January 30, 1990
A special meeting of the Tybee Island City Council was called to
order by Mayor Charles J. Hosti at 7:30 p.m. on Tuesday, January 30, 1990.
Present were the following members of Council: Paul Jackson, Jeff Dukes,
Jimmy Brown, Bill Walsh, Jack Youmans and Pat Locklear. City Attorney
Thomas J. Mahoney was also present, as were the following members of staff:
Rowena B. Fripp and Jacquelyn R. Brown.
The Invocation was given by Councilman Locklear. Mayor Hosti led
in the Pledge of Allegiance to the American flag.
The purpose of the special meeting was to consider a text amendment
to Code Section 8 -4 -35 (Planned United Development), and to hear a petition
concerning same.
No visitors wished to speak concerning the PUD text change.
The public hearing closed, and the meeting was opened for business
legally presented.
Dick Smith, the developer, spoke in favor of a project to be developed
at 39 Pulaski Street, on approximately 1.6 acres of ocean front land. He said
he wants to build a single family residential development and is willing to
meet the restrictions of a PUD so that the Planning Commission and the City
Council will have several opportunities at different stages of completion to
review the project. He said PUD gives the Council more control than any other
option would. He said that this is the reason the Planning Commission has
recommended the change in definition to include single family developments on
one acre or more.
Councilman Dukes stated that it should be very clear that the city
is not considering a variance to suit Mr. Smith's needs, but a permanent change
in the ordinance which was recommended by the Planning Commission after study.
Councilman Youmans read the pertinent passage from the minutes of
the Planning Commission minutes recommending the change. He then moved that
the ordinance be adopted. After a second by Councilman Dukes, the ordinance
passed unanimously on First Reading.
City Attorney Mahoney said that the record should reflect that the
Councilmembers had before them the criteria for zoning found in Code Section
8 -4 -74, and that their judgement is based on these criteria. The record should
further show that the requirements for a public hearing, Code Section 8 -4 -73
had also been followed.

Mr. Mahoney then read the ordinance for the second time. Councilman
Youmans moved its adoption; the second was by Councilman Dukes and the vote
was 6 - 0 in favor of adoption. A copy of the ordinance, Code Section 8 -4 -35,
is attached to, and becomes a part of, these minutes.
A petition for a single family PUD was then considered. It was
noted that the public hearing for this project has already been held and that
action was delayed to allow time for advertisement and consideration of the
Code change just adopted.
Dick Smith spoke for the development, saying that plans for the project
had been delivered to the city in December, and was favorably recommended by the
Planning Commission at its January meeting. He spoke of the request from the
city to locate the required dune crossover structure where an easement access
for the public can be allowed, saying that this change on the plat has been
made but must yet be approved by Dr. Marland of DNR. A revocable license for
the crossover will be needed, also. Councilman Jackson moved that the PUD for
the single family development be accepted as shown on the plat, and Councilman
Walsh seconded the motion. The vote was unanimous in favor. Mayor Hosti com-
mended Mr. Smith for his cooperation about the crossover.
The meeting was adjourned, to be followed by agenda preparation for
the regular meeting of February 8, 1990.

OF ORDINANCES, SECTION 8 -4 -35 DEFINITION OF
PLANNED UNIT DEVELOPMENT.
BE IT ORDAINED, AND IT IS HEREBY ORDAINED BY THE MAYOR AND COUNCIL IN
OPEN MEETING ASSEMBLED, THAT THE TYBEE ISLAND CODE OF ORDINANCES,
TITLE 8. Planning & Development, CHAPTER 4. Zoning, PARAGRAPH 35 Planned
Unit Development, BE DELETED IN ITS ENTIRETY, AND THAT A NEW PARAGRAPH,
TO BE NUMBERED AND TITLED THE SAME, BE INSERTED IN ITS STEAD, READING AS
FOLLOWS:
Section 8 -4 -35. Definition
A Planned Unit Development is any multifamily development, including town-
houses, apartments or condominiums consisting of ten (10) acres or more,
or single family planned unit development on one (1) acre or more, which
in design and construction complements the cultural and historical values
of the surrounding area.
