 -89. DPW /Sanitation Fire /lst Responder $21,445.13 $10,513.65 Fire Commissioner Youmans ex- plained that $8,000 is for architectural plans for fire station renovation to which city was committed before he became Fire Commissioner. He said that he doesn't like paying for a % of gasoline; prefers actual usage be charged. Parking Services $ 1,609.46 Recreation $ 1,582.36 Lifeguards $ 54.20 Mayor Hosti spoke about the high cost of housing prisoners, saying that in future arraignments will be prompt and extra effort will be made not to incur high costs for prisoner housing. Minutes for the December meetings of the 14th & 20th were approved unanimously on motion of Councilman Walsh, seconded by Councilman Dukes. The resignation of John Hutton as chairman of the planning commission was read and Councilman Dukes moved that the highest possible commendation the city can give be awarded to Mr. Hutton for his excellent service. Council- man Brown seconded and the vote was unanimous. Appointments were announced increasing the number of members on the Recreation Board with the purpose of allowing three committees: Adult sports, Children's Sports, and Leisure Services. The new appointments are Bob Pratt and Tony Voight. Two additional spaces on this board remain. Mayor Hosti recommended Bob Adkins for the vacancy on the Planning Commission. He said Mr. Adkins has been a resident for a number of years but has no particu- lar ties to any group. Councilman Youmans nominated John O'Neill, saying that Mr. O'Neill has a realtor's license but is employed in public relations, and that his knowledge is needed on the planning commission. Councilman Walsh nominated Leon Case. Mayor Hosti said he wished there were room for all three. 1 1 Tybee Island, Georgia January 11, 1990 Page tight Methods of voting were discussed and the city attorney ruled that it will take two votes, each Council member voting for only one person at a time, since the concensus seemed to be against a written ballot. The first vote was taken, resulting as follows: For Bob Adkins - Councilman Dukes For John O'Neill - Councilmembers Youmans, Brown and Jackson For Leon Case - Councilmembers Locklear and Walsh The City Attorney then declared that there must be another vote between Messrs. Case and O'Neill. This vote resulted in a tie which the Mayor broke appointing Leon Case to the planning commission. Mayor Hosti announced that he is forming the following committees, and Chairmen for each: School Property - Councilman Dukes Property Evaluations & Taxes - Councilman Locklear Fishing Pier /Pavilion - Councilman Jackson Councilman Brown reported that the police committee met on January 9th, and talked about the city's various security systems. A report, after looking over system with experts, will be brought back to the Council, probably in February. The community service workers from police court may be only a cause for inconvenience and overtime costs, and this will be discussed with the City Attorney and the Recorder. The police committee also decided to ask M.P.s, medics and lifeguards from the military to do weekend duty on the beach this summer. Councilman Dukes reported for the General Government /Finance committee that he has interviewed all City Hall staff, and has met with a representative of the Fair Labor Standards Board, Mr. John Dudash. There is a possibility that a written policy may be formulated to deal with overtime and compensatory time. He announced that the audit bids are in, and will be examined Friday. Water /Sewer, according to Councilman Jackson, has experienced two emer- gency problems recently. Failure of a pump at #6 lift station will necessitate an expenditure of about $4,000.00 but must be done since this is the main sewer lift station. Also, a sewer line collapse near llth Street and under U. S. 80 must be repaired at once. The low bid is from I AM Construction Company, and is in excess of $18,000. He recommended these emergency repairs be made at once, and Councilman Walsh seconded. The vote was unanimous in favor. 1 Tybee Island, Georgia January 11, 1990 Page Nine Councilman Jackson also mentioned that a draft of a fee schedule for sewer stubs modeled after the City of Savannah's has been agreed to by the committee. Councilman Youmans objected, saying that the committee has not actually met. Mayor Hosti asked Councilman Jackson to get the committee to- gether to act on this as soon as possible. Councilman Locklear made a short report on plans for the lifeguards for the summer season, using the same head lifeguard, a teacher, who held the position last season. Code Section 4- 4 -28B, about dogs running loose, was ready by Councilman Brown. He explained that this section was changed in the December meeting, but that the wording wasn't adequate, so an additional change has been made to make sure the ordinance is clear. He moved adoption; Councilman Dukes seconded and the vote was unanimous in favor. A second reading followed at once, with motion as before by Councilman Brown, seconded by Councilman Youmans and unanimously approved. The ordinance is attached to, and becomes a part of, these minutes. A revocable license for a dune crossover structure for Seaside Colony was approved on motion by Councilman Youmans, seconded by Councilman Walsh. It was noted during discussion that the state has approved both the design and the location of the structure, and that the license from the city indemnifies the city from liability and gives the city the right to have the structure moved upon request, if necessary. Mayor Hosti announced that he has appointed Pat Locklear to act as liaison from the City Council to the Tybee Council of the Savannah Area Chamber of Commerce. Councilman Youmans said he has served for the past two years on the State Public Safety Committee and was appointed by Governor Harris to serve on the Georgia State Criminal Justice Committee. The two positions are related. He said that it has been a tradition that members of Council and the Mayor go to the pre - legislative conference, Mayors' Day, and the GMA convention if they wish to go. He said he asked to go to Mayors' Day in Atlanta on January 26 -29 and his check wasn't approved. He moved that the city pay his expenses to Mayors' Day. A second was offered by Councilman Brown who said he believes this is one of the things that the money should be found to do, for any Councilman 1 1 Tybee Island, Georgia January 11, 1990 Page Ten who would like to go. Mayor Hosti spoke in explanation, saying that his reason for running for Mayor was to correct a situation that he viewed as a bad financial condition for the past four years, the city was spending $250 to $400 thousand dollars per year more than its income. He said when he was Mayor before the water /sewer utility had been in the red for two years and he started an austerity program that eliminated all unnecessary expense. He said in the present budget there is no money at this time to replace police cars or to make any major capital improve- ments. He talked about Mayor's Day saying that he'd like to go himself, and had enjoyed the times he went before, but believes the city can depend on its representatives, Tom Coleman and Jack Kingston, for all the state aid we can get. He said that the three months' projection showed a deficit for the first quarter of 1990 is likely, based on last year's expenditures. He asked cooperation of the entire Council to back off trips now to make time to get the city back on the right track. He said he suggested the city send one man, the Mayor pro tem Jimmy Brown, who'd never been before. He added that he wants to get the city into better financial shape without raising taxes. He said that the cost involved in pumping water is going to be looked into. All overtime is being eliminated. He said there is no cross - training in bookkeeping and it will cost a little to get this done, but it's important. It could cost 4 to 5 thousand dollars for every- one to go to Mayor's Day. Councilman Youmans said that his plans for Mayor's Day had included riding up with Councilman Brown, sharing a hotel room with him, so the expense would be registration and a few meals, since most meals are included in the registration. The vote was 3 -2, with Councilmen Youmans, Walsh and Brown voting for Councilman Youmans to make the trip. Councilmen Locklear and Dukes voted against. Councilman Jackson abstained, saying this did not, in his opinion, require a vote of Council, and never had been voted on before in his experience. The meeting was adjourned. REVOCABLE LICENSE FOR DUNE CROSSOVER STRUCTURE The undersigned applicant hereby requests permission from the City of Tybee Island, Georgia, to construct a dune crossover structure for the purpose of erosion control, and protection of certain waterfront property located within said city limits since a portion of the proposed project may encroach upon the sand beaches within the city limits of said municipality. The undersigned understands that thcl issuance of such a permit does not relieve the applicant of the obligation to obtain additional auth- orization from the State of Georgia. The undersigned further recognizes and agrees that this license does not confer upon the undersigned any rights, title, estate or interest in said licensed premises; nor does this license agreement confer upon the undersigned a license coupled with an interest or easement. This license merely gives the undersigned a revocable privi- lege, it being expressly understood and agreed that, regardless of any improvements or investments made, expense and harm incurred or encountered by the undersigned, this . agreement shall be subject to revocation, cancellation or termination, this 'license shall be null and void. The undersigned shall further indemnify and save the City of Tybee Island free and harmless from any and all liability, loss, cost, damage or other expense from accident or damage, either to itself or to the persons or property of others which may occur by reason of the exercise of the rights and privileges herein granted by this license. The undersigned applicant further recognizes that the City of Tybee Island does not grant permission to proceed with such project unless and until a Shore Assistance Permit is issued and a copy of same is filed wit e Clerk of Council of said city. "All cost and expense incident to the connection of the building sewer from the owner's building to the public sewer shall be borne by the owner. Any connection from the owner's property into the public sewer shall be made by the owner, under supervision of the sewer department, and no connection into the publ:.c sewer shall be covered until approval of the Superintendent of the department is granted. BE IT ORDAINED, AND IT IS HEREBY ORDAINED, BY THE MAYOR AND COUNCIL IN OPEN MEETING ASSEMBLED, THAT THE TYBEE ISLAND CODE OF ORDINANCES, SECTION 4 -4 -28 B BE DELETED IN ITS ENTIRETY AND THAT THE FOLLOWING SECTION BE NUMBERED AND TITLED THE SAME, BE INSERTED IN ITS STEAD: Section 4 -4 -28 B It shall be unlawful for any dog to be on the streets, lanes, highways or roads of the city or loose on vacant lots or unenclosed lots so that he may freely have access to the streets, lanes, highways or roads of the city, unless that dog is held firmly on a leash held by a person. It shall be the duty of any owner or possessor or any person who harbors or keeps any dog to confine securely the same within the limits of his own premises and not to permit that dog to run or have access to run the streets, lanes, highways, roads or parks.of the city except as above set forth or for hunting, field trials and the working of those dogs.
