On motion of Councilman Turley, duly seconded and carried, it was or- dered, that the salary of $15.00 per month for the janitor at the Public Comfort Station be withdrawn until further notice. There being no further business, on motion the Council adjourned. • gigtAiffthe MAYOR. _ / t/ I RECORDER. • • • At a regular meeting of the Mayor and Town Council of the town of Leesburg, in Virginia, held in the Council Chamber on May 25, 1936, at 7:30 P.'M., there were.present, E. N. Bradfield, Mayor; Roscoe B. Rhoads, Recorder; Herbert Howard, Laurence S. Hutchison, Harry F. Norton, W. Emory Plaster, Louis C. Rol- lins and Joseph H. Turley, Councilmen. Town Auditor Galleher also was present. The Minutes of the last meeting were read and approved. On motion of Councilman Rollins, duly seconded and carried, Marie Medley 111 was granted permission to establish a beauty and hair dressing establishment in Leesburg, upon payment of the proper license. The Mayor presented a check from Garrett & Co., in amount of $2.76, for a refund on the insurance premiums on the Town Hall building. On motion of Councilman Turley, duly seconded and carried, unanimously, the following Ordinance was adopted:- — BE IT ORDAINED; That, it shall be unlawful to play and/or operate a Symphonola, Mills Automatic Phonograph or any similar music device in any business place between the hours of 12:00 midnight and 8:00 A.M. The proprietor of a business place wherein this ordinance is violated, .a 24 , shall be punished--by a fine of.not less than three dollars ($3.00) nor more than ten dollars ($10.00) for each offense. On motion of Councilman Plaster, duly seconded and carried, the matter of using the room. in the Town Hall Building for a rummage sale by the Crusaders Class of the Methodist Episcopal Sunday School, on June 6, 1936, was left to the discre- tion of the Town Hall camnittee. • The Budget and License Ordinance for the town of Leesburg, in Virginia, as read by the Town Auditor at the meeting of April 17, 1936, was presented, and upon motion of Councilman Howard, duly seconded and-unanimously carried, was adopted as read and published, as follows:- • BUDGET FOR THE TOWN OF LEESBU?G. Telegraph Companies 25.00 • Telephone Companies 50.00 • Tobacco & Cigar Dealers 5.00 Undertakers . 20.00 • Any person, firm or copporation, transporting gasoline or other petrol- eum products of like nature, on or through the streets of the town of Leesburg, for sale and delivery to wholesale or retail merchants or to other persons for re-sale in the town of Leesburg, shall pay a license tax for the privilege of do- ing such business inthe town of Leesburg of $100.00 . Every person, firm of corporation, except those specifically provided for elsewhere in this ordinance or specifically exempted from municipal taxation by the State, who shall sell and deliver at the same time, goods, wares, manu- factured products or merchandise to licensed dealers or retailers, shall pay a specific tax of $50.00 per annum per vehicle, which license shall not be pro- rated or transferred. Every vehicle used in the aforesaid shall have conspic- uously displayed thereon the name of the person, firm or corporation using the same, together with hie or their post office address, and the license provided for herein shall be conspicuously displayed in each vehidle. Any person, firm 2G • • or corporation, violating the provisions of this section shall be liable to a fine of not less than $50.00 nor more than $100.00, for each offense. Every person, except merchants, paying a corporation license tax to the town of Leesburg for the privilege of peddling, delivering or bartering anything except the product.of a farm, owned or pperated by him, to consumers to the town of Leesburg, shall pay a license tax of $100 .00 Every person, firm or corporation selling or delivering at the same time, goods, wares or merchandise of any kind in the town of Leesburg, other than at a definite place of business, goods, wares ormerchandise to the licensed dealers or retailers shall pay a license tax thereby of $50.00. It is further provided that every vehicles used in the business aforesaid shall have conspicuously displayed thereon the name of the person, firm or corporation using the same, to- gether with its or his post office address and such license shall be conspicuous- ly displayed on each such vehicle. All persons, firms or corporations not pay- ing a State license tax or tax to a corporate sub-division thereof, shall pay a license tax of $50.00, whether orders are taken in advance or not. Every person, firm or corporation, who shall engage in the business of photographer, or shall act as a photographer agent or canvasser, shall pay for the privilege the sum of $5.00. Every proprietor or occupant of a publie hall or other room fitted for public exhibitions, balls, performances, fairs, or other entertainments, to which admission or charges for participation are made, or for Watch free will offerings are received or who uses or rents the same for such purpose, or receives.charges of free will offerings for participation therein or therefor, shall pay $25.00 license tax for such privilege; and no person shall, without a license authoriz- ed by law, charge for the use of same while used or employed for any of the pur- poses aforesaid, or for any lecture, concert or any other exhibition. Every printer shall pay for the privilege the sum of $10.00. Every person, firm or corporation owning and operating a blacksmith's shop, wheelwtight shop, watch repair shop or repair shop of any kind, except an auto garage doing repair work shall pay a license tax of $5.00 for the privilege. No person shall be allowed to conduct any shooting gallery or gallery for target practice with guns, pistols, or other similar implements or with bow and arrow, or gallery of other like amusements, for profit, without first having obtained a license therefor, anf for the privilege of conducting such'a gallery, shall pay a license tax of $50.00. No license shall be issued without first obtaining a special permit for same from the Council. Every non-resident baker, vendor of meats, ice cream, soft drinks, or other merchandise, who operates delivery wagons, shall pay a license fee of $15.00 per year for each vehicle so pperated, except that this shall not apply to wagons or trucks making delivery of merchandise to fill orders previously taken in writ- ing. All persons, firms or corporations engange in business not specifically • embraced in the foregoing sections and liable to taxation under the laws of the State of Virginia, there shall be assessed by the Sergeant of the town the same lioense tax as assessed by the State. For interpretation of the above businesses, reference is made to the Statutes of Virginia, defining said businesses. Mr. Francis Castle requested the use of the Town Hall on the night of Wednesday, June 3, 1936, for the Senior Dance of the Leesburg High School, and upon motion of Councilman Plaster, duly seconded and carried, the request was granted. It was moved by Councilman Plaster, duly seconded and parried, :that the Auditor be awarded the sum of $25.00 in compensation for services rendered in preparing the tentative budget. • .
