HomeMy Public PortalAbout1936_07_14SPEC 32 At a special meeting of the council of the town of Leesburg, in Virginia, held in council chambers in Leesburg, Virginia, on the 14th. day of July; 1936, ' at 7:30 P. M., councilmen Flippo, Howard, Turley and Rollins, they being all members of'the council present at the meeting, voted for the following pream- bles and resolutions which were proposed and adopted: Whereas, the council of the town of Leesburg, in Virginia, is advised that the Washington and Old Dominion Railway Company is now in receivership; and, Whereas, a newcoorporation known as the Washington and Old Dominion Railroad Company has been chartered and is about to conclude the purchase of the assets from the Washington and Old Dominion Railway Company and proposes to operate a railway service in Loudoun County, conditioned upon the payment of all delinquent taxes due the town of Leesburg, in Virginia, from the Wash= ington and Old Dominion Railway Company and further conditioned upon the said town exempting the Washington and Old Dominion Railroad Company from the pay— ment of taxes for a certain period of years as permitted under section 435(b) of the Tax Code of Virginia; and, Whereas, great loss and injury would ensue to the town of Leesburg, in Virginia, and its citizens in the event of a discontinuance of the railroad service to this community; Now, Therefore, Be it Resolved: That the said Washington and Old Dominion Railroad Company, in the event thatit begins in the immediate future railroad service to Leesburg, Virginia, as now exists and will thereafter continue same; it will be exempt from the payment of all town taxes assessed for tax years 1936, 1937, and 1938, with the understanding that a further exemption not exceeding two additional years may, if necessary, be extended to it at the end of the said three year period. This exemption, is, however, made on the express condition precedent ' to the operation of the same, that the said Washington and Old Dominion Rail- road Company or some one else for it shall pay to the town of Leesburg, in Vir- ginia, within forty-five days from this date all taxes, penalties and interest now in arrears and unpaid assessed against the Washington and Old Dominion Railway Company. This resolution shall be null and void unless the said Washington and Old Dominion Railroad Company shall within forty-five days from this date pay to the town of Leesburg, in Virginia, the taxes due by the said Washington and Old Dominion Railway Company as set forth above.
